Rape Survivor, Parents Refuse Abortion Consent, High Court Disposes Of Petition
Jabalpur: The Madhya Pradesh High Court has disposed of a petition about the delay in the termination of the pregnancy of a rape survivor after the girl and her parents refused to give their consent for the procedure. Government lawyer Mohan Sausarkar on Thursday submitted a report of four expert doctors stating that the girl, who is little over 14 years old, and her parents did not consent to abortion after being explained its possible untoward outcome. They wanted to continue with the pregnancy for the wellbeing of the girl, the report said. "Looking at the fact that the victim and her parents are not consenting to the medical termination of they wish to continue with pregnancy, they are at liberty to do further order is required to be passed in this petition," said Justice Amit Seth, disposing of the matter. On June 5, the court had initiated the petition on its own over the delay in the termination of the seven-and-half-month pregnancy of the rape survivor from Balaghat district, and sought a detailed report from the state government. The high court took suo motu notice of the matter after receiving a letter from the Balaghat district judge along with a report of the local civil surgeon dated May 26. "From the letter sent by the Principal District and Sessions Judge, Balaghat along with the report of Civil Surgeon dated 26.05.2025, it is not clear and apparent when the matter was reported to the concerning police station with regard to the sexual offence to the minor girl," Justice D Khot, who heard the case then, said. The court also wanted to know if the Standard Operating Procedure/guidelines issued by the High Court on February 20 were adhered to and followed in their true spirit in this case. The court then called for a report from the state "with all necessary details and case diary that under what circumstances the minor girl has been subjected to such delay in termination of pregnancy."

HC nod for MTP of minor rape survivor
Bhopal: The MP high court has allowed the medical termination of pregnancy (MTP) for a minor who is 28 weeks pregnant. The case was referred to the high court by the Damoh district court as the pregnancy of the 16-year-old rape survivor exceeded 20 weeks. Hearing the case as a petition, the high court sought a medical report of the girl. Two doctors conducted a medical test on the girl on May 21, 2025, and stated that she was 24 weeks pregnant. They opined that the MTP would be risky. However, the survivor and her mother pleaded that they were ready to take any risk for the termination of the pregnancy. The bench of Justice Amit Seth, in his order, stated that the Supreme Court and the high courts have allowed MTP of a 30-week foetus. The rape survivor in this case has a 28-week pregnancy. The judge, while allowing the MTP, instructed that the girl be sent with her parents to Netaji Subhash Chandra Bose Medical College, Jabalpur, where specialist doctors should advise them on the pros and cons of the procedure for medical termination of pregnancy at this advanced stage. The procedure will be conducted by a team of specialist doctors. The parents will take care of the girl following the procedure. If the child is born during the procedure, the state govt will be responsible for its upbringing. A portion of the foetus will be kept safe for DNA profiling. Minor rape survivor refuses med termination of pregnancy
Bhopal/Jabalpur: Parents of the minor rape survivor and the girl herself refused to undergo a procedure for medical termination of pregnancy after a medical report was presented in the high court. The report stated that the minor rape survivor was nearly eight months pregnant, and there was a risk in the medical termination of pregnancy. The case was referred to the high court by the district court, Balaghat, in accordance with the MP high court guidelines on the medical termination of pregnancy of rape survivors. These guidelines stipulate that the guidance of the high court is required if the period of pregnancy exceeds 24 weeks. The bench of Justice Amit Seth took strong exception to the excessive delay in informing the court about the pregnancy of the rape victim. Referring to the MP high court guidelines on medical termination of pregnancy, the court stated that the SHO of the police station concerned should inform the district court as soon as a rape victim becomes pregnant. The committee, in its report, stated that the 14-year-old rape survivor was nearly eight months pregnant. The medical termination of pregnancy (MTP) could be undertaken, but the procedure would be risky. The committee further stated that after being informed about the risks involved in MTP, the parents of the girl and she herself were reluctant to undergo the procedure for termination of pregnancy.
