
Miri man gets total 10 years' jail, 4 lashes for sexually abusing 10-year-old daughter
MIRI (July 4): The Sessions Court here today sentenced a 60-year-old man to a total of 10 years in prison and four strokes of the cane for sexually abusing his daughter in 2021.
Judge Afidah Abdul Rahman convicted the man on his own guilty plea to a charge under Section 14(a) of the Sexual Offences Against Children Act (SOAC) 2017, read together with Section 16(1) of the same Act.
Section 14(a) provides for up to 20 years in prison and caning, while Section 16(1) provides for additional punishment not exceeding five years and no fewer than two strokes of the rotan upon conviction.
According to the facts of the case, at around 10am on Sept 2, 2021, in a rented room, the accused sexually abused his then 10-year-old daughter by touching and inserting his finger into the victim's private part twice.
The investigation found that victim is the accused's illegitimate daughter.
Deputy public prosecutor Mohammad Asymawi Ghazali had earlier informed the court that the case was scheduled to continue today and would see three more prosecution witnesses called to testify.
However, the unrepresented accused subsequently informed the court that he wished to change his plea to guilty.
For the offence under Section 14(a), the accused was sentenced to eight years in prison and two strokes of the cane, while for the offence under Section 16(1), he received two years in prison and two strokes of the cane.
However, the accused will only serve eight years in prison effective from the date of his arrest on July 18, 2023, after the court ordered for both sentences to run concurrently.

RM103,000 Criminal Breach of Trust: Clerk claims trial

Kota Kinabalu: A 37-year-old accountant clerk claimed trial to three counts of committing criminal breach of trust involving a sum of RM103,351.36. Brandon Ng Jia Lie made the plea after the charges were read before three Sessions Court Judges, Hurman Hussain, Elsie Primus and Noor Hafizah Mohd Salim, Friday. Advertisement On the first count, Ng is accused of breaching the trust given to him as an accountant clerk by depositing two cheques amounting to RM6,462.50 belonged to Syarikat Sime Darby Industrial Sdn Bhd, into his bank account for his own use. The alleged incident took place between Nov 16, 2021 and Dec 31, 2021 at the Standard Chartered Bank Malaysia Berhad, here. On the second count, he allegedly committed criminal breach of trust by depositing another eight cheques amounting to RM64,169.26 belonged to Syarikat Sime Darby Industrial Sdn Bhd, into his bank account for his own use, between Feb 29, 2022 and Dec 29, 2022 at the same place. On the third count, Ng is accused of committing the offence by depositing five cheques amounting to RM32,719.60 belonged to Syarikat Sime Darby Industrial Sdn Bhd, into his bank account for his own use at the same place between Feb 3, 2023 and July 27, 2023. The offence, under Section 408 of the Penal Code, carries a jail term of between one and 14 years, and whipping, and liable to fine, on conviction. The court set Aug 12, this year, and released on bail of RM5,000 in two local sureties for each charge. Ng was also ordered to report to the nearest police station every first and third Friday of the month and his passport, if any, to be impounded by the court until the disposal of his case. Earlier, the prosecution objected to bail Ng on the grounds that he has three charges against him but if the court were to grant bail, there were several conditions to be imposed on him. Ng, who was not represented, asked for bail to be given to him saying that it was his first court case and if he was denied bail, there's no one else to financially provide for his family since his wife is a full-time housewife. He also claimed that he has no authority to sign or approve any cheque. Ng requested for the amount of bail to be between RM2,000 and RM3,000, adding that he would apply for the legal service from the National Legal Aid Foundation. Housewife gets eight years for abusing adoptive daughter using kitchen tools
KUALA SELANGOR: A housewife was sentenced to eight years in jail by the Sessions Court today after pleading guilty to assaulting her 13-year-old adoptive daughter from a young age using a stick, slashing her with a knife, and hitting her with a mortar and pestle. The court heard that the 54-year-old woman had continuously abused the girl, whom she had adopted since the victim was a baby, causing her to suffer broken teeth and multiple bodily injuries. The court was also told that the victim had her fingernails ripped off, was barred from attending school, survived on only a bread bun almost daily, and wore the same clothes every day. Judge Nurul Mardhiah Mohammed Redza ordered the housewife to serve the jail term from her arrest on June 28 and imposed a two-year good behaviour bond on her. She also ordered the housewife to perform 40 hours of community service in the span of four months after she completes her jail sentence. The woman was charged with committing the acts on the girl, an offence under Section 31(1)(a) of the Child Act which provides a maximum 20-year jail term or a fine not exceeding RM50,000 or both upon conviction. She was arrested by the Kuala Selangor district police's Criminal Investigation Department investigating officer and detectives at a house in Taman Bendahara on June 28. Her heinous acts came to light after S. George Wilson, the president of non-governmental organisation Persatuan Kebajikan Ikhlas Johor Malaysia lodged a report on the abuse at 6.40pm at the Kuala Selangor police station on the same day. George was alerted by a neighbour who had long suspected the girl was being mistreated. Investigations and medical checks on the girl by medical officers from the Tanjung Karang Hospital confirmed that there were physical injuries due to abuse. National Legal Aid Foundation lawyer Khairul Hazwan Rashid Mohd Redduan asked the court to impose a light sentence. "She does not have an income and her husband has been jailed for a drug offence. "If she is to be jailed, I ask that it begin from the date of her arrest," he said. Deputy public prosecutor Mohamad Nor Hakimi Mohamad Rosedin asked the court to hand down a deterrent sentence as a lesson to the accused and society, and to consider rampant abuse cases.
