Rape, molest of minors: Dads charged

Kota Kinabalu: Two out of three fathers were separately charged with raping and committing physical sexual harassment against underaged girls. In the first case, Jumat Pillih, 33, pleaded not guilty before Sessions Court Judge Elsie Primus, to the charge against him, Friday. Advertisement He is accused of raping the 15-year-old girl at 6pm on Nov 20, 2021 inside a store in KDCA, Penampang. The offence, under Section 376(1) of the Penal Code, which carries a jail term of up to 20 years, and whipping, on conviction. The court set Aug 21 this year for pre-trial case management and released Jumat on a bail of RM10,000 with RM5,000 deposited in two local sureties. Jumat was also ordered to report to Penampang police station twice a month, to surrender his passport, if any, to the court until the disposal of his case and to not communicate or tamper with the prosecution witnesses. Earlier, Deputy Public Prosecutor Nurul Shafeerah Mad Iskim (DPP) objected to Jumat's bail but if the court granted the bail she suggested the amount to be RM10,000, with several conditions imposed on him. Counsel Dominic Chew who defended Jumat, asked for bail to be granted with a lower sum as Jumat has a wife and three children to look after and that he was not a flight risk as he cooperated with the police by reporting himself every month to the Investigating Officer of the case. In the second case, a 42-year-old security guard claimed trial to committing sexual abuse against a 13-year-old girl. Olkestria Bandang made the plea before Sessions Court Judge Hurman Hussain, to committing the offence against the girl by kissing her mouth, fondling her breasts and trying to put his private part into the girl's private part. The alleged offence took place at 7pm in November 2024 inside a car parked in Inanam Point, Inanam, near here. His pre-trial case management had been fixed on Oct 17 this year and the court offered bail of RM3,000 in a local surety who must his wife. The court warned Olkestria not to tamper with the alleged victim, or her family, or any of the potential witnesses. DPP Fazriel Fardiansyah Abdul Kadir objected to bail on the grounds that the case was a non-bailable offence and that Olkestria was living near the alleged victim. He told the court that Olkestria was a security guard of a school in which the girl attended. Counsel Nartiah FM Sambatan requested for bail, saying Olkestria has three children to look after. She further told the court that Olkestria no longer worked at the school where the victim attends. Two men charged for sexual offences against underage girls
KOTA KINABALU (July 18): Two men were separately charged in a Sessions Court here today for committing sexual offences against underage girls. In the first case, 33-year-old Jumat Pilih pleaded not guilty to a charge of raping a 15-year-old girl. The offence was allegedly committed around 6pm on November 20, 2021, in a storeroom at the Kadazan Dusun Cultural Association (KDCA) grounds in Penampang. He was charged under Section 376(1) of the Penal Code, which carries a prison sentence of up to 20 years and whipping, upon conviction. The court fixed August 21 for pre-trial case management. Bail was set at RM10,000, with RM5,000 to be deposited, under two local sureties. Jumat was also ordered to report to the nearest police station twice a month and to surrender his passport. He was reminded not to interfere with prosecution witnesses. Deputy Public Prosecutor Nurul Shafeerah Mad Iskim appeared for the prosecution, while counsel Dominic Chew represented the accused. In a separate case, 43-year-old Olkestria Bandang pleaded not guilty before judge Hurman Hussain to a charge of sexually assaulting a 13-year-old girl. The alleged incident took place around 7pm in November 2024, inside a car at a parking lot in Inanam. He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for imprisonment of up to 20 years and whipping, upon conviction. The court set October 17 for pre-trial case management and granted bail of RM3,000 under one local surety. Olkestria was also prohibited from approaching or harassing the victim, her family, and any prosecution witnesses. Deputy Public Prosecutor Fazriel Fardiansyah Abdul Kadir prosecuted, while counsel Nartiah F. Mirchelle Sambatan appeared for the accused.
