Detaining student despite valid health grounds not right: Telangana HC
HYDERABAD: Justice K Sarath of the Telangana High Court has set aside a circular issued by Geethanjali College of Engineering and Technology, Keesara, dated June 12, 2025, detaining Kondaparthi Manvitha, a B Tech (CSE) student, from appearing in the III year II semester exams. The court directed the college authorities to publish her examination results and permit her to complete the course without further hindrance, considering her case on medical, merit, and humanitarian grounds. Manvitha had undergone surgeries for a severe lung condition in February and March 2025, leading to her absence from classes. She resumed attendance in April and paid the exam fee on May 23. However, the college detained her citing only 49.33% attendance, below the mandatory 65% required under Regulation 6 of the college's AR-22 academic rules. Justice Sarath, however, held that while regulations are essential, educational institutions must also consider merit and medical circumstances. Noting the petitioner's clean academic record, the court emphasised that education policies must balance rule enforcement with empathy.

Telangana HC clears woman to donate liver to father without husband's consent
HYDERABAD: In a significant ruling, Justice K Sarath of the Telangana High Court on Monday directed a private hospital not to insist on spousal consent for an organ transplant procedure, clearing the way for a woman to donate a portion of her liver to her ailing father. The court was hearing a writ petition filed by the woman, who expressed her willingness to donate part of her liver. However, the hospital had refused to proceed without prior consent from her husband, despite the couple being estranged. The petitioner argued that her husband was deliberately withholding consent due to ongoing marital discord, putting her father's life at risk. Senior counsel Prabhaker Sripada, appearing for the petitioner, argued that there was no legal requirement under the Transplantation of Human Organs and Tissues Act to obtain spousal consent for such a donation. He contended that the hospital's insistence was arbitrary and lacked legal backing. Justice Sarath agreed with the petitioner's arguments and issued an interim order suspending the hospital's demand for the husband's consent.

The hospital was insisting on consent from her estranged husband, who had declined to oblige. The woman's advocate, senior counsel Prabhaker Sripada, said that there was no provision under the Organ Transplant Act to insist on spousal consent. He said that her husband was wilfully withholding such consent to the detriment of the health of her father. The judge granted an interim order suspending requirement of a letter of consent, enabling the hospital to go ahead with the liver transplantation.
