AGC orders inquest into Zara Qairina's death
PUTRAJAYA: The Attorney General's Chambers (AGC) has decided to conduct an inquest to determine the cause and circumstances surrounding the death of Form One student Zara Qairina Mahathir. In a statement today, the AGC said the decision was made after reviewing the investigation report submitted by the Royal Malaysia Police in connection with the death of the Sekolah Menengah Kebangsaan Agama (SMKA) Tun Datu Mustapha student on Aug 12. According to the AGC, the inquest proceedings aim to establish the cause of death and determine whether there were any criminal elements involved. 'This process will be conducted at the Coroner's Court independently and transparently under the provisions of the law,' the statement read. The AGC said the decision to proceed with an inquest was in line with subsection 339(1) of the Criminal Procedure Code [Act 593]. On Aug 8, the AGC said that Zara Qairina's remains needed to be exhumed to allow for a post-mortem to be carried out. It said further investigation by the police was necessary to ensure a thorough probe. Following this, the remains of the 13-year-old, who was buried at the Tanjung Ubi Muslim Cemetery in Kampung Mesapol in Sipitang, Sabah, were exhumed on Aug 9 and taken to Queen Elizabeth I Hospital for the post-mortem before being reburied early Monday at the same cemetery. Zara Qairina was pronounced dead at Queen Elizabeth I Hospital, Kota Kinabalu, on July 17. She had been taken there after being found unconscious in a drain near her school dormitory in Papar at about 4 am on July 16.- Bernama

Published on: Wednesday, August 13, 2025 Published on: Wed, Aug 13, 2025 By: Jo Ann Mool Text Size: On Nov 11, 2022, the High Court granted SLS leave to proceed with the judicial review, while the Attorney General's Chambers (AGC), acting for the Federal Government, later secured a stay order to halt the High Court from hearing the merits of the case, pending appeal. Kota Kinabalu: The High Court will deliver on Oct 3 its decision on the Sabah Law Society's (SLS) substantive judicial review over Sabah's 40 per cent special grant. According to SLS counsel Dr David Fung, Judge Datuk Celestina Stuel Galid informed this during a Zoom hearing Tuesday. The decision will be delivered at 9am in open court. The court had, on July 7, heard oral arguments by the parties on the substantive merits of the judicial review and fixed Aug 7 for an e-review of the matter. The SLS filed a judicial review leave application on June 8, 2022, after the Federal Government announced on April 14, 2022 that an agreement had been reached with the State Government, and named the Federal and State governments as the first and second respondents. On Nov 11, 2022, the High Court granted SLS leave to proceed with the judicial review, while the Attorney General's Chambers (AGC), acting for the Federal Government, later secured a stay order to halt the High Court from hearing the merits of the case, pending appeal. On June 18, 2024, the Court of Appeal dismissed the Federal Government's appeal against the leave granted to SLS and directed the High Court to fix a date for the full hearing. The Federal Government then applied for leave to appeal the ruling to the Federal Court, but on Oct 17, 2024, the Federal Court dismissed the application. The SLS is seeking a declaration, among others, that the Federal Government's failure to hold a second review in 1974 with the State Government was a breach and contravention of its constitutional duty stipulated under Article 112D, Clauses (1), (3) and (4) of the Federal Constitution. It said the 40 per cent entitlement remained due and payable by the Federal Government to the State Government for each consecutive financial year for the period of 1974 to 2021, in which a failure to pay the entitlement was a breach of the fundamental right to property of the Sabah Government and ultimately, of the people of Sabah, as enshrined under Article 13 of the Federal Constitution. SLS also sought an order of mandamus directed to the respondent to hold another review with the State Government under the provisions of Article 112D of the Federal Constitution, to give effect to the payment of the 40 per cent entitlement for each consecutive financial year from 1974 to 2021 within 30 days, and to reach a decision within 90 days from the date of the order, and that the respondent pays the entitlement to the State Government or as constitutional damages for breach of Article 13 of the Federal Constitution, or both. In a statement Monday, family lawyers Shahlan Jufri and Mohd Luqman Syazwan Zabidi expressed gratitude to the Attorney General's Chambers (AGC) for directing police to apply for the exhumation and subsequent post-mortem on Aug 10. They also thanked police for closely overseeing both the exhumation and examination processes. The family acknowledged the presence and support of individuals, including members of the media, who were at the cemetery and Queen Elizabeth Hospital (QEH) 1 throughout the day. They said this solidarity was deeply appreciated as the family navigates the next steps in the legal process. Meanwhile, the family lawyers hailed the Bukit Aman Criminal Investigation Department's (CID) takeover of Zara's death investigation as a positive step towards justice. The decision follows the AGC's directive for the case to be handled by a Task Force from Bukit Aman, fulfilling one of four demands the legal team made to the AGC on Aug 5. The four requests were for the investigation papers to be returned to the Royal Malaysia Police (PDRM) and the case reopened, for experienced investigators from Bukit Aman to be appointed, for Zara's grave to be exhumed for a post-mortem and for an inquest to determine whether criminal elements were involved. The family lawyers said the latest development gives hope that the truth behind Zara's death will be uncovered. They believe it will help establish whether her death was the result of foul play.
