Nagpur airport: 60 buildings violate height norms, demolition stuck in red tape

Nagpur: Mihan India Limited (MIL) has over a year ago sent notices to 60 buildings with height norm violations that 'obstruct' flights taking off from the current runway. A final resolution of the problem, though, remains mired in long bureaucratic procedures.
Multiple agencies are involved before a part of any building that exceeds the stipulated height can be demolished. This delays the decision-making process, said sources.
Until 2015, Airports Authority of India (AAI) determined a building's height according to the distance and issued a no-objection certificate (NOC). However, it is Mihan India Limited (MIL) — the airport operator — that issues notices for any violation to the builder.
After that, the final decision lies with a third agency — the Directorate General of Aviation Safety (DGCA).
According to the Aircraft (Demolition of Obstruction Rules), only the DGCA has the power to order a demolition. MIL, as a state govt agency, cannot proceed by itself, a source explained.
In Nagpur, there were 68 buildings that MIL found to be violating the AAI's height norms. This was a mix of buildings with additional floors or even a structure on the terrace, which takes its height beyond the limit.

All the buildings were from the pre-2015 era, said sources, and were largely located in Jaitala. MIL conducted its own exercise to confirm that the height norms were indeed violated and informed the DGCA, said a source.
The DGCA has its own system of sending notices and also giving the builders a final chance to be heard. A hearing was held in Nagpur over eight months ago.
Orders for demolition of parts of eight buildings were issued and even complied with. However, no decision has been taken for as many as 60 structures.
The DGCA can even order a fresh survey to determine the distance from the airport and the height. However, there have been no orders for that too, a source said. These 60 buildings come in the way of the runway. If the entire airport premises and the proposed second runway are considered, 161 buildings have exceeded the height and notices have been sent.
According to a RTI reply, 22 such obstructions have been removed. Out of these, eight were in the landing and take off path of aircraft.
The MIL is now waiting for a decision by the DGCA. In case a demolition has to take place, the DGCA has to carry it out through the highest govt authority in the district. This can be the collector, divisional commissioner, or even the municipal commissioner, said a source.
The system has been streamlined after 2015, reducing the scope of violations, said a source. Applications now have to be made through the No-Objection Certificate Application System (NOCAS) — an online mechanism of AAI. The MIL is also part of the process and can recommend rejection of NOC if it finds that incorrect coordinates are given to determine the distance, a source said.

Dehradun (Uttarakhand) [India], June 15 (ANI): Uttarakhand Chief Minister Pushkar Singh Dhami on Sunday warned of strict action against the culprits after seven people were killed in a chopper crash in Uttarakhand's Rudraprayag district and said that aviation companies have been directed to follow the rules of Directorate General of Civil Aviation. Following the incident, the Chief Minister informed that the Helicopter services will not run for the next two days. Speaking to ANI, CM Dhami said,' This morning, a helicopter crashed due to bad weather. I pray to God for those who lost their lives.' Calling for strict compliance with safety norms, the Chief Minister said, 'An emergency meeting has been called immediately, in which instructions have been given that the rules of our DGCA (Directorate General of Civil Aviation) should not be violated, and the pilots flying in the upper Himalayan areas should have experience of the region. Aviation companies should also ensure this.' 'A control and command centre should be set up. Strict action will be taken against the culprits in this accident... Helicopter services will not run today or tomorrow. These services will remain closed until the safety of the passengers is ensured,' he told ANI. Earlier this morning, seven people, including the pilot on board a helicopter were killed after the chopper crashed near the forested area of Gaurikund in Uttarakhand's Rudraprayag district, the State Disaster Response Force (SDRF) said. The Aryan Aviation Helicopter was flying to Guptkashi from the Kedarnath Dham when it crashed at 5:30 am today. The deceased have been identified as Captain Rajbir Singh Chauhan (39), resident of Jaipur, Vikram Rawat (47) a Badrinath Kedarnath Temple Committee representative and resident of Rasi, Vinod Devi (66), resident of Uttar Pradesh, Trishti Singh (19), resident of Uttar Pradesh, Rajkumar Suresh Jaiswal (41), resident of Gujarat, Shraddha Rajkumar Jaiswal and Kashi (2), resident of Maharashtra. Rescue teams were immediately dispatched under the direction of SDRF Commander Arpan Yadav. The incident spot was located in a very inaccessible and dense forest area, where a fast-paced and coordinated rescue operation was carried out by the joint teams of SDRF, NDRF, and local police. Rescue teams worked in inclement weather to retrieve the bodies of the deceased. Uttarakhand Chief Minister Pushkar Singh Dhami held a virtual high-level meeting with senior officials from the CM residence after the helicopter crash. State Chief Secretary, Disaster Management Secretary, UCADA CEO, Garhwal Commissioner and other senior officials were present in the high-level meeting. The Aircraft Accident Investigation Bureau (AAIB) will investigate the crash, the Directorate General of Civil Aviation (DGCA) stated. The DGCA further said that, in light of the crash, the frequencies of helicopter operations to Char Dham would be reduced as a precautionary measure. Sonika further stated that the District Magistrate and Senior Superintendent of Police (SSP) will reach the site soon. 'Since the rescue operation is underway and seeing the weather conditions in the valley, our shuttle services have been closed. Almost all the helicopters are involved in the rescue operation. DM and SSP will also reach the site soon,' Sonika told ANI. 'At around 5:30 AM, we got the information that a helicopter, which was going from Shri Kedarnath Dham to Guptkashi, could not be located. After some time, it was learnt that it had crashed near Gaurikund. Rescue operation is underway, SDRF teams have reached the spot. In the wake of a tragic helicopter crash in the Gaurikund area of Uttarakhand, the Ministry of Civil Aviation on Sunday issued strict instructions to the Directorate General of Civil Aviation (DGCA) to enforce all safety protocols related to chopper operations in hilly and sensitive areas like the Kedarnath valley. The ministry has emphasised that passenger safety is non-negotiable. It has warned that no helicopter operator should fly in unsafe weather or break operational rules. The DGCA has been instructed to enforce all rules strictly and ensure that safety and discipline are maintained at every level, especially in pilgrimage zones where lives are at high risk. The helicopter involved in the accident belonged to Aryan Aviation and was operating on the 'Shri Kedarnath Ji-Guptkashi' sector. The Bell 407 chopper (Reg. VT-BKA) took off from Guptkashi at 5.10 a.m. and landed at Kedarnath at 5.18 a.m. It departed again at 5.19 a.m. for its return journey but tragically crashed near Gaurikund sometime between 5.30 and 5.45 a.m. There were five passengers, one infant, and one crew member on board. Rescue teams from the National Disaster Response Force (NDRF) and the State Disaster Response Force (SDRF) are carrying out operations at the crash site. Preliminary findings suggest the crash may have been caused by Controlled Flight into Terrain (CFIT), with reports of poor visibility and dense clouds at the valley entry point. "The exact cause will be confirmed after a detailed probe by the Aircraft Accident Investigation Bureau (AAIB)," the ministry said. In Uttarakhand, Chief Minister Pushkar Singh Dhami held a high-level emergency meeting at 11 a.m., attended by top officials from the state government, the Civil Aviation Ministry, the DGCA, and other agencies. "Following the incident, the operations of Aryan Aviation for the Char Dham Yatra have been suspended immediately," the ministry added. Two helicopters from TransBharat Aviation were also found flying in similarly dangerous weather conditions. "The licenses of both pilots involved -- Capt. Yogesh Grewal and Capt. Jitender Harjai -- have been suspended for six months," it said. To ensure safety, all helicopter services in the region have been suspended on June 15 and 16. The Uttarakhand Civil Aviation Development Authority (UCADA) has been directed to conduct a thorough review with all helicopter operators and pilots before flights are allowed to resume. A Command-and-Control Room will be set up by the UCADA to monitor real-time flight operations and raise alarms in case of any risk.
