Disorderly conduct case ends as prosecution drops appeal against Selangor DAP Wanita sec-gen's acquittal
KUALA LUMPUR, May 7 — Selangor DAP Wanita secretary Nalina Nair Rama Krishnan remains acquitted of a disorderly conduct charge, for allegedly causing a disturbance at a police station here four years ago.
During today's proceedings at the High Court, deputy public prosecutor Noor Dayana Mohamad informed Judge Datuk Muhammad Jamil Hussin that the prosecution was withdrawing its appeal against the Magistrate's Court decision to acquit and discharge the 36-year-old on August 10, 2023.
'In light of the withdrawal, the prosecution's appeal is hereby dismissed,' said Judge Muhammad Jamil. Also present was Nalina's counsel, Farida Mohamad.
On August 10, 2023, Magistrate Nadia Othman acquitted and discharged Nalina after finding that the prosecution had failed to establish a prima facie case against her at the close of its proceedings.
Nalina was charged under Section 90 of the Police Act 1967 for allegedly committing the offence at the lobby of the Dang Wangi district police headquarters at 9pm on August 19, 2021.
Speaking to reporters outside the court, Nalina expressed gratitude to her legal team for their unwavering commitment and courage in defending her. — Bernama

Unemployed man charged with wife's murder in Johor

(Bernama pic) TANGKAK : An unemployed man was charged in the magistrates' court here today with the murder of his wife in Bukit Gambir, near here, early this month. Khairul Azmi Ithnin, 32, nodded when the charge was read out to him before magistrate Lee Kim Kiat. No plea was recorded as the case falls under the jurisdiction of the High Court. Khairul was alleged to have caused the death of Iecah Junus, 34, at a house in Taman Cahaya, Bukit Gambir, between 3.30pm and 5.30pm on June 2. The charge, framed under Section 302 of the Penal Code, carries the mandatory death penalty upon conviction. Deputy public prosecutor Amirah Sapian requested that no bail be offered, and applied for Khairul to be sent to Permai Hospital for a psychiatric evaluation under Section 342 of the Criminal Procedure Code. The court allowed the application and set July 8 for case mention, as well as the submission of pathology, toxicology, and DNA reports. Khairul was also charged at the Muar sessions court with nine counts of arson involving vehicles in Kampung Pengkalan Kota Durian Chondong and Kebun Durian Kampung Teratai 2, Tangkak, on June 3. He pleaded guilty to six of the charges after they were read out to him before judge Sayani Mohd Nor. Khairul was accused of committing mischief by fire with the intent to damage six vehicles: two Toyota Hilux, a Toyota Wish, a Perodua Myvi, and two motorcycles – an Ego Avantis and a Yamaha LC. The offences were said to have taken place between 4.36am and 6.46am in the two villages in Sagil, Tangkak. Khairul pleaded not guilty to the three remaining charges of setting fire to a Honda Civic and two motorcycles – a Modenas Kriss and a Honda RS150 – in Kampung Pengkalan Kota Durian Chondong on the same day. The nine charges were framed under Section 435 of the Penal Code, which provides for a maximum sentence of 14 years in prison and a fine, upon conviction. The court set July 9 for sentencing and the presentation of case facts for the six charges to which Khairul pleaded guilty. The date will also serve for the mention of the remaining three charges, including the submission of documents and the appointment of legal counsel.

Gerik MP proposes first-response team near fatal bus crash site

(Bernama pic) PETALING JAYA : Gerik MP Fathul Huzir Ayob has called for the immediate establishment of a permanent first-response team at Pulau Banding, Perak, to provide assistance in the event of future tragedies on the Gerik-Jeli East-West Highway where a fatal bus crash claimed 15 lives yesterday. Highlighting an urgent need for quicker response times in emergencies, Fathul said the proposed set-up should include a clinic, along with ambulance services, police, fire and rescue personnel, the Civil Defence Force, and the People's Volunteer Corps or Rela. 'The presence of a dedicated response team equipped with emergency medical capabilities, technical assistance, and logistical support is crucial in providing early aid to accident victims,' he said in a statement. 'This team must be permanently stationed at Pulau Banding to avoid having to wait for rescue units from Gerik or Jeli, which can take 45 minutes to an hour or more to arrive,' he said, commenting on yesterday's accident. In the early morning incident, a multi-purpose vehicle was hit by the bus, carrying students from Universiti Pendidikan Sultan Idris, as the vehicles were going downhill on the highway. Fathul also urged the government to consider upgrading the East-West Highway, saying that the road, constructed in 1967, was outdated and in poor condition. 'The road must be rebuilt with modern materials and design, widened, equipped with proper lighting, and more effective road markings and signage, especially considering that the route passes through the Royal Belum forest reserve,' he said. He added that any redevelopment of the road must factor in the presence of wildlife such as elephants, tigers, and buffalo. 'We must consider constructing underpasses, overpasses or elevated roads like the Rawang Bypass. There are many international projects that can serve as references,' he said.

Bus driver in Gerik crash apologises, blames ‘faulty brakes'

(Bernama pic) PETALING JAYA : The driver in the fatal bus crash that killed 15 Universiti Pendidikan Sultan Idris (UPSI) students yesterday has apologised to their families, claiming that the incident occurred due to a brake malfunction. Amirul Fadhil Zulkifle, 39, said the brakes malfunctioned when the bus reached the elephant crossing bridge at Gerik, although the vehicle had been in good condition upon its departure from Terengganu. 'I was trying everything I could, but none (of the bus's brake systems) were working, including the handbrake. Even the gears of the bus could not be changed,' Harian Metro quoted him as saying. Amirul said others on the road might have seen him cutting past vehicles and speeding, but claimed he was doing so to minimise the damage and avoid colliding with other vehicles. 'The last vehicle I cut past had a dashcam, and by then I was doing my best to mitigate the situation,' he said. He claimed that, upon realising the failure of the brakes, he immediately shouted for the students to take cover and prepare for impact. Amirul also said that while the students seated at the front may have understood him, most at the back were asleep, and could have interpreted his warnings as an outburst. Local transportation think tank MY Mobility Vision said his description matched common failure modes in buses with air brakes, and called for a critical forensic investigation of the bus's systems to determine the cause behind the tragedy. In a statement, the think tank said the accident might be symptomatic of a larger problem with Malaysia's road infrastructure, as evidence indicated that the guardrails had penetrated the bus cabin, posing an even larger risk to its passengers. 'Every guardrail on a federal highway must perform to standards, particularly the MASH TL-3 specifications that Malaysia has committed to adopting. 'We must ask: did this barrier fail to perform when lives depended on it?' said MY Mobility Vision.
