Man gets 20-year rigorous imprisonment for raping stepdaughter
New Delhi: A sentence must be commensurate with the nature and gravity of the offence, the manner in which the crime was committed, the condition of the victim, the age of the convict, whether the convict is a habitual offender and other relevant factors, a court observed while sending a 32-year-old man to 20 years of rigorous imprisonment for sexually assaulting his 13-year-old stepdaughter.
On Aug 2, the court of additional sessions judge Ankita Mehta said there was no straightforward formula for sentencing, and both the aggravating and mitigating factors needed to be considered. It also needs to balance the twin objectives of deterrence and reform of the convict, the judge added.
The court was hearing sentencing arguments for the man convicted of raping his stepdaughter in 2023. He was convicted by the court for rape and under sections 6 (aggravated sexual assault) and 9(n) of Pocso Act this June.
The judge also awarded Rs 10.5 lakh as compensation to the survivor, noting that she suffered immense mental trauma and the incident left a lifelong scar on her mind.

Special public prosecutor advocate Vineet Dahiya asked for stringent punishment and submitted that the gravity of the offences increased even more, given that the convict was the stepfather of the survivor and she was subjected to rape/penetrative sexual assault within the four walls of her house, which was supposed to be the safest place for her.
Dahiya said offences against children were on the rise and Pocso Act was enacted by Parliament with the understanding that offenders under it shall be dealt with a heavy hand.
