Madras High Court stays suspension of student over 'Free Palestine' graffiti
Representative image CHENNAI: Madras HC has stayed the May 25 decision of Rajiv Gandhi National Institute of Youth Development (RGNIYD) in Sriperumbudur to suspend a second-year PG student for defacing hostel property by painting 'Jai Bhim' and 'Free Palestine' graffiti in his hostel room. Justice T V Thamilselvi directed the institute to allow the student and petitioner, S Aslam, to appear in exams and take part in the internship programme. "If he is not permitted to attend the examination and internship programme, it will cause undue hardship to the petitioner," the court said in its interim order on Thursday. RGNIYD's assistant registrar, Avinav Thakur, the warden, and the assistant warden visited the hostel premises and found Aslam defacing the property with graffiti. An inquiry committee, including Avinav, subsequently suspended Aslam from the institute and expelled him from the hostel. However, Aslam alleged that he was being victimised after he and some other students exposed a pending sexual assault case against Avinav in Jharkhand. He claimed that Avinav influenced the committee and coerced some students to testify against him. The court then adjourned the matter for hearing on June 25.

Anna University sexual assault case: SIT probe into ‘FIR leak case' still under way
CHENNAI: While the lone accused in the AU rape case was convicted on Wednesday, the three-member Special Investigation Team (SIT) constituted by the Madras HC continues to investigate the case of 'leak' of the FIR pertaining to the case, for which a separate FIR was filed, sources said. The SIT was mandated by the Madras HC to probe both cases. Sources said the team will soon file a report on the FIR leak case and a formal statement will be issued regarding it. The investigation by the SIT regarding the case evoked criticism after multiple journalists, who downloaded the FIR from the CCTNS portal where it was available for a brief period of time without disclosing sensitive details, said they were harassed by the team. Journalists said they were forced to hand over their personal mobile phones without notice, giving the investigation team unbridled access to personal and professional information. The investigation team later stopped this method of investigation after the Madras HC directed the SIT not to harass journalists.

Reproductive rights, population control, and more: What Supreme Court said on maternity leaves in recent ruling
Written by Rishu Jaiswal The Supreme Court passed a significant ruling on May 23 allowing 'maternity benefit' to a Tamil Nadu-based teacher for her third child under Fundamental Rule 101 (a). The woman — an English teacher at a government higher secondary school — sought relief after her plea was rejected by the Madras High Court. Fundamental Rule 101(a), pertaining to the Maternity Benefit (Amendment) Act, 1961, addresses the eligibility criteria for maternity leave of state government servants in India. Here's what the Supreme Court said: # The apex court set aside the judgment declining maternity leave to the school teacher, and said she was entitled to receive maternity benefits despite having two children. # Maternity leave is integral to maternity benefits and reproductive rights are now recognised as part of international human rights law like right to health, privacy, equality and non-discrimination and dignity, remarked the Supreme Court. While hearing the matter, a division bench of Justice Abhay S Oka and Ujjal Bhuyan disagreed with the findings of the Madras HC and said, 'Thus, as can be seen…, through various international conventions, the world community has recognized the broad spectrum of reproductive rights which includes maternity benefits.' # Emphasising on the Article 21 of the Constitution, the top court bench said, 'By judicial interpretation, it has been held that life under Article 21 means life in its fullest sense; all that which makes life more meaningful, worth living like a human being. Right to life includes all the finer graces of human civilization, thus rendering this fundamental right a repository of various human rights. Right to life also includes the right to health. Right to live with human dignity and the right to privacy are now acknowledged facets of Article 21.' # The Supreme Court also noted that the Maternity Benefit (Amendment) Act, 2017, does not bar maternity leave for women with more than two children, and only limits the duration of leave — 26 weeks for those with up to two children, and 12 weeks for those with more. It said that maternity leave itself is not denied based on the number of children. # The court also acknowledged the importance of population control measures, and said, 'Population control and reproductive rights are not mutually exclusive goals. They must be reconciled in a rational, humane manner.' A timeline of the case in SC The woman started working as an English teacher at a government higher secondary school in Tamil Nadu's Dharmapuri district in 2012. She had two children from her first marriage, which ended in a divorce in 2017. The kids are in the custody of her former husband. After marrying again in 2018, she became pregnant in 2021 and applied for maternity leave from August 17, 2021, to May 13, 2022, covering both pre- and post-natal periods. Her application for leave was rejected, and she subsequently filed a case in the high court. Initially, the case went to a single-judge bench who ruled in her favour and ordered the government organisation to grant her maternity leave. 'OCI card valid ID for legal heirship': Madras HC
CHENNAI: The Madras HC has ruled that the Overseas Citizen of India (OCI) card/ booklet is a valid identity document that could be used for obtaining legal heir certificate in India. Justice D Bharatha Chakravarthy, in a recent order, said as per the Union government's notification, state governments should ensure the OCI registration booklets of Overseas Indians are treated as valid identification for any services. The ruling was given on the petition filed by Manel Amrithkala, an OCI, seeking a direction to the Egmore tahsildar to process her application for legal heir certificate by accepting the OCI card/booklet as identification document as her husband, Dr S Subramaniam, died on March 5. The petitioner said she has been living abroad and do not possess an Aadhar card or any other locally issued ID. The online portal for legal heir certificate is not accepting their application. The judge directed the tahsildar to process her application in accordance with the law and pass appropriate orders within four weeks by treating the OCI card/ booklet as an identity document.
