Man gets 21 years' jail, 12 rotan strokes for raping stepdaughter in Sabah
KOTA KINABALU: A 46-year-old man has been sentenced to 21 years in jail after the Sessions Court here found him guilty of raping his 11-year-old stepdaughter. Judge Elsie Primus also ordered 12 strokes of the cane on the man when handing down the sentence on Friday (June 13) after ruling that the prosecution had proven its case beyond reasonable doubt at the close of the defence. The offence took place at 1.57pm on Dec 30, 2021, at a house in Inanam. The man was convicted under Section 376(3) of the Penal Code, which carries a minimum sentence of eight years' imprisonment and at least 10 strokes of the cane, and up to 30 years in jail. The court ordered that the jail term begin from the date of conviction. However, his application for a stay of execution was granted. He was also ordered to undergo three years of police supervision and counselling during his imprisonment. During the trial, seven prosecution witnesses and four defence witnesses were called. The accused's newly appointed lawyer, Nurul Rafeeqa Afdul Mutolip, appealed for a minimum sentence, arguing that this was his first offence, adding that he had apologised to the victim and her family and continued to financially support his wife and stepdaughter. However, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim urged the court to impose a severe sentence, arguing that the lengthy trial had wasted court time due to irrelevant defence witnesses, delaying the proceedings. She stressed that although the accused had apologised, the trauma suffered by the victim would remain a lifelong scar. Nurul Shafeerah added that a strong sentence was necessary as a deterrent and to protect children from sexual crimes, particularly when the perpetrator is in a position of trust or is a family member. "The law exists to safeguard minors under the age of 16 from sexual exploitation, especially by individuals in positions of authority or with familial ties, which is why Section 376(3) prescribes a minimum jail term of eight years,' she said.

Man gets 13 years' jail, five strokes for raping stranger
KOTA KINABALU (May 21): A Sessions Court here on Wednesday sentenced an unemployed man to 13 years' jail plus five strokes of the cane for raping a woman Judge Elsie Primus imposed the sentence on Midrick Makales, 30, after he decided to change his not guilty plea to one of guilty under Section 376 (1) of the Penal Code when the case came up for first day of trial. The indictment provides for a jail term of up to 20 years and whipping, upon conviction. Midrick was also ordered to undergo rehabilitative counselling and to be placed under police supervision for three years. He was convicted of raping the 21-year-old woman at a rented room of a shop in Lorong Buah Duku here on January 13. The court heard that Midrick and the victim were strangers and she never talked to him. Both of them were tenants at the rented rooms of the shop. In mitigation, the unrepresented Midrick prayed for a lenient sentence and undertook not to commit a similar offence again. In reply, the prosecution pressed for a heavier sentence on Midrick on the grounds that he will post a threat to society since he had raped a woman, who is stranger.

Logging firm owner, manager fined RM100,000 for unpaid timber royalties

KOTA KINABALU: A logging company owner and manager were fined RM100,000 by the Sessions Court here on Friday for possessing 238 logs without paying the required royalty. Judge Elsie Primus ruled that the prosecution had proven its case beyond a reasonable doubt against Yun Ket Chun and Tiong Chee Khong, who were each fined RM50,000 or face eight months' jail, which they paid. Advertisement The offence took place on Feb 7, 2020, in the Sipitang Forest Reserve, where the duo was found in possession of 630.17 cubic metres of logs without lawful authority or royalty payment. The pair were convicted under the Forest Enactment 1968, with the prosecution arguing the offence deprived the state of RM60,000 in revenue and challenged the Sabah Forestry Department's authority. Rape case set for May 21

In previous proceedings, Midrick's trial was postponed due to the last minute application by a counsel to discharge herself from representing him. Midrick had told the court that in previous proceedings, his family was collecting funds to engage a counsel. Midrick is accused of raping the 21-year-old woman at 11am on Jan 13, this year, at a rented room of a shop in Lorong Buah Duku, here. The offence, under Section 376(1) of the Penal Code, carries a jail term of up to 20 years, and whipping, on conviction.
