Ex-admin assistant jailed and fined for CBT involving Felda settlers' death benefits

KUANTAN: A former administrative assistant has been sentenced to three months' jail and fined of RM20,000, in default a further six months in prison, for criminal breach of trust (CBT) involving more than RM41,000 in death benefits for seven Felda settlers.
Sessions judge Sazlina Safie meted out the sentence on Nurul Syafiha Awang Za, 36, after she pleaded guilty to the charge here on Monday (June 30).
The judge ordered Nurul Syafiha to serve the jail sentence from today.
The accused, who was then with the Felda office here, was charged – as a person entrusted by one Roslan Kumin with RM41,652.42 in cash to be given as death benefits to the next of kin of seven Felda Sungai Panching settlers – with committing CBT by dishonestly using the money for personal use.
The offence was committed at the Felda Sungai Panching Timur Office here between February 2018 and 2019.
Nurul Syafiha was charged under Section 406 of the Penal Code, which provides for imprisonment of not more than 10 years with caning and a possible fine upon conviction. – Bernama

TANAH MERAH: An 18-year-old teenager diagnosed with intellectual disabilities was formally charged today in the Magistrate's Court here for the alleged murder of a senior citizen. The accused, Tuan Mohamad Izmal Firdaus Tuan Muda, acknowledged the charge but did not enter a plea as the case falls under High Court jurisdiction. The incident occurred on June 19 between 6 and 6.30 pm along the roadside near a grocery store in Kampung Buluh, Gual Ipoh. The victim, Shamsudin Mohamed, 60, was found dead at the scene. The charge was filed under Section 302 of the Penal Code, which carries severe penalties, including the death sentence or imprisonment ranging from 30 to 40 years, along with a minimum of 12 strokes of the cane upon conviction. Deputy Public Prosecutor Siti Hajar Mazlan led the prosecution, while the accused remained unrepresented during the proceedings. The court scheduled the next mention for September 2.

KENINGAU: A 40-year-old farmer was sentenced to 45 years in jail and 15 strokes of the cane by the Sessions Court here on three counts of incest against daughter, who has an intellectual disability, on Monday. The man pleaded guilty before Judge Ahmad Fairuz Mohd Puzi to committing the offence against his 14-year-old biological daughter, who is a registered person with an intellectual disability in August 2024, at a house in a village in Tambunan. Ahmad sentenced the man to 15 years in jail and five strokes of the cane for each charge. The court ordered Ahmad to serve the imprisonment sentence consecutively. Each charge was framed under Section 376(2)(d) of the Penal Code. Counsel Timothy Daut, representing the man, requested a lenient sentence, stating that he had admitted his wrongdoing and repented. Timothy also submitted that the man had no prior criminal record and was willing to undergo rehabilitation. Deputy Public Prosecutor Ling Guong Zhin urged the court to impose a heavier sentence to serve as a deterrent to society. Kota Kinabalu: An entertainment outlet caretaker was on Monday fined RM2,500, or jailed eight weeks by the Magistrate's Court here for operating the outlet without a licence. Syarin Dewin pleaded guilty before Magistrate Dzul Elmy Yunus to committing the offence at the Oke Gas Bar, Kingfisher plaza, here, on June 7, this year, at 11.25pm. Syarin was found manning the business without a valid licence issued under Section 6 (1) of the Public Entertainment Ordinance (PEO) 1958. The charge under Section 4 of the PEO 1958 and punishable under Section 11 of the same Ordinance provides for a fine of up to RM50,000, or up to one year in jail, or both, on conviction. The prosecution informed the court that police raided the place and found the premises was in operation with music being played. Syarin, who was the caretaker, failed to produce any valid business licence, said Prosecuting Officer Inspector Mohamad Hamidi Mohamad Hamzah. In another court, a 31-year-old man was fined RM25, or jailed three days for causing annoyance to his younger brother through his behaviour. Muhibil Murad pleaded guilty before Magistrate Marilyn Kelvin to committing the offence against Morin Murad, 26, on June 24, this year, at 8.20pm, in a house at Taman Juara, Manggatal. The charge, framed under Section 8(1) of the Minor Offences Ordinance, provides for a RM25 fine on conviction.
