The court set this Sept 18 for case management and ordered the accused to be remanded at Miri Central Prison pending the date. – Photo by Jenifer Laeng MIRI (Aug 6): A man pleaded not guilty in the Sessions Court here today to charges of raping and sexually assaulting his 13-year-old daughter. The 53-year-old entered the plea before Judge Afidah Abdul Rahman after the charges under Section 376(3) of the Penal Code and Section 14(a) of the Sexual Offences Against Children Act 2017 were read by a court interpreter. On the first charge under Section 376(3), which carries a jail term of between eight and 30 years and whipping upon conviction, he is accused of raping the victim in a house here at about 2am on April 20, 2023. On the second charge under Section 14(a), which carries a maximum of 20 years' imprisonment and whipping upon conviction, he allegedly committed physical sexual assault on the victim at the same location at around 12.30am on July 20 this year. The prosecution urged the court not to grant bail as the accused resides in the same house as the victim. The court set this Sept 18 for case management and ordered the accused to be remanded at Miri Central Prison pending the date.

MIRI (Aug 6): A senior citizen was sentenced to eight years in jail by the Sessions Court here today after pleading guilty to slashing a 20-year-old man using a machete. The 68-year-old accused, however, was spared from caning due to his age. Judge Afidah Abdul Rahman handed down the sentence after considering several factors, including the accused's guilty plea—which saved the court time and costs—his mitigation, the facts of the case, the seriousness of the offence and public interest. The accused, from Taman Ceria, Bandar Baru Permyjaya here, was charged under Section 326 of the Penal Code, which provides for imprisonment of up to 20 years and may also include a fine or whipping, upon conviction. According to the facts of the case, the accused had intentionally inflicted grievous injuries on the victim using a machete, a dangerous weapon that could potentially cause death. He committed the offence behind a mini mart at Emart Tudan here at around 2.10pm on Aug 2 this year. File photo for illustration purposes MIRI (Aug 5): A teenager pleaded not guilty in the Sessions' Court today to eight charges of raping two underage girls, who are also his biological sisters. The 19-year-old accused was charged under Section 376(3) of the Penal Code, which carries a prison sentence of not less than eight years and not more than 30 years, and a minimum of 10 strokes of the cane, upon conviction for each charge. According to the charge sheet, the accused was alleged to have committed incest with his two younger sisters, aged 13 and 15. All the offences were allegedly committed between March 2023 and June this year at the family's home here. After the accused entered his plea, Deputy Public Prosecutor Muhammad Asymawi Ghazali requested a new date for case management and urged the court to deny bail, citing that the accused lives in the same house as the victims. Sessions Court Judge Afidah Abdul Rahman allowed the request and set Sept 18 for case management. The accused, who was unrepresented, was ordered to remain in remand at Miri Central Prison pending the next hearing.

MIRI (July 4): The Sessions Court here today sentenced a 60-year-old man to a total of 10 years in prison and four strokes of the cane for sexually abusing his daughter in 2021. Judge Afidah Abdul Rahman convicted the man on his own guilty plea to a charge under Section 14(a) of the Sexual Offences Against Children Act (SOAC) 2017, read together with Section 16(1) of the same Act. Section 14(a) provides for up to 20 years in prison and caning, while Section 16(1) provides for additional punishment not exceeding five years and no fewer than two strokes of the rotan upon conviction. According to the facts of the case, at around 10am on Sept 2, 2021, in a rented room, the accused sexually abused his then 10-year-old daughter by touching and inserting his finger into the victim's private part twice. The investigation found that victim is the accused's illegitimate daughter. Deputy public prosecutor Mohammad Asymawi Ghazali had earlier informed the court that the case was scheduled to continue today and would see three more prosecution witnesses called to testify. However, the unrepresented accused subsequently informed the court that he wished to change his plea to guilty. For the offence under Section 14(a), the accused was sentenced to eight years in prison and two strokes of the cane, while for the offence under Section 16(1), he received two years in prison and two strokes of the cane. However, the accused will only serve eight years in prison effective from the date of his arrest on July 18, 2023, after the court ordered for both sentences to run concurrently. Additionally, the court also ordered the accused to undergo counselling sessions during his imprisonment and to remain under police supervision for two years after his release. Judge Afidah Abdul Rahman convicted Frankie Wan, 45, from Long Puak in Long Lama, Baram, on his own guilty plea to a charge under Section 324 of the Penal Code, read together with Section 326A of the same Code. Section 324 provides for up to 10 years' imprisonment, or a fine, or caning, or any two of such punishments upon conviction, and Section 326A carries a penalty of imprisonment of up to twice the maximum term provided under Section 324. According to the facts of the case, Frankie was found to have deliberately injured his 71-year-old mother using a brick. He committed the offence on June 8 at around 6.30pm at their residence at Kampung Long Puak, Long Lama, Baram.
