Cuttack: The Enforcement Directorate (ED) Deputy Director Chintan Raghuvanshi, who was arrested by the CBI in May for bribery, walked out of Jharpada jail in Bhubaneswar on Friday evening after being granted bail by Orissa High Court. The High Court also granted bail to Chintan's associate Bhakti Binod Behera, from whose vehicle the CBI sleuths had recovered the bribe money. Justice Gourishankar Satapathy allowed their separate bail pleas through a common order, imposing stringent conditions. Raghuvanshi and Behera were arrested from two locations in Bhubaneswar after the CBI caught them red-handed while accepting bribe from a city-based mining businessman. According to the agency, Raghuvanshi had placed a bribe demand of Rs 5 crore, which was reduced to Rs 2 crore and Rs 20 lakh was received as an instalment. Raghuvanshi had reportedly demanded the amount from the businessman with a promise not to arrest him or attach his property in the 12 cases of financial irregularities pending against him with the ED. Earlier this month, Raghuvanshi was granted an interim bail for 10 days by the High Court to visit his ailing wife and their newborn. He returned to jail as soon as his interim protection was over.

CUTTACK: The Orissa High Court has granted bail to Chintan Raghuvanshi, a 2013-batch Indian Revenue Service (IRS) officer and deputy director of the Enforcement Directorate (ED), who was arrested by CBI on May 30 in connection with a bribery case. Justice Gourishankar Satapathy granted bail to Raghuvanshi on furnishing bail bonds of Rs 1 lakh with two solvent sureties of the same amount to the satisfaction of the trial court. As part of the bail conditions, the court directed the surrender of Raghuvanshi's passport and restricted him from leaving the country without prior permission. Senior advocates Ashok Parija and Saura Chandra Mohapatra along with advocate Lalitendu Mishra represented the IRS officer. In a detailed order on July 23, Justice Satapathy noted that while the investigation had progressed significantly, there was no immediate prospect of trial. He observed that Raghuvanshi had been in custody for over 50 days and the offence, although serious, carries a maximum punishment of seven years. It was also noted that the CBI had not sought custodial interrogation and that Raghuvanshi had cooperated with investigators, including providing his mobile phone password and complying with interim bail conditions. The court also granted bail to Bhakti Binod Behera setting identical conditions.

Justice Gourishankar Satapathy allowed Raghuvanshi to go on bail on furnishing a bond of Rs 1 lakh with two solvent sureties of like amount, subject to conditions, including surrender of his passport and restrictions on travel without prior court permission. Senior advocate Ashok Parija and senior advocate Saura Chandra Mohapatra, along with advocate Lalitendu Mishra, represented the officer. The court, in its order on July 23, noted that Raghuvanshi has been in custody for over 50 days while the investigation is still ongoing and the trial has not yet begun. "Bail is the rule, jail the exception," Justice Satapathy observed, underlining that an accused is presumed innocent until proven guilty. The court also pointed out that the CBI has not sought custodial interrogation of Raghuvanshi at any stage and that he had cooperated with the investigation, including providing passwords to his mobile devices. It was also noted that the accused had not misused the liberty granted during interim bail. The CBI has alleged that Raghuvanshi received illegal gratification through co-accused Bhakti Binod Behera. The tainted money was allegedly recovered from a vehicle linked to Behera. The primary evidence against Raghuvanshi includes phone conversations with the complainant and co-accused. The court held that fears of Raghuvanshi being a flight risk could be addressed through appropriate bail conditions and said economic offences do not automatically warrant denial of bail.

Orissa: Enforcement Directorate's Deputy Director Chintan Raghuvanshi, who was arrested by the CBI while allegedly accepting a bribe from a businessman in Bhubaneswar, was released on interim bail from the Jharpada jail on Friday evening. The Orissa High Court granted him interim bail on Wednesday for 10 days on the ground that the young officer became a father on June 28 and he wanted to see his newborn baby and attend some rituals. "The IRS officer was released from jail this evening after the relevant documents from the high court and the lower court were produced to the jail authorities," his lawyer, Lalitendu Mishra, said. A single-judge bench of Justice Gourishankar Satapathy granted the interim bail on the condition that he should not leave the country during the 10-day period. Raghuvanshi and his associate were arrested in Bhubaneswar on May 30 after being allegedly caught red-handed while accepting the bribe amount of Rs 20 lakh from a man who is in mining. According to the CBI, he demanded Rs 5 crore from the businessman, who was involved in certain financial irregularities, to not arrest him. The businessman negotiated it down to Rs 2 crore, and the Rs 20 lakh cash was a part of it.

The abbreviation stands for Station House Officer–a police officer in charge of a police station. The message was clear: don't be mere office-bearers; take up responsibility and serve the people in your respective blocks and wards. ED's problem: Officials in graft cases Since the CBI has arrested Enforcement Directorate's Deputy Director Chintan Raghuvanshi, a 2013-batch IRS officer, on graft charges, bureaucratic circles are agog about the impending malice in the law enforcement agency, which administers the Prevention of Money Laundering Act (PMLA). Raghuvanshi is not the only ED officer accused of alleged bribery. Several similar cases in various states have come to light in recent times. A retired IPS officer of the 1988 batch, who served a stint in the ED, said that the enhanced powers to the agency under the PMLA are not a new phenomenon. So, it is not the case of 'power corrupts and absolute power corrupts absolutely'. He said that until almost 2018, the staffing of the ED was primarily dominated by police officers, who had always had exposure to administering the criminal provisions under the law. When the criminal clauses were inserted in the PMLA, it was not new to them, and they handled it with care. However, as officers from revenue and other financial services began joining the agency, many of whom had very little training in dealing with the criminal provisions of the laws, such graft cases came to light more frequently. Officers joining the ED, irrespective of their service cadre, should be given training on how to deal with and invoke the criminal provisions of the PMLA, he said.
