PJ councillor's acquittal over Covid-19 vigil final as DPP drops appeal

(X pic) PETALING JAYA : The prosecution has dropped its appeal against the acquittal of a Petaling Jaya city councillor and another individual previously charged with disorderly conduct at a police station. The pair were among 31 people arrested while attending a candlelight vigil for Covid-19 victims at Dataran Merdeka on Aug 19, 2021. In a Facebook post, DAP's Nalina Nair said the prosecution decided today to drop its appeal against the acquittal given to her and Sujatra Jayaraj in 2023. 'This decision reaffirms what we have maintained all along: that our arrest and the charges brought against us were unjust. 'The police and public prosecutors must reflect deeply on the handling of this case. Due process must always be respected. The power to arrest must never be misused to intimidate or suppress legitimate civil action,' said Nalina. On Aug 26, 2021, Nalina and Sujatra claimed trial at the Kuala Lumpur magistrates' court to disorderly conduct at the Dang Wangi police station. They were arrested after attending the memorial for Covid-19 victims at Dataran Merdeka, alongside others like Undi18 co-founder Qyira Yusri and Misi Solidariti founder Sarah Irdina Ariff. They were investigated for gathering without notice and breaching Covid-19 restrictions at the time, and slapped with a RM2,000 compound each. Nalina is among 13 of them who are suing the government, home ministry, inspector-general of police, police, and 18 police officers, accusing them of false imprisonment, assault and battery, breach of constitutional rights, breach of statutory duties, and malfeasance in public office.

Disorderly conduct case ends as prosecution drops appeal against Selangor DAP Wanita sec-gen's acquittal
KUALA LUMPUR, May 7 — Selangor DAP Wanita secretary Nalina Nair Rama Krishnan remains acquitted of a disorderly conduct charge, for allegedly causing a disturbance at a police station here four years ago. During today's proceedings at the High Court, deputy public prosecutor Noor Dayana Mohamad informed Judge Datuk Muhammad Jamil Hussin that the prosecution was withdrawing its appeal against the Magistrate's Court decision to acquit and discharge the 36-year-old on August 10, 2023. 'In light of the withdrawal, the prosecution's appeal is hereby dismissed,' said Judge Muhammad Jamil. Also present was Nalina's counsel, Farida Mohamad. On August 10, 2023, Magistrate Nadia Othman acquitted and discharged Nalina after finding that the prosecution had failed to establish a prima facie case against her at the close of its proceedings. Nalina was charged under Section 90 of the Police Act 1967 for allegedly committing the offence at the lobby of the Dang Wangi district police headquarters at 9pm on August 19, 2021. Speaking to reporters outside the court, Nalina expressed gratitude to her legal team for their unwavering commitment and courage in defending her. — Bernama

Prosecution withdraws appeal against acquittal of Nalina Nair for disorderly conduct
KUALA LUMPUR: Selangor DAP Wanita secretary Nalina Nair Rama Krishnan remains free of a charge of rioting and disorderly conduct at a police station four years ago. This is following the prosecution withdrawing its appeal against the Magistrate's Court's decision that acquitted Nalina Nair on Aug 10, 2023. Deputy public prosecutor Noor Dayana Mohamad informed High Court judge Justice Muhammad Jamil Hussin that the prosecution was no longer pursuing the appeal when the case was brought up in court here on Wednesday (May 7). "The prosecution's appeal is hereby withdrawn," Justice Muhammad Jamil said. Nalina Nair was represented by lawyer Farida Mohamad during the proceedings. On Aug 10, 2023, magistrate Nadia Othman acquitted Nalina Nair after finding the prosecution failed to prove prima facie at the end of the prosecution's case. On Aug 26, 2021, Nalina Nair was charged with rioting, disorderly behaviour or hurling insults at the lobby area of the Dang Wangi police headquarters here at 9pm on Aug 19, 2021. The charge was under Section 90 of the Police Act 1967, which carries a maximum of RM500 or six months imprisonment or both. A total of five prosecution witnesses were called to testify at the trial.
