Gabriela Youth to Comelec: Disqualify Duterte Youth

The Gabriela Youth on Tuesday filed a formal letter with the Commission on Elections (Comelec), seeking for the disqualification of the Duterte Youth party-list from Eleksyon 2025. Members of the progressive group trooped in front of the Comelec main office in Intramuros, Manila to stage a rally for the immediate resolution of a 2019 petition seeking to nullify the registration of the Duterte Youth. "Duterte Youth is a fraud. They do not represent the dreams, demands, or struggles of the Filipino youth. What they represent is a legacy of red-tagging, militarism, and violence—especially toward women, LGBTQ+ youth, and those who dare to speak out," said Gabriela Youth National Spokesperson Fran Reyes. "Duterte Youth does not speak for us. They are a mouthpiece for state terror, not a voice for the youth. Their disqualification is not just legal—it is moral and urgent,' Reyes added. Duterte Youth ranked second during the recently-concluded May 12 elections, garnering 2,338,564 votes, translating to two seats in the House of Representatives. However, the Comelec suspended their proclamation due to pending cases filed against them. In March, the Kabataan Tayo ang Pag-asa also filed with the poll body an urgent motion to resolve a petition seeking to cancel or to declare nullity their registration of Duterte Youth for being void ab initio, or void from the beginning for committing material representation when they fieled overaged nominees in 2019. The case has been pending with the poll body for the past six years. Section 9 of Republic Act No. 7491 or the Party-list System Act states that party-list representatives of the youth sector should only be aged between 25 to 30 years old. Cardema was 34 years old when he was named Duterte Youth first nominee. In August 2019, the Comelec canceled Cardema's nomination due to misrepresentation. He was replaced by his wife, Ducielle Cardema. Duterte Youth party-list chairman Ronald Cardema on Friday called on Commission on Elections (Comelec) Chairman George Garcia to resign in the wake of the Comelec's decision to suspend the group's proclamation as a winner in the mid-term elections, and entitled to three seats in the House. Duterte Youth party-list received 2,338,564 votes or 5.57 percent of the votes cast in Eleksyon 2025. 'Ang sabi due to serious allegations, grave allegations in 2019, 'yung aming proklamasyon will be on hold. Serious pala eh. Ba't hindi niyo ba naresolba noong 2019? 'Yung huling hearing noong 2019 rin. Hindi na kami pinatawag kahit kailan lampas kalahating dekada na,' Cardema said during the Pandesal Forum. (If those were indeed serious allegations against us, why did the Comelec not resolve it back in 2019 when those cases were filed? The last hearing was in 2019, and we were never asked to come again.) Cardema was referring to the cases filed in 2019, which said Duterte Youth was ineligible to run in the party-list race since it failed to submit all the requirements needed to be recognized as a registered party-list. Comelec Chairman Garcia maintained that the suspension of Duterte Youth's proclamation is rooted in serious questions on its merits to participate in the party-list race, and that the poll body will resolve it sooner than later. 'Comelec will resolve it (cases vs. Duterte Youth) immediately. It concerns the merits of the group. But it is our obligation not only to the party list, but to their supporters and the Filipino people, to resolve this immediately,' Garcia said. 'Ang issue po roon goes to the heart of the fact kung dapat bang ma-accredit ang party-list na iyon,' he added. Garcia said he had nothing to do with the suspension of the proclamation of Duterte Youth since he did not participate in voting on the Comelec sitting as National Board of Canvassers (NBOC) Resolution providing the suspended proclamation of party-list winners. 'Hindi po ako nag-participate doon... Sa palagay niyo po ba kung mag-re-resign si Chairman Garcia, magbabago ba yung desisyon ng buong National Board? Anim pa rin po 'yun. Duterte Youth party-list chairman Ronald Cardema on Tuesday filed a petition seeking a temporary restraining order (TRO) against the Commission on Elections' (Comelec) suspension of the former's proclamation. "Sa tingin po natin, merong grave abuse of discretion ang Comelec kahapon. Sinabihan lang kami na hindi kami kasama sa proclamation tanghali bago mag-proclamation mismo," Cardema said in an ambush interview. (We believe there was grave abuse of discretion by the Comelec yesterday. We were only informed that we were not included in the proclamation at noon, just before the proclamation ceremony itself.) "Kung sinabi nila last week 'yun, eh di nagawan namin ng paraan pero parang sinadya na talagang tatlo, apat na oras bago 'yung proclamation at saka kayo magsasabi," he added. (If they had told us last week, we could have done something about it, but it seems like it was intentional to inform us just three or four hours before the proclamation.) The Duterte Youth party-list garnered 2.3 million votes during the 2025 midterm polls, ranking second. However, the Comelec suspended Monday the proclamation of Duterte Youth and Bagong Henerasyon, citing pending cases filed against them before the poll body. Cardema said the case being referred to was already filed in 2019. "Una, masabi ko sa inyo, existing na 'yung hao siao na kaso na yun, nu'ng 2019 pa, pero binigyan tayo ng proclamation for the 2019 election. Nu'ng 2022, existing pa rin 'yung 2019 na kaso na 'yun, pero pinasali tayo at binigyan tayo ng proclamation," he said. The Commission on Elections (Comelec) proclaimed Monday 52 party-list groups as winners in the 2025 national and local elections. The poll body was supposed to proclaim 54 groups, but it suspended the proclamation of Duterte Youth and Bagong Henerasyon partylists, which got three and one seats in the House of Representatives, respectively. Akbayan Partylist, which got the most number of votes in the party-list race, will be getting three seats in the House of Representatives in the 20th Congress, along with Tingog Partylist after being proclaimed by Comelec at Manila Hotel Tent City. Suspension of Duterte Youth party-list's proclamation sought

The counsel for petitioners seeking the cancellation of the Duterte Youth's registration on Sunday urged that the party-list's proclamation be suspended until the petition is resolved. In their original petition filed in 2019, Reeya Beatrice Magtalas, Abigail Aleli Tan, Raainah Punzalan, and Aunell Ross Angcos said the Duterte Youth's registration is void ab initio (invalid from the beginning), on the grounds that it had not complied with publication and public hearing requirements. Ducielle Cardema was sworn in as the party-list's representative in 2020. She was succeeded by the current representative, Drixie Mae Cardema, after the party-list won again in 2022. In March, the petitioners raised the issue again, urging the Commission on Elections to resolve the petition. Now, the petitioners have once more "formally sought" the suspension of the party-list's proclamation after Eleksyon 2025, according to their lawyer Emil Marañon III of Trojillo Ansaldo Marañon Law Office. "It must be recalled that in SPA No. 19-009 (DC), the petitioners raised the fact that per Comelec's own record, it appears that Duterte Youth Party-List is not even a registered party-list group, hence, should not have been allowed to run in the first place," the counsel's statement read. "That as of the date of this filing, the instant case has been unresolved for more than five (5) years." GMA News Online has reached out to the Duterte Youth party-list for comment and will publish it as soon at it becomes available. The winning party-lists will be proclaimed by the Comelec on Monday. The Duterte Youth received the second most votes in the partylist race behind Akbayan, and will send three representatives to the House. On Monday morning, Comelec Chairman George Erwin Garcia said two winning party-list groups will not be proclaimed due to pending cases.
