Guatemalan man in ICE custody after he agreed to meet a juvenile for sex in Portsmouth, R.I., authorities say

Advertisement According to a report filed by Portsmouth police, Perez Gomez's arrest was 'the result of an undercover operation conducted by multiple law enforcement agencies' aimed at identifying and arresting 'adults utilizing online platforms to engage in commercial sexual activity with adults and minors within the town of Portsmouth.' When Perez Gomez arrived at the location, he was taken into custody by Portsmouth police, officials wrote. Perez Gomez was arrested on Boyds Lane around 6:45 p.m. on July 11, the report states. Advertisement In an email on Thursday, Portsmouth Police Detective Lieutenant Lee Trott wrote that the incident remained under investigation. Rhode Island state court records show Perez Gomez posted bond on July 12, the same day he was taken into custody by ICE. He was ordered to have no unsupervised contact with minors and was scheduled to be arraigned in Newport County District Court on Thursday, filings show. ICE said Perez Gomez is in custody 'pending removal proceedings.' 'Mr. Perez Gomez has a clean record and maintains his innocence, as is his right to do so,' Leah J. Boisclair, an attorney representing Perez Gomez, wrote in an email on Thursday. 'He was released on bail with conditions and would have remained on bail complying with those conditions until he was given his day in court. ICE has deprived Mr. Perez Gomez of those rights.' Boisclair wrote she is 'deeply concerned and alarmed by the growing pattern of interference by ICE in our judicial system specifically in cases where individuals have not yet had their day in court.' 'Every person in the United States, regardless of their immigration status, is entitled to the fundamental right of due process under the Constitution. That includes the presumption of innocence until proven guilty and the opportunity to defend oneself in a court of law. This includes my client, Mr. Perez Gomez,' Boisclair wrote. 'When ICE intervenes before judicial proceedings have concluded, or detains individuals outside of courtrooms before their cases are heard, it effectively undermines the rule of law, chills access to justice, and erodes public trust in our legal institutions,' Boisclair added. 'No agency should short-circuit the judicial process or treat individuals as guilty before a verdict has been rendered.' Related : Separately, another Guatemalan national who unlawfully entered the United States in 2006 is in custody after he allegedly assaulted federal officers as they carried out an arrest warrant on Tuesday, according to the Prosecutors said ICE officers, a Drug Enforcement Administration agent, and a Deputy US Marshal approached Cristian Aroldo Pineda Diaz, 37, and Diaz allegedly attempted to avoid arrest by tackling the DEA agent, 'causing serious injury to the agent.' 'Diaz continued to struggle as the ICE agents and Deputy U.S. Marshal worked to subdue him,' prosecutors said in a statement. 'An immigration officer and a DEA agents suffered injuries during the scuffle requiring medical attention.' Diaz has been awaiting trial in Rhode Island state court on felony domestic assault charges and for violating a protective order, according to officials. Prosecutors said Diaz was arrested in Central Falls on Feb. 5, 2023, 'on domestic breaking and entering, domestic disorderly conduct, and resisting arrest charges,' and a no-contact order was issued to block him from contacting the complainant. 'On Feb. 16, 2023, an arrest warrant was issued after Diaz allegedly violated the no-contact order by texting and calling the complainant,' officials said. 'It is further alleged that on that date, Diaz followed the complainant's car and struck the vehicle numerous times with his vehicle. An arrest warrant was issued for Diaz charging him with six counts of felony domestic assault and violation of a protective order.' Batavia native, partners open new quick-service place in Falls

When you need a break from seeing what downtown Niagara Falls has to offer, there is a new place to get a quick bite to eat. Snack Time Indian Food Corner opened last month within the Comfort Inn property at 1 Prospect Pointe. Owner Hunter Boisclair and business partners Vick and Jolly Singh's business caters to Indian tourists and others taking a break from exploring the sights. Along with drinks and snacks, customers can pick up prepared food including wraps, rice platters, pizza, coffee, juices and bakery items. The business partners have some sense of what the Falls has to offer through their other businesses and are plenty aware of the thousands of people per day visiting the Falls in the summer. A Batavia native, Boisclair was previously involved with Vitality Nutrition Group there, which led to his partnership with the Singhs. He makes the nearly hour-long commute from Genesee County to Buffalo and Niagara Falls to work on his new projects. The Singhs are originally from India, and the food offerings come from their background. Together with Boisclair, the trio operates grocery stores and small restaurants throughout the region, including a fresh food place inside Erie County Medical Center and a new pizza place in the works for Pine Avenue. Since opening, Snack Time has been busier on the weekends and in the evenings, since it is open until 11:30 p.m. seven days a week. The owners plan to add a shake bar and breakfast options soon.
