Habitual addict gets 7 years and 3 lashes

Kota Kinabalu: A 47-year-old man was jailed seven years and ordered given three strokes of the cane for taking syabu repeatedly. Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Eddy James, after ruling that the prosecution had proven its case beyond reasonable doubt against Eddy. Eddy was found guilty of taking the drug at 12.20pm on Dec 28, 2023 after his urine tested positive at the police station here. He has two previous conviction records for taking the drug. They were arrested in Tambunan on May 15 this year after failing to produce identification documents to the immigration personnel who carried out an operation in the area. After serving the jail sentence, the illegal immigrants were ordered referred to the Immigration Department for deportation. Five years, fine for role in prostitution

Kota Kinabalu: A 27-year-old woman was jailed five years and fined of RM10,000, or jailed 10 months for being a middle person in offering sexual services to a man. Sessions Court Judge Elsie Primus meted out the sentence to Amiliana Pius Abdullah, after ruling that the prosecution had proven its case beyond reasonable doubt against Amiliana on Tuesday. Amiliana was found guilty of being the middle person between the man and a 20-year-old woman in offering RM350 per prostitution service at 11.30pm on Feb 2, 2022 at a unit of an apartment, here. The offence under section 372(1)(f) of the Penal Code and punishable under Section 372(1) of the same Code carries a jail term of up to 15 years, whipping and liable to a fine, on conviction. The court granted Amiliana's application to stay execution of the jail sentence pending appeal against the decision to the High Court but the fine must be paid on Tuesday. Man freed of sexually harassing niece, 10

Kota Kinabalu: A 38-year- old man was freed of a charge of committing physical sexual harassment against his niece, without his defence being called. The man was discharged and acquitted by Sessions Court Judge Amir Shah Amir Hassan who ruled that the prosecution had failed to establish a prima facie case against the man. The man was accused of committing the offence against the 10-year and 10-month-old girl by fondling her breasts during the day on Dec 31, 2022 at a house in Penampang. He was charged under Section 14(a) of the Sexual Offences Againts Children Act 2017, which provides for a jail term of up to 20 years and whipping, on conviction. Four witnesses had been called by the prosecution during the hearing. Carrying machete in public: Filipino jailed 5 years, 2 strokes

Kota Kinabalu: A 20-year-old Filipino who had in possession a machete in the public without any permit, was jailed five years and ordered to get two strokes of the cane. Khalid pleaded guilty before Sessions Court Judge Amir shah Amir Hassan, to the charge against him on Friday. Khalid was found having the weapon at 11.30pm on May 12 this year by the roadside in Lorong Taman Bukit Setia 1, Sepanggar, here. The offence under section 6(1)(a) of the Corrosive, Explosive and Dangerous Weapon Act 1985 carries a jail term of between five and 10 years, and whipping, on conviction. The court ordered Khalid to serve the jail sentence from the date of his arrest and referred to the Immigration Department after completing the jail sentence. During mitigation, Khalid who was not represented, asked for leniency saying that he has a wife and two children, to look after. Advertisement However, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged the court to impose a heavy sentence the grounds that it was a serious and rampant. She submitted that the act by Khalid had posted threat to the public because bringing a dangerous weapon in the public that might cause death. Nurul also told the court that Khalid was sentenced to four months' jail for entering the State illegally. The court heard that while the policemen were on patrol duty to prevent crime when they saw a man in suspicious behaviour while holding an object at the said place. The police then detained the man who later identified as Khalid and the object he held was a machete. Khalid did not have any permit to carry the weapon in the public. Syabu: Jail, rotan for retired army

Kota Kinabalu: A 37-year-old retired army from Kedah was jailed five years and ordered given a stroke of cane for taking syabu for the third time. Mohd Ikmal Amir pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan, to the charge against him on Wednesday. Mohd Ikmal repeatedly took the drugs at 9am on Jan 21, this year after his urine tested positive for drugs at the Papar police station and he has two previous conviction records for drugs. The offence under Section 39C (1) (b) of the Dangerous Drugs Act carries a jail term of between five and seven years and whipping, on conviction. The court ordered the accused to serve the jail sentence from the date of his arrest. After completing his jail sentence, Mohd Ikmal was ordered to be placed under police supervision for three years. Advertisement Before meting out the punishment, the court advised Mohd Ikmal not to repeat the offence in future. The judge hoped that the punishment would also set as a reminder or deter not only Mohd Ikmal but also the public at large from taking syabu. In mitigation, Mohd Ikmal, who was unrepresented, asked for leniency and requested the jail term to be served in Sungai Buloh as he did not have any family member in Sabah. He told the court that he stayed with the drug addicts and was influenced to take drugs. Mohd Ikmal, who never not married, also claimed that he had promised to his mother that he would return home once he becomes a successful person but cannot do so as he did not have money.
