Judge Datuk Duncan Sikodol set the date when the case came up for mention Wednesday. This was after the prosecution, represented by Deputy Public Prosecutor Nur Nisla Abdul Latif, requested time to respond to the submissions by the defence. Also appearing for the prosecution are deputy public prosecutors Ng Juhn Tao and Batrisyia Mohd Khusri. On Feb 28 this year, Duncan ordered the 13 teenagers, aged 16 to 19, to enter their defence on the charge of jointly murdering Mohamad Nazmie Aizzat, 17, in the dormitory rooms 7 Resak and 5 Belian at the Lahad Datu Vocational College between 9 pm on March 21 to 7.38 am on March 22 last year. They were charged under Section 302 of the Penal Code, read together with Section 34 of the same law, and face the death penalty or 30 to 40 years' imprisonment and not more than 12 strokes of the cane, if convicted. Eight of the students were represented by lawyers Datuk Ram Singh, Kamarudin Mohmad Chinki and Chen Wen Jye, while five others were represented by lawyers Mohamed Zairi Zainal Abidin, Abdul Ghani Zelika, Vivian Thien, Jhesseny P Kang and Kusni Ambotuwo. – Bernama

TAWAU: The fate of 13 teenagers, aged between 16 and 19, who are accused of murdering a student from Lahad Datu Vocational College (KV) in March last year, is expected to be decided on June 11. High Court Judge Datuk Duncan Sikodol set the tentative date for the verdict during proceedings at the High Court here today. Today's session was initially scheduled for clarification on decisions, submissions, or specific legal issues before the court fixes the date for judgment. Earlier, deputy public prosecutor Nur Nisla Abd Latif informed the court that all parties had filed their written submissions, with the prosecution submitting theirs earlier this morning. However, she requested a new deadline to file the prosecution's reply, as several defence counsels had submitted their submissions late. Duncan instructed the prosecution to file their reply submission by or before May 21 and subsequently fixed June 11 as the tentative date for the court's decision. The 13 teenagers were jointly charged with the murder of Mohamad Nazmie Aizzat Mohd Narul Azwan at Lahad Datu Vocational College between 9pm on March 21 and 7.38am on March 22 last year. They were charged under Section 302 of the Penal Code, read together with Section 34, which carries the mandatory death penalty or imprisonment of 30 to 40 years and up to 12 strokes of the cane, upon conviction. On April 15, the defence closed its case after calling 18 witnesses during the defence stage of the trial. All 13 accused gave sworn testimony from the witness stand. Eight of the accused were represented by lawyers Kamarudin Mohmad Chinki, Datuk Ram Singh, and Chen Wen Jye, while the remaining five were represented by Abdul Ghani Zelika, and court-appointed counsels Vivien Thien, Jhasseny P. Kang, Kusni Ambotuwo, and Mohamed Zairi Zainal Abidin.

Man loses second appeal against rape conviction

KOTA KINABALU (May 7): An unemployed man has failed in his second appeal at the High Court here against his conviction and sentence for raping his underage cousin. On Wednesday, Justice Datuk Duncan Sikodol dismissed the 25-year-old's appeal, upholding his 23-year jail term and 12 strokes of the cane imposed by a lower court on May 18, 2023. The man had raped his nine-year-old cousin in Kota Marudu in 2016, an offence under Section 376(2) of the Penal Code. This marks his second unsuccessful appeal. On May 20, 2024, another High Court judge upheld his earlier conviction for raping and sodomising his younger sister in 2017, when she was 10. For that case, he was sentenced to a total of 33 years in prison (21 years for rape and 12 years for sodomy, to be served consecutively) and 19 strokes of the cane. The lower court also ordered three years of police supervision post-release and mandatory rehabilitative counselling during his imprisonment. The appellant was represented by counsel Datuk Bernard J Dalinting in both cases.
