Advocate General Birendra Saraf on Monday informed the bench of Chief Justice Alok Aradhe and Justice Sandeep Marne that the government has held meetings and will require three more weeks to formulate a policy. To this, the bench said while it does not mind giving time, the government must keep in mind the upcoming festivals. 'Festivals are coming up from August. We (the court) also need time to look into the policy. Hence, let the policy decision be placed before the court on or before July 23,' the court said. The court had permitted manufacture and sale of PoP idols pursuant to a clarification from the CPCB that its revised guidelines pertained only to the immersion of such idols. The court was hearing a bunch of petitions by associations of Ganesh idol makers, challenging the CPCB guidelines banning the use of idols made of PoP and their immersion, alleging violation of their fundamental rights. Mumbai: A residents' association has moved Supreme Court against Bombay high court's order that had refused to stay piling work for construction of a passenger jetty and terminal facilities near Gateway of India. Clean and Heritage Colaba Residents Association had filed a petition against the state govt and Maharashtra Maritime Board's decision to construct the jetty. On May 2, after advocate general Birendra Saraf informed the high court (HC) that part of the seaside wall of the promenade would not be demolished before Jun 20, HC adjourned the hearing to Jun 16. The residents body again moved HC, stating that "the very next day" they learnt that piling work was to begin. On May 7, HC declined to grant a stay, stating that "any action taken by the respondents for implementation of the project" would be subject to the outcome of the petition. The residents' body's special leave (to appeal) petition filed through advocate Prerak Choudhary, stated that HC "ought to have considered that any drilling or piling work would result in damage to the heritage wall, which would make prayers of the writ petition infructuous." The residents' body urged an "ex-parte interim stay" on HC's May 7 order. It also sought a stay "on any coercive steps taken by the respondent state against the petitioner". On May 8, HC refused to halt construction of the jetty on another petition by three persons. Their special leave petition is listed for hearing on Tuesday. The residents' body will also seek that its petition is heard urgently.
