SC rejects plea challenging declaration of ISIS as terrorist organisation

The Supreme Court on Tuesday rejected a petition challenging two government notifications declaring the Islamic State of Iraq and Syria (ISIS) and associated ideological expressions as terrorist organisations under the Unlawful Activities (Prevention) Act (UAPA), 1967. A Bench of Justices Surya Kant and Joymalya Bagchi was hearing the petition filed by Saquib Abdul Hamid Nachan. Petitioner alleged wrongful arrest The petitioner claimed that he and his son were wrongfully arrested for alleged links to ISIS. The bench, however, noted that these grievances could only be addressed through appropriate proceedings before the competent criminal court. The court also clarified that it was not inclined to entertain a blanket challenge to the government notifications dated February 2015 and June 2018, issued under Section 35 of the UAPA. Amicus curiae, senior advocate Mukta Gupta, submitted that the two notifications violated the petitioner's fundamental right under Article 25 of the Constitution by misinterpreting religious terms such as 'caliphate' and 'jihad', equating them with terrorism. She argued that the declarations lacked supporting material or adherence to any procedure akin to that prescribed for declaring 'unlawful associations' under Section 3 of the UAPA. 'He says the word 'caliphate' is wrongly interpreted. That violates his fundamental right of religion. He has given substantial portions indicating what, according to the Quran, is the meaning of caliphate and jihad,' Gupta submitted. However, the bench rejected this argument, stating that such terms must be interpreted in the context of the alleged terrorist activity and not purely from a religious or scriptural standpoint. 'When the notification used the word 'caliphate', it is in relation to terrorist activity. So it has to be read in that context,' Justice Bagchi observed. No mechanism to review terrorist declarations under Section 35 Gupta further highlighted that while the UAPA provides for a tribunal to review the banning of unlawful associations, there is no equivalent review mechanism under Section 35, which governs the designation of terrorist organisations. She also informed the court that the petitioner had been arrested after filing the writ petition, and that his son had previously been detained by the National Investigation Agency (NIA) on similar allegations. In response, Justice Surya Kant noted that the petitioner could pursue bail or other legal remedies through the appropriate criminal forum. 'He can always avail his remedy before the appropriate forum,' he said. Plea not a constitutional challenge The bench concluded that the petition appeared to be an attempt to secure relief in ongoing individual criminal proceedings, rather than a genuine constitutional challenge to the notifications. 'It seems to us that instead of a challenge to the impugned notifications, the remedy for the petitioner and his son lies in approaching the appropriate forum,' the court said in its order, while disposing of the petition.

Last Updated: Saquib Abdul Hamid Nachan was convicted for his involvement in a series of bomb blasts that took place in Mumbai between 2002 and 2003. Islamic State of Iraq and Syria (ISIS) operative, Saquib Abdul Hamid Nachan, died in Delhi's Safdarjung hospital on Saturday after suffering a brain haemorrhage, officials said. He was convicted for his involvement in the bomb blasts in Mumbai in 2002 and 2003 and had been in judicial custody in Tihar Jail since 2023. He was admitted to the hospital a few days ago and was on a ventilator after a brain stroke earlier this week, according to reports. He was initially admitted to the Deendayal Upadhyay Hospital in Delhi on Monday; however, after his health deteriorated on Wednesday morning, he was moved to Safdarjung Hospital. The doctors said that his condition worsened on Saturday, after which he died at 12.10 pm, news agency PTI reported. His body will be handed over to his family after the postmortem. His last rites will be held on Sunday at Borivali near Maharashtra's Padgha, officials said. The head of the Islamic State outfit's India unit had been in Tihar Jail after the National Investigation Agency arrested him on December 9, 2023, along with 15 other ISIS members from Padgha. According to the NIA, Nachan — already known for his repeated involvement in terror-related cases — had also declared himself the Amir-e-Hind (leader of India) for ISIS. In June 2024, the NIA filed a chargesheet against Nachan and 16 other hardcore operatives of the banned global terror group in connection with the Delhi-Padgha ISIS terror module case. The case involves a conspiracy focused on recruiting and radicalizing young people and making improvised explosive devices (IEDs). According to Nachan's lawyer, he had earlier suffered two brain strokes, back in 2021 and 2023, with the latest one before his NIA arrest. In 2016, Nachan — who was reportedly a former office-bearer of the banned Students' Islamic Movement of India (SIMI) — was convicted for his involvement in a series of bomb blasts that took place in Mumbai between 2002 and 2003. NEW DELHI: The National Investigation Agency (NIA) has arrested Mushtaq Ahmed Ganie of Budgam district in Kashmir in connection with last year's grenade blast in Srinagar market, which killed a woman and left several people injured, people familiar with the development said on Tuesday. The blast was carried out by terrorists associated with the Islamic State of Iraq and Syria (ISIS)/Islamic State in Jammu and Kashmir (ISJK) and had cross-border links, a NIA officer said. According to an officer who asked not to be named, Ganie was an overground worker (OGW) and had helped the attackers. 'He was arrested on May 22 and is currently being interrogated about his other associates, including overground workers who have links with different terror groups in the Valley,' said the officer. The grenade attack took place on November 3, 2024, at the busy Sunday market near TRC, Srinagar, which the NIA has said was carried out to create panic and terror in the region and as part of a broader strategy to disturb public order. Three persons – Sheikh Usama Yaseen, Umar Fayaz Sheikh and Afnan Mansoor Naik – were charge sheeted earlier this month in the case under the Unlawful Activities (Prevention) Act, 1967, Explosive Substances Act, and the Bharatiya Nyaya Sanhita (BNS). Yaseen, Sheikh and Naik are currently in judicial custody. In a statement on May 3, NIA said it had uncovered possible involvement of other terror groups in the conspiracy behind the grenade attack and has found that 'the trio had planned, conspired and executed the grenade attack with the intent to create panic and terror in the region'. 'The attack was part of a broader strategy to disturb public order and further the violent agenda of terrorist outfits operating with support from across the border,' it added.

The National Investigation Agency (NIA) has arrested two absconders allegedly part of a sleeper cell of terrorist outfit Islamic State of Iraq and Syria (ISIS) from Mumbai airport, officials said on Saturday (May 17, 2025). The duo were wanted in a 2023 case related to fabrication and testing of IEDs in Pune, Maharashtra, they said. The accused, identified as Abdullah Faiyaz Shaikh alias Diaperwala and Talha Khan, were intercepted by the Bureau of Immigration at the Mumbai International Airport Terminal 2 last night when they tried to return to India from Jakarta, Indonesia, where they had been hiding, the officials said. The NIA team then took them into custody and arrested them, said a statement issued by the probe agency. The two accused had been on the run for more than two years and also had non-bailable warrants issued against them by the NIA Special Court, Mumbai. The NIA had also declared a cash reward of ₹3 lakh each for information about the two accused. The case relates to a criminal conspiracy by these men, along with eight other Islamic State of Iraq and Syria (ISIS) Pune sleeper cell members already arrested and in judicial custody, the statement said. They had conspired to commit terrorist acts with the aim to disturb India's peace and communal harmony by waging a war against the Government of India in furtherance of the ISIS agenda to establish Islamic rule in the country through violence and terror, it said. These two men, already chargesheeted along with the other arrested accused, were allegedly involved in assembling IEDs from a house rented by Abdullah Faiyaz Shaikh in Kondhwa, Pune, the NIA said. During the 2022-2023 period, they had also organised and participated in a bomb-making and training workshop, besides carrying out a controlled explosion to test an IED fabricated by them, at these premises, it said. The NIA, which has been actively investigating the activities of ISIS in India in a bid to foil its terrorist plans, had previously chargesheeted all the 10 accused in the case under various sections of the Unlawful Activities of Prevention Act, Explosive Substances Act, Arms Act and the Indian Penal Code. Besides Abdullah Faiyaz Shaikh and Talha Khan, the others arrested in the case are identified as Mohammed Imran Khan, Mohammed Yunus Saki, Abdul Kadir Pathan, Simab Nasiruddin Kazi, Zulfikar Ali Barodawala, Shamil Nachan, Akif Nachan and Shahnawaz Alam, the probe agency said.
