Delhi govt's PWD removes arbitration clause from contract conditions to cut losses

New Delhi, The Delhi government's Public Works Department has deleted the arbitration clause from its general conditions of contract to reduce the increasing financial losses. According to the new conditions, in case of any dispute between the PWD and a private contractor, the matter will be dealt with only in the courts. "The arbitration clause has been removed from our new tenders. Originally the motive behind arbitration clauses was to fast-track any disputes instead of litigation, but in most of the cases that went for arbitration, the government was incurring heavy financial losses," PWD minister Parvesh Verma said. In the Barapullah Phase 3 project, the government lost around ₹300 crore because the PWD did not make an appeal against the arbitration order and the private company benefited, he added. Last year, LG V K Saxena had said that compared to the tender amount of ₹964 crore, the government would end up paying ₹1,326.3 crore for the Barapullah Phase 3 project. The PWD has been dealing with several legal matters in the past few years, mostly deriving from delays in projects as the construction cost shoots up beyond the initial estimated cost, putting a liability on the government. In 2023, former PWD minister Atishi also took notice of the increasing financial burden on the public exchequer due to the large number of arbitration cases in the department. She had directed officials to make changes in the working of the department to ensure such situations did not arise again. Currently, the PWD has a panel of around half a dozen arbitrators empanelled to fight their legal cases. According to the rules, the empanelled arbitrator shall not have more than five cases of the PWD in hand at a time. In India, arbitration is an alternative dispute resolution method where parties agree to settle their disputes outside of court by a neutral third party, called an arbitrator, who makes a binding decision. This process is governed by the Arbitration and Conciliation Act, 1996.

NEW DELHI : As part of its initiative to generate revenue from unused land, Delhi Development Authority (DDA) will allocate two plots in Nehru Place and Dwarka for the construction of five-star hotels . The land parcels will be given to developers through a licence fee arrangement for a period of 55 years. The initiative aims to encourage public-private collaboration for Delhi's development, the authority said. "The plot at Nehru Place (Plot no A4) in south Delhi measures around 2.2 acres while the plot at Dwarka Sector 23 (Plot A) measures over 2.5 acres. For the development of hotel facilities, the developer will need to abide by all development control norms as specified in the MPD 2021 and unified building bylaws 2016. Further, the star rating guidelines as per the ministry of tourism shall be strictly applicable while developing the projects," it stated. As per the project plan, for the Nehru Place site, a floor area ratio (FAR) of 325 will be allowed with permission for 50% ground coverage. At the Dwarka site, an FAR of 375 with 40% ground coverage will be allowed. "Since both the sites are vacant, it will be easier for the developer to begin work," said the authority. DDA will publish the request for proposal for the project on May 5 and give the opportunity to interested developers to visit the sites from May 5 to June 18. The last date for submission of queries is May 20 while the due date for bidding will be June 19. According to authority officials, as the land parcels available at DDA's disposal are depleting fast, alternative modes of disposal of land are being adopted for generating revenue on a regular basis. In its budget, approved in a meeting chaired by LG V K Saxena on April 24, DDA had approved the rollout of major projects on a licence fee basis, as it can be a sustainable source of revenue for it. The projects included the development of hotels at Dwarka and Nehru Place, a hospital at Dwarka, a multi-integrated stadium and sports complex at Rohini and Narela, corporate offices at Rohini, and a gold souk at Dwarka. DDA has already floated expressions of interest for developing the gold souk. "A gold souk does not only mean gold markets; it will also include multiple commercial activities and world-class hospitals, which we lack in Delhi, among other facilities," LG had stated earlier. DDA has also approved 50 acres of land each for two sports complexes at Rohini and Narela and issued expressions of interest. "Provisions for world-class stadiums with hotels and accommodations for athletes, similar to international sports hubs, will be made at these complexes. They will be used for organising international sports events, and if a team from another country arrives, it will have training facilities, lodging, dining and entertainment, all within the same complex. We have also allocated land for corporate offices and invited expressions of interest," said an official.

New Delhi: Delhi Development Authority allocated Rs 38 crore in its budget for developing its third multi-level parking facility at Netaji Subhas Place in Pitampura, adding to its existing projects at Nehru Place and Bhikaji Cama Place. The announcement was made during the authority's 2025–26 budget presentation on Thursday, in the presence of LG VK Saxena "The approved parking layout plan at the District Centre, Netaji Subhas Place, comprising surface parking and a multi-level parking, is in the process of revision due to the existence of a large number of trees. Once the process is completed, new estimates will be prepared," said a DDA official. The parking is expected to have three levels, including a basement, besides surface parking space. DDA expects to finalise it by the end of Aug. The total covered area at the parking facility is 19,354 square metres. "The facility will have space for 452 cars, including 20 suitable for disabled. In addition to this, 193 two-wheelers can be parked at the site," said the official. The project involves a conventional type of parking with a reinforced cement concrete structure. "Seismic factors were taken into account to make it earthquake-resistant, and two rainwater harvesting pits will be constructed here to conserve rainwater. The civil work is in progress at the site, and we are expecting the project to be completed by Aug 31," the official said, adding that the parking lot will have a parking guidance facility, EV charging facility, lifts, CCTV surveillance system and firefighting system. DDA had recently revamped Nehru Place market, and new granite was laid out in the common area, pavements renovated and toilets fixed. The revamp plan also included constructing the parking lot. Traders stated that the facility, once operational, will end the illegal parking of vehicles in and around the complex. "The parking lot at Nehru Place, which is expected to be completed by June-end, consists of six floors, including the basement and ground floor. It will offer parking space for 660 cars, including 56 for disabled, and 352 two-wheelers. The cost of the project is Rs 62.4 crore," the official informed. The project is a conventional type of parking with an RCC framed structure. To ensure its safety during earthquakes, seismic factors have been incorporated in the design. "A sustainable development model was followed while developing the structure, such as the transplantation of trees and compensatory plantation. A vertical garden in an area of about 400 square metres on the wall of the building will be developed after the civil work is completed. Besides, provision for two rainwater harvesting systems was made to ensure water conservation at the project site and prevent water logging in the area," disclosed the official. The multilevel parking will have a parking guidance facility which will help motorists to park their vehicles. There will be provisions for charging electric vehicles, lifts, a CCTV surveillance system and a firefighting system. These features will make the facility more user friendly and motivate people to use it frequently. "At present, the construction work is in progress at the site and we estimate completion of work by June 30," said the official.
