3 Cincinnati men guilty in Springboro break-in, high-speed chase on I-75

May 28—Three Cincinnati men pleaded guilty to their involvement in a late January break-in and police pursuit with speeds reaching 110 mph in Springboro. Darvon Antion Green, 26, Naseem Zahir Whittle, 22, Tyrese Larry Woodward, 25, were each charged in Warren County Common Pleas Court for felony counts of burglary, theft, possessing criminal tools and obstructing official business. Green also was charged two counts of failure to comply with an order or signal of a police officer and having weapons while under disability. Springboro police were called just after 10:45 p.m. Jan. 31 to a report of a burglary in progress at an apartment at 60 Mottaret Way. A resident was out of town but spotted three people inside her home on security cameras wearing black clothing, masks and gloves after they broke in from the balcony. While police were on the way, the suspects left the same way they came in, according to a Springboro Police Department report. Responding officers were passed by a speeding 2023 Honda Accord, which did not stop when police tried to pull it over. This resulted in a police chase to Interstate 75, with speeds reaching 110 mph. The Honda, reportedly driven by Green, struck a tire deflation device on I-75 South at Austin Landing but kept going, with sparks coming from the tires as it fled toward the Ohio 73 exit. The car was traveling erratically before it went off the right side of the road and down an embankment, striking brush, a creek and an embankment near Exit 38 in Franklin Twp., according to an Ohio State Highway Patrol crash report. The three men, who were not injured in the crash, then ran from the car into a wooded area, leading to a foot pursuit, Springboro police said. Springboro, Miami Twp. and Miamisburg police used drones to track the suspects, in addition to a K-9 from Miamisburg. The Franklin Division of Police, Clearcreek Twp. Police Department and Warren County Sheriff's Office also assisted in the apprehension of the three men. Green pleaded guilty May 21 to burglary plus a one-year firearm specification and was sentenced to 3 1/2 years in prison. The rest of the charges against him were dismissed as part of a plea agreement. Whittle on May 21 also pleaded guilty to burglary plus a one-year firearm specification. The rest of the charged were dismissed as part of a plea agreement that calls for a sentence of three to four years in prison, said Travis Vieux, assistant prosecuting attorney. He is scheduled to be sentenced June 16. Woodward also was scheduled to plead guilty this week to a reduced charge as part of a plea agreement, according to court records.

Man found not guilty of murder in Trotwood Memorial Day shooting

May 14—A jury found a man not guilty in the deadly shooting of 40-year-old man in Trotwood on Memorial Day 2022. Anthony E. Smith, 43, was acquitted of two counts of murder and felonious assault, according to Montgomery County Common Pleas Court records. The jury found him guilty of carrying a concealed weapon. A judge also convicted Smith of having weapons while under disability following a bench trial, or trial by judge. He was sentenced to three years in prison. Smith received credit for 572 days served. Around 3:20 p.m. on May 30, 2022, Trotwood police responded to the 600 block of North Sherry Drive for a reported shooting. Officers arrived to find Bobby Daniels lying in a yard with multiple gunshot wounds, according to Trotwood police. Daniels and Smith reportedly got into an argument prior to the shooting. Smith's defense, Attorney Jon Paul Rion, said Smith was acting in self-defense. Multiple video cameras captured different portions of the incident. Rion said the videos helped show Smith was acting with restraint and was attempting to de-escalate the situation. Police identified Smith as a person of interest shortly after the shooting. Murder, felonious assault and weapons violations charges were filed against him in June 2022. He was arrested in October 2023, more than a year after the deadly shooting.

Cincinnati man gets probation connected to I-675 road rage shootout

May 1—A Cincinnati man accused of exchanging gunfire with another driver on Interstate 675 in Beavercreek has been sentenced to probation after pleading to a bill of information. David James Fletcher, 53, was sentenced by Greene County Common Pleas Court Judge Adolfo Tornichio to two years of unsupervised probation. He also agreed to turn over a Ruger pistol, along with its magazine and ammunition, to be destroyed by Beavercreek police. If he violates his probation, Fletcher would face a $2,000 fine and 360 days in jail. The sentence comes after Fletcher pleaded guilty to misdemeanor charges of assault and possessing criminal tools that were charged via a bill of information. As part of the agreement, Fletcher agreed to abide by the sentence recommended by a magistrate, whose sentence was approved by the court. Fletcher, who was driving a silver Ford work van, and another driver in a maroon Ford hatchback traded shots at about 10:20 a.m. June 5 on northbound I-675 between Wagner Drive and Indian Ripple Road. Both vehicles were struck by multiple rounds, Beavercreek police said. Police first made contact with the man driving the hatchback on I-675 north of Indian Ripple Road. Fletcher continued north on I-675, then went west on U.S. 35 into Riverside before calling police. Beavercreek police Capt. Scott Molnar said Fletcher suffered a gunshot to the abdomen, but police at the time said the injury was minor and he was expected to be released from the hospital later the same day. A grand jury decided to indict Fletcher, but not the other driver.
