Kota Kinabalu: A 45-year-old civil servant was charged with using a fake document to get claim amounting to RM19,100. Town Planning Officer, Nazri Hamburg, pleaded not guilty before Sessions Court Judge Jason Juga, to the charge against him on Wednesday.
Advertisement Nazri is accused of submitting the fake claim statement which was a bill from Syarikat Pengangkutan Putra dated May 12, 2017 for payment of transporting two vehicles to Papar and three workers to move/carry goods when in fact the service was never rendered. He allegedly submitted the fake document dated June 12, 2017 to an Administrative Assistant (Finance) at the Sabah Town and Regional Planning Department with intention to deceive his principal. The alleged offence took place on Oct 2, 2017 at the Sabah Town and Regional Planning Department, here. The offence under Section 18 of the Malaysian Anti-Corruption Commission Act (MACC) 2009, punishable under Section 24(2) of the same Act provides for a jail term of up to 20 years and a fine of not less than five times the amount or value of the false particulars, or RM10,000, whichever is higher, upon conviction. The court fixed July 10 for pre-trial case management. Nazri was released on bail of RM10,000 with RM5,000 deposited in a local surety. The court also ordered Nazri to report once a month to the MACC office and his passport, if any, to be kept by the court. The court also reminded him not to disturb the prosecution's witnesses pending disposal of the case. Horrific Gerik crash exposes dark truth behind bus permit leasing
KOTA BARU: Thousands of express and tour buses are operating illegally nationwide using leased permits, a practice that contravenes the Land Public Transport Act 2010, the Bumiputera Express Bus Operators Association of Malaysia (PPBBM) said. PPBBM chairman Zainal Abidin Mehat said the issue of leasing public transport bus permits has been ongoing for some time. However, it only came to light following the recent fatal crash involving a tour bus carrying students from Sultan Idris Education University (UPSI) along the East–West Highway near Gerik, which claimed 15 lives. Zainal said some bus operators conduct business without any valid permit by purchasing second-hand buses and operating them under permits obtained from various other companies. This, he said, is because many bus operators, most of whom are former bus drivers, are unwilling to apply for permits due to the high upfront cost and the numerous procedures required by the Ministry of Tourism, Arts and Culture (MOTAC) or the Land Public Transport Agency (APAD). "There are even companies that own dozens or hundreds of permits and take advantage by leasing them out, whether for express or tour buses, at a rate of RM500 per month per permit, raking in tens of thousands of ringgit monthly," he said. Zainal said that the practice of leasing express and tour bus permits has been going on for years. "I often receive complaints about this issue, but it remains unresolved because there is both supply and demand in the permit leasing market. "The modus operandi involves bus operators purchasing second-hand buses over 10 years old for between RM70,000 and RM100,000, repainting them to appear new and attractive, and using them as tour or express buses. "To avoid dealing directly with APAD or MOTAC, they simply lease permits from companies offering such services, paying RM500 a month," he told Berita Harian. Zainal said that due to high demand, some bus companies that have more than 100 express or tour bus permits lease out nearly all of them. These companies retain only a few permits for their own use to avoid detection. "Imagine a company with 100 permits earning RM500 per permit every month, they can easily make tens of thousands of ringgit monthly," he said. "They lack the proper knowledge to become legitimate operators and are only chasing fast money, with little concern for the safety of future passengers. "If the fatal crash on the Gerik-Jeli road hadn't occurred, this issue might never have been exposed, even though in reality it involves thousands of buses across the country. "They're also crafty, during APAD enforcement operations, these buses are kept off the road temporarily to avoid detection for operating under permits belonging to other companies. "That's why sometimes you'll see one company name on the bus body and another on the permit," he said. He urged the government to take firmer and more drastic action against bus operators using leased permits. "We welcome the move by the Transport Ministry to revoke the licences of bus companies found to have leased out their permits," he said. The Malaysian Anti-Corruption Commission (MACC) chief commissioner said the length of time is needed to enable the investigation team to obtain complete information. 'We need to analyse several documents including financial statements. 'So far, we have recorded the statements of 53 witnesses to assist with the investigation,' he said after attending the MACC Law Enforcement Accredited Programme convocation yesterday. Azam said more witnesses will be called up to assist with the investigation. Azam had said the highway concessionaire is a key witness in the investigation. Earlier reports stated that 45 people who had given statements were recalled to provide more information. On June 3, the MACC disclosed that it had seized assets worth around RM143mil concerning the case. Investigators are also tracing luxury vehicles and properties linked to the Tan Sri, including assets in London and Switzerland. On another matter, Azam said at least two people are expected to be charged in connection with a video clip of an alleged corruption scandal involving a Sabah assemblyman. He said he will make the announcement of the prosecution soon. It was reported that the MACC has completed the investigation paper regarding the case. According to a source, the investigation paper was sent to the prosecution for review two weeks ago. Several video recordings have gone viral, allegedly showing conversations between certain people and several Sabah lawmakers regarding the issue of mineral licensing in the state. Meanwhile, the statement recording of a Tan Sri had resumed yesterday at his residence following a six-hour session on Wednesday, he added. A white Toyota Vios carrying MACC officers was seen entering the individual's residence at 8.45am in Bandar Tasik Selatan here while the MACC's Anti-Corruption Tactical Squad (ACTS) arrived at the premises at 10.50am yesterday. The ACTS officers were seen armed with firearms. Four vehicles were seen entering the property, including two white vans, a Nissan Grand Livina and a Honda City. One of the entrances to the property was also sealed by auxiliary police from a private company, with cones and barriers placed at the gate. Media personnel were prevented from approaching the area.
