Metro Line 5 rod accident makes Bombay high court urge swift implementation of construction safety measures suggested by committee it appointed in 2023

Mumbai: Expressing its concern at the serious injury caused to a man in an autorickshaw when an iron rod fell from the under-construction Metro Line 5 site, the Bombay high court on Thursday observed that measures suggested by a committee it appointed in 2023 required expeditious implementation. A division bench of Justices Girish Kulkarni and Arif Doctor said an expert committee was appointed and suggested measures for construction sites. Had these been implemented expeditiously by all public bodies, the recent iron rod incident could have been avoided. "The measures are in the larger public interest and thus expeditious action is required," said the high court, placing the matter of a 2023 petition filed by Lokhandwala Residency Towers CHS on the issue of public safety for urgent hearing next Tuesday. As we see from the photograph and newspaper report, all these construction sites would show that below construction sites, free access to the public and traffic is permitted without adequate precautions being taken to safeguard human lives by taking suitable measures to prevent objects from falling from such construction being undertaken at a considerable height," the high court said. The high court called for the state urban development department to participate at the next hearing and said it intends for the BMC to place on record the guidelines submitted by the expert committee so that the state govt can consider them and ensure they are forwarded to all municipal bodies across the state for implementation. The high court, in March 2023—Justice Kulkarni was on the bench when appointing the committee—expressed serious concerns over accidents caused by objects falling from suspended cranes at construction sites at public places, which the person on the ground may ordinarily not notice.
