NC House committee advances 'Second Amendment Financial Privacy Act'

Rep. Reece Pyrtle (R-Rockingham) told colleagues Tuesday that his efforts to pass the Second Amendment Financial Privacy Act stems from a merchant category code that was created in 2022 for gun and ammunition sellers. The International Organization for Standardization (ISO) approved the code as a way to identify suspicious and potentially illegal weapons purchases.
At the time, groups like Everytown for Gun Safety praised the specific merchant category code ('MCC') noting that it could provide necessary data for banks and law enforcement to identify transactions that may be related to mass shootings or other gun-related crimes.
Rep. Pyrtle told members of the House Commerce committee that this code, which would appear when a firearms purchase is made by credit card, creates a burden on lawful gun owners.
'The surveillance causes a significant and chilling effect on individuals in North Carolina wishing to exercise in their federal and state constitutional rights to keep and bear arms,' Pyrtle explained.
House Bill 38 would prohibit payment card networks like Visa or Mastercard from using a firearms code for recording transactions or from maintaining any sort of firearms registry.
'This is really a piece of legislation that I think is protecting individuals from industries outside this country and the individuals from private sector from collecting data,' said Pyrtle.
Pyrtle's bill would also grant North Carolina's Attorney General the power to investigate any alleged violation by the credit card networks and assess civil penalties.
Rep. Bryan Cohn (D-Granville) questioned whether the legislation might have an unintended consequence of making it more difficult to investigate gun-related crimes.
'There's a federal law that prohibits a firearms list of ownership. You're not supposed to do that,' said Pyrtle, a retired police chief. 'And as an investigator, I can always go to the federal firearms licensed dealer and request a search as part of my investigation.'
Three states – California, Colorado, and New York – were the first to pass legislation that would require the unique category code for gun and ammunition sales.
Sixteen states have passed legislation that bans the use of the merchant category code for gun store purchases.
Pushback from gun rights groups has largely prompted the larger credit card companies to pause their use of the specific code.
House Bill 38 advanced on a voice vote Tuesday and now moves to the House Judiciary I Committee.

Germany Suspends Humanitarian Visas For Russian Dissidents

The new German coalition government has reportedly suspended a visa program for people suffering political persecution in their home country. This in particular appears to affect people in Russia who are critical of the war against Ukraine, including journalists, activists and others targeted by the Russian government. In its rush to clamp down on migration of all kinds, Germany is also reported to have halted the issuance of humanitarian visas already approved. According to Deutsche Welle, hundreds of Russian dissidents had been approved visas under Germany's humanitarian scheme, but the actual issuance of those visas has been blocked by the ministry of interior. These include journalists, activists and a man who was arrested after his school-age daughter drew a picture apparently critical of Russia's war against Ukraine. When approached by Deutsche Welle, a spokesperson for the German interior ministry explained that, as the new coalition government of Germany had agreed to limit migration pathways such as the humanitarian visa, issuance of those visas would be halted, with some limited exceptions in 'urgent cases.' Given Germany's stance on the war in Ukraine, this suspension is somewhat a surprise, especially given the relatively small amount of Russian dissidents who have or are seeking this visa and the propaganda value governments typically get through such visas. Governments have long used visa and asylum policy to political ends, allowing in refugees and dissidents and then using their flight as evidence of the failings of hostile countries. Notable cases of this include the US accepting Cuban refugees during the Cold War, in what was known as the Mariel boatlift, and the continued attention on people who manage to flee North Korea. In Germany, however, immigration of all kinds is the dominant political issue, apparently trumping all others. Chancellor Friedrich Merz, sworn in with his cabinet earlier this year, has long been to the right on the issue. Nipping at his heels is the stridently anti-immigration party Alternative for Germany, which has seen considerable gains in recent years in state elections and opinion polls. Germany has already taken several steps to tighten immigration of all kinds - regular and irregular. These include implementing border checks with its neighbors, pursuing more active 'pushback' strategies and tightening rules on family reunification and citizenship eligibility. Nonetheless, calls for ever-further tightening of the border have led to the new coalition government, in which Merz's conservative Christian Democrat party govern with the Social Democrats, pursue every opportunity they can to cut numbers down further. It is conceivable the reporting from Deutsche Welle on the Russian dissident issue, which has been picked up by several other outlets, may see those several hundred people currently waiting for humanitarian visas find some relief. DW notes that a lawyer working with a group that supports Russian dissidents abroad is hopeful the ambiguity in the interior ministry's comment may leave room for hope. More broadly, however, this affair is a sign of just how far states in western Europe are willing to go in trying to cut down on immigration numbers.
