HC to agencies: Ensure only treated water is discharged into Yamuna
New Delhi: Delhi High Court has asked agencies to ensure that only treated water is discharged into the Yamuna river , directing them to take immediate steps in this regard. A special bench of Justices Prathiba M Singh and Manmeet PS Arora, flagged the need to check the flow of untreated water into the river after a committee set up by it reported several shortcomings in the functioning of Sewage Treatment Plants (STPs). "A brief perusal of the report itself would show that there is an enormous quantum of work that needs to be undertaken in order to ensure that only treated water is discharged to the Yamuna," the court observed, directing Delhi Jal Board , Municipal Corporation of Delhi, Delhi Pollution Control Committee and Delhi State Industrial and Infrastructure Development Corporation to take urgent steps. It ordered a multi-agency meeting to be held with the members of the high court-appointed panel for further action. After this, the officials may agree to hold further meetings in this regard, if necessary. Finally, DJB and MCD shall file their joint report and the action plan for addressing various shortcomings, deficiencies and improvements as pointed out by the special committee, the court further directed. It also took note of the panel's submission that most STPs have flow meters, but their efficacy remained doubtful. The court asked DJB to file a report on this matter. It had earlier warned DJB to get its act together on the functioning of sewage treatment plants or face contempt of court while reviewing steps taken to improve STPs' working to combat heavy pollution in the river. The court had also pulled up Delhi govt for its failure to regulate the emission of sewage and industrial waste in the Yamuna, stating that its STPs were not working according to capacity and something was "drastically wrong" with them. The court was dealing with suo motu petitions on the water logging problem in Delhi, the issue of rainwater harvesting and easing traffic jams in the national capital during monsoon and other periods.

New Delhi: The Delhi High Court was informed on Monday that a foot over bridge (FOB) meant to facilitate the movement of Rajputana Rifles from their barracks to the parade ground in Delhi Cantonment area would be completed within 10 months. A bench of Justices Prathiba M Singh and Manmeet PS Arora then directed the Delhi government's Public Works Department (PWD) to initiate the process for issuing tenders for the FOB's construction. The court passed the direction after perusing Delhi Cantonment Board's status report which said all government agencies, including the Delhi Metro Rail Corporation (DMRC), the Delhi Jal Board (DJB), the PWD and the Rajputana Rifles Regiment Centre in the meetings held on July 10 and 24, had agreed to complete the construction within 10 months. 'Simultaneously let the tender process for construction of the FOB be also initiated by the PWD and a report be filed. In the meantime, the maintenance of the culvert will continue to be carried out,' the court said. The Delhi Cantonment Board's status report also said the Army, as a short-term measure, decided to construct a 'Bailey bridge'. A Bailey bridge is a type of portable, prefabricated truss bridge, the parts of which can be assembled or moved when needed. The report was filed in pursuance to the high court's June 18 order, directing the stakeholders — PWD, Delhi Cantonment Board and the Delhi Traffic Police — to hold a joint meeting in July to brainstorm an immediate solution for the construction of a bridge for the convenience of the soldiers. The court posted the hearing for August 29. On May 26, the high court took judicial notice of a news report claiming over 3,000 soldiers of the Rajputana Rifles had to pass through foul-smelling and filthy drain to move out of their barracks and reach the parade ground in the Delhi Cantonment area. 'The soldiers are required to pass through this culvert four times a day. The said drain is stated to be flooded and is slick with sludge and sometimes near waist-deep in places,' the bench then noted. Soldiers trudge through sewage four daily in the South Delhi area for decades and no bridge has been built despite repeated requests, the report added.

For Rajputana Rifles soldiers crossing dirty drain, Bailey bridge could be timegap answer
New Delhi: Delhi High Court on Wednesday asked authorities to furnish the final plan on the construction of a foot overbridge (FOB) for Rajputana Rifles soldiers who had to cross a putrid drain to reach the training and parade ground at Rajputana Rifles Regimental Centre, located in Delhi Cantt. A bench of justices Prathiba M Singh and Manmeet PS Arora was reviewing progress in a case it took suo motu cognizance on the basis of a news report that said soldiers had to face a "smelly trail" from their barracks to the ground. The court asked Public Works Department (PWD), traffic police and Delhi Cantonment Board to conduct a joint meeting to finalise the construction of the FOB, seeking a report on its design, budget and timeline. HC pointed out that despite having been approved earlier, the structure was yet to be constructed. Meanwhile, a joint survey by Delhi Traffic Police (DTP) and Central Road Research Institute (CRRI), whose findings were presented in HC, ruled out the installation of a pedestrian signal on Ring Road near the training yard, deeming it "unfeasible." "Based on the findings, the installation of a pedestrian signal at the location is not advisable. This stretch of Ring Road is a high-speed, signal-free corridor with a horizontal curve. Bringing foot traffic onto it would lead to congestion and pose grave safety risks. Further, as a temporary solution, a Bailey bridge is recommended in the report," said DCP Traffic (New Delhi) Rajeev Kumar. The report said at least 1,500 soldiers use the informal pathway on an average daily, with a peak flow of 400-500 at any instant during the morning, afternoon and evening hours. It pointed out that the proposed interim arrangement, in the form of a grade crossing facility with a pedestrian signal, would entail huge congestion on Ring Road in both directions of travel. The entire stretch is signal-free with flyovers, and the sudden introduction of an at-grade crossing facility, especially on the horizontal curve of the road, would have serious safety implications, it added. "Until a permanent FOB is constructed, a temporary arrangement in the form of a Bailey bridge crossing can be constructed as a stopgap safer arrangement by availing the services of the concerned unit of our Army… Such a facility was created by our Army within a week during the Commonwealth Games 2010 as a contingency measure," the report stated. Aditya Tanwar, president of Rashtrawadi Yuva Sangh Delhi, said, "We first raised the issue after observing this on our route. We then involved CRRI and tried to fix it, but nothing happened. Finally, the court hearings started in May. Hopefully, a resolution will be brought." According to CRRI scientist S Velumurgan, "It has been on CRRI's notice since Nov last year. Considering the prevailing conditions at the site and inadequate facilities for the soldiers, an FOB is fully justified. We have been advocating it for a long time now. The alternative, which is the at-grade pedestrian signal crossing, was ruled out due to unsafe environs for the soldiers as well as a possible pile-up of Ring Road traffic. " HC had last month also asked PWD if the culvert can be cleaned and some landscaping done there. "The soldiers are required to pass through this culvert four times a day. The drain is stated to be flooded and is slick with sludge and sometimes near waist-deep in places," it noted, terming it an "unacceptable situation". HC's intervention came while dealing with a batch of petitions where it is monitoring steps being taken to prevent a repeat of what the capital saw during monsoon last year — flooding of roads, homes and lawyers' offices due to clogged stormwater and sewage drains. The special bench has been issuing directions from time to time for cleaning of drains in Delhi and removal of encroachments that block smooth flow of stormwater to the Yamuna. HC has also pushed Delhi Jal Board to improve functioning of sewage treatment plants (STPs). It has ordered installation of flow meters at discharge points in all 37 STPs to prevent dirty water being released into the river.

Delhi: Until FOB built for Rajputana Rifles Regiment, PWD to clean culvert daily
The Public Works Department (PWD) told the Delhi high court on Friday that it will remove debris and garbage from a culvert used daily by more than 3,000 soldiers of the Rajputana Rifles Regiment on their way to the parade ground as a short-term solution until a foot overbridge is constructed. The court took cognizance of a Hindustan Times report highlighting the unsanitary conditions the soldiers were forced to endure and passed an order on Friday directing PWD to ensure the culvert was cleaned so that soldiers could use it until the FOB was built. The bench, comprising justices Pratibha M Singh and Manmeet PS Arora, observed that the existence of debris and stones will be hazardous for soldiers, especially with monsoons expected to arrive in the coming months, which will make the path muddy and more treacherous. 'While the FOB is designed and built, the engineer in-charge has agreed to get the walking path cleaned with some tiling in the culvert after removal of malba and stones, which could be hazardous. Accordingly, let the cleaning in the area be undertaken forthwith and photographs shall be placed before this bench on June 18 along with the status report,' the court said on Friday. The PWD engineer said that in-principle approval for the long-pending FOB has been given by the PWD sub-committee on Wednesday. He admitted that this construction would take time due to the area's topography, vehicular movement and the metro line. On Thursday, PWD officials had conducted a site visit to decide the FOB's location and said that the same was likely to come up between Delhi's metro pillar numbers 64 and 65 of the Delhi Cantonment Board (DCB) and would not require tree felling permission. In the meantime, PWD proposed to make the path used by the soldiers clean by removing the debris on their route through the culvert. Apprehending the accumulation of mud in the culvert during monsoon, the court also directed PWD to clean the area on a daily basis. 'During monsoon, there is a possibility of a lot of mud being collected in the area. After rains, the maintenance of the area shall be undertaken on a daily basis so that no inconvenience is caused to the movement of the soldiers in the culvert,' the court said. The order was passed in a suo motu plea taking cognizance of HT's report, 'A smelly trail from barracks to grounds: Regiment's daily battle in Delhi,' which had shown how 3,000 soldiers of the Rajputana Rifles, the oldest rifle regiment of the Indian Army, located in the Delhi Cantonment, are forced to march through a culvert four times a day– twice before breakfast and twice after dusk. The report highlighted the failure of the Delhi government to construct the FOB at the spot. During the hearing on Friday, PWD also suggested that traffic signals and a zebra crossing be installed for the soldier's convenience. Considering the suggestion, the court directed the deputy commissioner of police, traffic and PWD to convene a meeting on June 3. The order said, 'The concerned DCP shall consider the feasibility of creating zebra crossing and the traffic signal, in a manner so that the vehicular movement is also not obstructed in any manner and for a limited time only. Let a meeting be conducted with the DCP traffic and Bhushan (PWD engineer) with the nodal officer in the DCB on June 3, at 11am. The DCB shall appoint a nodal officer for all these works.' The matter will next be heard on June 18.
