Daycare owner faces Rs 10k penalty for hiring a minor
Noida: Labour department has filed an 'inspection note' against the owner of a daycare centre operating from a residential society in Noida's Sector 137 for employing a minor as an attendant at the CJM court. Assistant labour commissioner Ayush Pandey said that the owner of 'Blipee' faces a penalty of up to Rs 10,000 if found guilty of knowingly employing a minor as an attendant at the facility. The attendant was sent to a correctional home by the Juvenile Justice Board for allegedly beating and biting a 15-month-old toddler earlier this month. A CCTV footage, obtained by the police, showed the attendant pinning the child to the ground, slapping and biting her repeatedly because the child wouldn't stop crying. However, Charu, who is yet to be arrested, had claimed that the teenager was only hired as an attendant after she produced a society card that specified her age as 21. Police have also found an Aadhaar card that shows the girl's age was 21. "We have asked the minor to produce documents like a school certificate to prove her age, as the Aadhaar card is not considered age proof. As per her statement, she was born in 2009. So, we have sent an inspection note to the chief judicial magistrate where the case is being heard further so that the owner can be investigated by the police," Pandey said. An inspection note is a written record of observations made by a labour inspector during an inspection of a workplace or establishment. It details the findings of the inspection, including any violations of labour laws or regulations, and serves as a basis for further action, such as issuing notices, imposing penalties, or requiring corrective measures. Meanwhile, the child welfare commission has recorded the statements of the owner of the daycare and is in the process of recording the statements of the AOA of the society. "Once we have all the statements, we will submit our suggestions to the investigating officer on what action, if any, can be taken against the owner and the AOA, and sections may be added to the FIR," CWC chairperson KC Virmani said. Condo RWA gets CWC notice over daycare, probe on against owner
Noida: The child welfare committee on Tuesday sent a notice to the RWA of Paras Tierea, asking why it had allowed a daycare centre to operate from a residential society, as part of its inquiry after a minor attendant at the facility was seen beating and biting a 15-month-old toddler. "Apart from setting up an inquiry on the operator of the daycare centre, a notice has been sent to the RWA, asking if it gave permission to run the facility," CWC chairperson Dr KC Kirmani told TOI on Wednesday. President of the Sector 137 society's RWA, Vikrant Mahajan, didn't respond to questions on legality of the daycare's operations. The 'Blipee' daycare centre operated out of a 3BHK flat on the ground floor of the society. The toddler's parents, residents of the society, subsequently filed a police complaint and an FIR was registered against daycare centre owner Charu. According to the parents, Charu knew of the attendant's action but did not intervene. Separately, the labour department has initiated proceedings against Charu for employing a minor. "The department is examining medical reports and verifying the attendant's age to confirm if she is a minor. Once that is established, we will proceed with an inquiry under the Child Labour Act to implicate the owner of the daycare centre as employing a minor is punishable by law," said Ayush Pandey, assistant labour commissioner, Gautam Budh Nagar. Charu, who is yet to be arrested, had earlier said she had been running the daycare since 2021 and had all the necessary documents, including registration from the local administration. She had also claimed that the teenager was only hired as an attendant after she produced a society card that specified her age as 21. While the attendant has been sent to a correction home by the Juvenile Justice Board for 14 days, police have added more sections of the Juvenile Justice Act to the FIR. "Sections 75 (punishment for cruelty to a child), 82 (corporal punishment by a person in charge of a child care institution) and 88 (alternative punishment) of the Juvenile Justice Act have been added to the FIR. We have also sent a report to the labour department to aid their inquiry," said Vinod Kumar Mishra, SHO of Sector 142 police station. Other charges in the FIR, originally filed on Aug 7, include those for voluntarily causing hurt, criminal intimidation and intentional insult.
