Pensacola area restaurant inspections: One restaurant temporarily closed, four receive high violations

Here's the breakdown of restaurant inspections in Escambia and Santa Rosa counties for the week of July 14-20. Florida's restaurant owners are not required to post restaurant inspection results where guests can see them. So, every week, we provide that information for you. During the latest round of inspections from the Department of Business and Professional Regulation, one restaurant was temporarily closed, two restaurants received an administrative complaint, two restaurants received a high-priority violation and 31 restaurants passed their first inspection with zero violations. Disclaimer: The Florida Department of Business & Professional Regulation describes an inspection report as a 'snapshot' of conditions present at the time of the inspection. On any given day, an establishment may have fewer or more violations than noted in their most recent inspection. An inspection conducted on any given day may not be representative of the overall, long-term conditions at the establishment. One restaurant temporarily closed Andy D's 8649 Gulf Blvd. Inspection details: Complaint Inspection on July 15 Follow-up inspection: Operations ordered stopped until violations were corrected. The restaurant complied with a follow-up inspection on July 16. Total violations: 12 total violations, with three high-priority violations High Priority - Live, small flying insects found. Observed approximately 20 live flies in the following location: 11 live flies on walls, prep tables and mop sink in back kitchen. Five live flies on clean drink glasses at dish washing area. One live fly on clean plates on shelf next to make line. Three live flies on upright reach in freezer in back kitchen. **Warning** High Priority - Raw animal food stored over/not properly separated from ready-to-eat food. Fish container over coleslaw container in walk-in cooler. High Priority - Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Items held for more than four hours: fish 55 degrees Fahrenheit, shrimp 57 degrees Fahrenheit, beef 60 degrees Fahrenheit, cheese 60 degrees Fahrenheit. **Warning** Andy D's responds: Navarre Beach restaurant briefly closes, reopens after 'tireless deep cleaning' Two restaurants receive an administrative complaint Yolicious Frozen Yogurt and Sweets 5100 N. Ninth Ave. Inspection details: Complaint Inspection on July 16 Follow-up inspection: These violations require further review but are not an immediate threat to the public. A follow-up inspection is still required. Total violations: Six total violations, with two high-priority violations and one administrative complaint Basic - Dead roaches on premises. Observed eight dead roaches in the following locations: one between window facing ice cream freezer and customer facing ice cream freezer, six in cabinet under reach-in cooler, and two in cabinet with dry goods under pastry display. **Admin Complaint** High priority: Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. Milk at 50 degrees Fahrenheit, ice cream mix 49 degrees Fahrenheit. Both items for approximately two hours. High Priority - Time/temperature control for safety food identified in the written procedure as a food held using time as a public health control has no time marking and the time removed from temperature control cannot be determined. Tapioca boba has no time marking. Per operator, was made three hours ago. Routine regulation and inspection of restaurants is conducted by the Department of Business and Professional Regulation. The Department of Health is responsible for investigation and control of food-borne illness outbreaks associated with all food establishments. How do I report a dirty restaurant in Florida? If you see abuses of state standards, report them and the Department of Business and Professional Regulation will send inspectors. Call the Florida DBPR at 850-487-1395 or report a restaurant for health violations online. Get the whole story at our restaurant inspection database. What does all that terminology in Florida restaurant inspections mean? Basic violations are those considered against best practices. A warning is issued after an inspector documents violations that must be corrected by a certain date or within a specified number of days from receipt of the inspection report. An administrative complaint is a form of legal action taken by the division. Insufficient compliance after a warning, a pattern of repeat violations or existence of serious conditions that warrant immediate action may result in the division initiating an administrative complaint against the establishment. Says the division website: "Correcting the violations is important, but penalties may still result from violations corrected after the warning time was over." An emergency order — when a restaurant is closed by the inspector — is based on an immediate threat to the public. Here, the Division of Hotels and Restaurants director has determined that the establishment must stop doing business and any division license is suspended to protect health, safety or welfare of the public. Escambia voters to decide elected vs. appointed superintendent again. The question is when

Voters will have the opportunity to decide if Escambia County's school superintendent is elected or appointed, but first Escambia County commissioners must decide when the vote will happen. The Escambia County School Board voted to put the issue on the ballot earlier this year, however the Escambia's Board of County Commissioners must approve adding the referendum to the ballot. At this week's regular meeting, Escambia's Board of County Commissioners is expected to schedule a public hearing for Thursday, Aug. 7 at 5:30 p.m. to consider adopting an ordinance that would establish when the issue would be on the ballot. There are three options for scheduling the vote. All three include authorizing a county-wide referendum to determine if the Escambia County school superintendent should be an elected position, but each is for a different election. The three options are: General Election Ballot on Nov. 03, 2026 Statewide Primary Election Ballot on Aug. 18, 2026 Special election with the date set in 2026 at the discretion of the supervisor of elections to meet compliance with state election laws Appointed vs. elected: Escambia School Board wants to put elected vs. appointed superintendent back on the ballot If the referendum passes in 2026, Escambia County voters will elect a superintendent during the November 2028 general election. In February, the school board voted 3-2 to approve a resolution to put a referendum on the August 2026 midterm primary election giving voters the option of choosing to elect or appoint the Escambia County schools superintendent. District 5 Board Member Tom Harrell introduced the measure at the board's workshop on Feb. 13. Harrell, Kevin Adams and Paul Fetsko voted in favor of the resolution while Carissa Bergosh and David Williams opposed it. In 2018, Escambia County voters supported a referendum for an appointed superintendent. After a nationwide search, the board hired Tim Smith, but he was terminated in a surprise 3-2 vote in 2023. Since that time, Keith Leonard has been leading the school district. Leonard, however, is set to retire in 2027 or 2028. Escambia County's next board meeting is scheduled for Thursday, July 10, at 5:30 p.m., 221 Palafox Place.
