TCS representatives, KITU office-bearers attend conciliatory meeting
Following the Karnataka IT/ITeS Employees Union filing an industrial dispute case against IT services company Tata Consultancy Services in the context of allegations of forced resignations by the company, a conciliatory meeting was held today between the parties by the Karnataka Labour Department. It has been learnt that another detailed meeting would be held on September 8. Boban Varghese Thomas, general manager-HR, and Mahesh G.K., assistant manager at TCS, attended the meeting in which Suhas Adiga, general secretary-KITU, VJK Nair, president-KITU, and Sooraj Nidiyanga, secretary-KITU, participated. Sources close to the matter told The Hindu that both parties presented their sides at the meeting, which was held at the additional labour commissioner's office. Case against company KITU representatives had recently filed an industrial dispute case against TCS following allegations of forced resignations. On July 27, the company also announced that it would release 2% of its global workforce, which comes to around 12,000 employees. Following the complaint by the union, the Labour Department sent a notice to TCS. According to the Industrial Disputes Act, companies employing more than 100 workers are required to obtain prior approval from the government before carrying out any layoffs or retrenchments. Such retrenchments are permitted only for specific reasons and under conditions clearly defined in the Act. The union claims to have received several complaints from TCS employees, particularly those on the bench, who were reportedly being forced by the management to resign after introducing a new 'bench policy.' The new policy limits an employee's duration on the bench to 35 days annually.

TCS layoffs: No employee has complained, IT firm tells Karnataka labour authority

The IT major will now submit its response to an IT union's complaint of labour law violations based on the grievances of affected employees. All the officials will meet again for another conciliation on September the meeting on Wednesday, the TCS management represented by its HR executives, Boban Varghese Thomas, general manager - HR, and Mahesh GK, assistant manager, met the unions and Karnataka's labour department officials to deliberate on the notice from the labour authorities on complaints made by the Karnataka State IT/ITeS Employees Union (KITU).KITU president VJK Nair, general secretary Suhas Adiga, and secretary Sooraj Nidiyanga appeared for the union has been asked to provide the list of complaints they have received from the impacted employees, said a senior official of the Karnataka labour department, who did not wish to be identified.'We believe that any company which makes such decisions needs to be considerate and take care of basic labour rights of the employees, where due process needs to be followed and also be given due compensation. Basic concerns of affected employees must be addressed,' labour department officials and the union representatives will be meeting again in the first week of next labour commissioner (industrial relations) G Manjunath held the conciliation meeting after the union complained of the IT major violating laws under the Industrial Disputes Act , 1947, following its recent employee layoff month, the TCS management announced layoffs of 2% of its total workforce , translating to around 12,000 employees losing their jobs globally. At the meeting, the TCS representatives, who attended on behalf of the TCS management, said the company had yet to start any of the stated they are yet to get clarity on the exact number of employees who could be affected or the city-wise or country-wise breakup of TCS executives also said they don't recognise the KITU and sought to know if they have any specific complaints from any employees being fired. The union members, however, did not produce copies of any complaints but cited media reports.
