KUANTAN: A former Felda administrative assistant was sentenced to three months in jail and fined RM20,000 by the Sessions Court today for criminal breach of trust (CBT) involving death benefit funds totaling RM41,652.42, some six years ago. Nurul Syafiha Awang Za, 36, pleaded guilty to the charge before judge Sazlina Safie, who ordered her to begin serving the sentence immediately. The accused, from Terengganu, committed the offence by pocketing the death benefit payouts for the next-of-kin of seven settlers amounting RM41,652.42 which were entrusted to her. Nurul Syafiha had committed CBT by misusing the money for her personal expenses. The offence was committed at the Felda Sungai Panching Timur office between February 2018 and June 2019. The mother of three was charged under Section 406 of the Penal Code, which carries a maximum penalty of 10 years' imprisonment, whipping, and a fine. Malaysian Anti-Corruption Commission deputy public prosecutor Kamariah Seman led the prosecution, while Nurul Syafiha was represented by Datuk Syed Azimal Amir Syed Abu Bakar. In mitigation, Syed Azimal pleaded for a lenient sentence, noting that his client is currently unemployed and has school-going children to support.

KUANTAN: A former administrative assistant has been sentenced to three months' jail and fined of RM20,000, in default a further six months in prison, for criminal breach of trust (CBT) involving more than RM41,000 in death benefits for seven Felda settlers. Sessions judge Sazlina Safie meted out the sentence on Nurul Syafiha Awang Za, 36, after she pleaded guilty to the charge here on Monday (June 30). The judge ordered Nurul Syafiha to serve the jail sentence from today. The accused, who was then with the Felda office here, was charged – as a person entrusted by one Roslan Kumin with RM41,652.42 in cash to be given as death benefits to the next of kin of seven Felda Sungai Panching settlers – with committing CBT by dishonestly using the money for personal use. The offence was committed at the Felda Sungai Panching Timur Office here between February 2018 and 2019. Nurul Syafiha was charged under Section 406 of the Penal Code, which provides for imprisonment of not more than 10 years with caning and a possible fine upon conviction. – Bernama

The court ruled that failure to pay the fine would result in an additional six months' imprisonment. The case involved funds entrusted to Nurul Syafiha by Roslan Kumin, intended as death benefits for the next of kin of Felda Sungai Panching settlers. Instead, she misused the money for personal expenses between February 2018 and 2019 while working at the Felda Sungai Panching Timur Office. Charged under Section 406 of the Penal Code, the offence carries a maximum penalty of 10 years' imprisonment, whipping, and a fine. Deputy Public Prosecutor Kamariah Seman from the Malaysian Anti-Corruption Commission (MACC) led the prosecution, while Nurul Syafiha was represented by lawyer Datuk Syed Azimal Amir Syed Abu Bakar.
