Supreme Court halts MP HC order in Saif Ali Khan family estate dispute

The Supreme Court on Friday granted an interim stay on a Madhya Pradesh High Court order remanding a decades-old property dispute involving the royal estate of Bhopal's last Nawab, Hamidullah Khan, to the trial court for fresh adjudication.
A bench comprising Justices P S Narasimha and Atul Chandurkar issued notice on a plea of Omar Faruq Ali and Raashid Ali, descendants of the elder brother of Nawab Hamidullah Khan, against the high court's order of June 30.
The petitioners have challenged the high court's decision to set aside a February 14, 2000, trial court judgment that upheld the exclusive rights of Nawab's daughter Sajida Sultan, her son Mansoor Ali Khan (former India cricket captain), and their legal heirs, actor Saif Ali Khan, Soha Ali Khan, Saba Sultan, and veteran actress Sharmila Tagore, over the estate.
The high court said the trial court's ruling was based on a 1997 Allahabad High Court verdict which was later overturned by the Supreme Court in 2019.
However, instead of applying the 2019 precedent and deciding the case conclusively, the high court remanded the matter for re-evaluation.
Senior advocate Devadutt Kamat, appearing for the petitioners, said the high court remand order was contrary to the procedural norms outlined under the Civil Procedure Code (CPC).
The case has its origins in civil suits filed in 1999 by members of the Nawab's extended family, including the late Begum Suraiya Rashid and her children, Mahabano (also deceased), Niloufar, Nadir, and Yawar, as well as Nawabzadi Qamar Taj Rabia Sultan, another daughter of the Nawab.
The plaintiffs sought partition, possession, and equitable settlement of the Nawab's private estate.
The trial court ruled in favor of Sajida Sultan, stating the estate was not subject to Muslim Personal Law and had devolved upon her under constitutional provisions.
Following the Nawab's death in 1960, the Government of India issued a 1962 certificate recognising Sajida Sultan as both the ruler and rightful heir to the personal estate under Article 366(22) of the Constitution.
The plaintiffs, however, contended the Nawab's personal estate should be distributed among all legal heirs under Muslim Personal Law.
They also pointed out the 1962 certificate was not formally contested but claimed it should not bar equitable partition.
The respondents, including actor Saif Ali Khan and his family, argued succession followed the rule of primogeniture and Sajida Sultan had rightfully inherited both the royal title (Gaddi) and personal properties.
While overturning the trial court ruling, the high court remanded the case.
The petitioners moved the top court seeking reversal of the remand order.

The protest was organised in opposition to the Special Intensive Revision (SIR) of electoral rolls in Bihar, which the Opposition claims is a move to manipulate voter data ahead of the upcoming Assembly elections. Speaking to IANS, Mrityunjay Tiwari said, 'This protest is being waged both in the House and on the streets. There are deliberate attempts to weaken democracy. We will not allow vote theft with SIR. This is a major battle to safeguard democratic principles.' Reacting to the ECI's demand that LoP Rahul Gandhi either issue a formal declaration or apologise for his statements regarding electoral integrity, Tiwari alleged that the poll body was working under the influence of the central government. 'It is evident that the ECI is acting on a script written by the Centre. Rahul Gandhi is the Leader of the Opposition; he has raised serious concerns, and it is the duty of the ECI to clarify. Instead, they are asking for oaths. What oath is needed? The Election Commission has deviated from its responsibility and accountability,' he told IANS. Meanwhile, the Delhi Police on Monday detained several INDIA Bloc leaders, including LoP Gandhi, Priyanka Gandhi, Trinamool Congress leader Sagarika Ghose, and Shiv Sena (UBT) MP, Sanjay Raut, as they attempted to march to the ECI's office. Among the key figures leading the protest were Congress President Mallikarjun Kharge and Samajwadi Party (SP) leader Akhilesh Yadav. The leaders accused the ECI of failing to prevent voter list tampering during last year's Lok Sabha elections and claimed the SIR process in Bihar is another attempt to manipulate the democratic process. In a dramatic moment during the protest, Akhilesh Yadav was seen jumping over a police barricade as security personnel tried to halt the march. Several other leaders were detained for attempting to breach the barricades en route to the ECI office. Following his detention, LoP Rahul Gandhi told reporters, 'The ECI cannot even speak, and this is the reality. The truth is visible to the nation. This march is not political; it is a battle to protect the Constitution — a fight for 'one man, one vote.' We demand a clean and transparent voter list.'

Karnataka Chief Minister Siddaramaiah on Monday accused the BJP-led Central government of "weaponising" police against the INDIA bloc MPs instead of "addressing rot" in the electoral system, as "exposed" by Rahul Gandhi. He made the remarks after the Delhi Police today detained INDIA bloc MPs, for protesting against the poll body over the ongoing Special Intensive Revision (SIR) of electoral rolls in poll-bound Bihar and allegation of "voter fraud" during the 2024 Lok Sabha elections. "The cowardly Narendra Modi Govt and a compromised Election Commission have completely lost the plot. After Shri Rahul Gandhi exposed massive voter fraud in Bengaluru, instead of addressing the rot in our electoral system, the BJP is weaponising the police to detain those demanding accountability," Siddaramaiah wrote in a post on X. Rahul Gandhi on August 7 held a press conference, where he claimed that the 2024 Lok Sabha elections were "choreographed" by the EC to benefit the BJP, which he said appeared "immune to anti-incumbency." We want a clean, pure voters list," the Congress leader said. Congress MP Priyanka Gandhi said, "Dare hue hai. Sarkaar kaayar hai. (They are afraid, the Government is a coward)," BJP leader and Union Minister Dharmendra Pradhan accused the Congress of misleading the public. "The country can see if there is anyone who is working against the Constitution, it is led by Rahul Gandhi. SIR is not happening for the first time in the country. Congress leader Rahul Gandhi said on Monday that the notices the Election Commission is sending him regarding his 'vote chori' allegation are meant to distract from the main issue of alleged irregularities in India's electoral rolls for the 2024 Lok Sabha elections. "It is their (Election Commission) data. It is not my data that I will sign (an affidavit)... Put that data on your website and you will get to know. All this is just to distract from the issue. This has not just taken place in Bengaluru but several other constituencies too," Rahul Gandhi told reporters. The Congress MP was responding to the Election Commission's notices to him. The poll panel had urged Gandhi to declare the allegations under oath. Karnataka's Chief Electoral Officer (CEO) issued a notice to Congress leader Rahul Gandhi, over his claims that a 70-year-old woman from Mahadevpura, Shakun Rani, had voted twice. The Karnataka CEO has directed the Leader of Opposition (LoP) in Lok Sabha to provide all the 'relevant documents' on the basis of which he made the claims.
