Bhopal: In an interim order, a division bench of the MP high court ordered Netaji Subhash Chandra Bose Medical College , Jabalpur, to return the documents of a PG student from Bhopal, who quit her studies midway following the death of her father. The court restrained the medical college from demanding Rs 30 lakh from the student according to the conditions of the bond until the case is finally decided. Dr Nisha Rawat from Bhopal, in her petition, said that she took admission at Netaji Subhash Chandra Bose Medical College in the postgraduate course in microbiology in the academic session 2023-24. She had to quit the course midway to take care of her mother following the death of her father. She wants to join the community medicine department at Gandhi Medical College, Bhopal, as a demonstrator, but the Jabalpur medical college is demanding Rs 30 lakh from her to release her documents as per the condition of the bond she filled at the time of admission. Senior Counsel Aditya Sanghi, appearing for the petitioner, contended that the National Medical Commission (NMC) has asked all the states and union territories to do away with the bond that medical students have to fill at the time of admission in a PG course. The bench of Chief Justice S K Kait and Justice Vinay Jain, while ordering Netaji Subhash Chandra Bose Medical College to release the papers of the girl without the amount of penalty, said that the final outcome in the case would be subject to their final judgement.

No bids received for cancer institute equipment tender in Jabalpur, HC told

Bhopal/Jabalpur: The state govt informed a division bench of the MP high court on Tuesday that no bids were received in response to the tender floated for the purchase of equipment for the cancer institute in Netaji Subhash Chandra Bose Medical College , Jabalpur. During the hearing of a public interest litigation (PIL) over the cancer institute lying defunct despite the sanction of Rs 84 crore as far back as 2016 for the purchase of equipment to create the desired infrastructure, the division bench of Chief Justice Suresh Kumar Kait and Justice Vivek Jain was informed in the previous hearing that tenders were floated for the purchase of equipment. In the past, tenders were cancelled as only one or two bids were received. The court had asked the health and medical education department not to cancel the tender this time, even if only a single tender was received. However, during the hearing of the petition on Tuesday, the court was informed that not a single bid was received in response to the tender. A petition challenging the cancellation of earlier tenders has also been filed. The court will now hear both petitions jointly on May Vikas Mahavar, in his petition, said the cancer institute in Jabalpur Medical College was not serving its purpose due to a lack of infrastructure, despite the fact that the govt sanctioned Rs 84 crore in 2016 to purchase equipment for the institute. The inability of the cancer institute to treat patients is a violation of their fundamental rights, said the court was informed on behalf of the state govt that tenders were invited two to three times for the purchase of equipment, but each time, tenders were cancelled for technical reasons. The purchase has to be made by the MP Public Health Service Corporation. The court had asked the petitioner to make the principal secretary, health, and MD, MP Public Health Service Corporation, a respondent in the the previous hearing, principal secretary (health) Sandeep Yadav appeared in court and, in deposition, said tenders were cancelled because only one or two companies participated in the bidding. The tender was floated again, inviting bids, and the technical bid was to be opened on April 29, with tenders opening on July 6. The court, while asking officials to take a call on the bid received, exempted them from personal the hearing of the case on Tuesday, the state govt told the court that no bid was received in response to the tender. A company has also challenged the cancellation of the tender on an earlier occasion. The court will now club the two petitions and hold a joint hearing of the case on May 15.

Bhopal/Jabalpur: Hearing a public interest litigation (PIL) over the largely dysfunctional Cancer Institute at Netaji Subhash Chandra Bose Medical College, Jabalpur, a division bench of the MP high court found that an amount of Rs 84 crore was allocated 9 years ago for the purchase of equipment and machines for the institute, but the purchase has not been made yet. Following this, the court has summoned principal secretary, medical education, and managing director, MP Public Health Services Corporation. The court was told that the tender floated earlier had to be cancelled as only one or two bidders participated in the tender. Advocate Vikas Mahawar from Jabalpur, in his PIL, said that the Cancer Institute at Jabalpur Medical College lies largely defunct as it doesn't have the necessary equipment and machines to treat cancer patients. In the year 2016, the govt allocated Rs 84 crore for the purchase of equipment and machines, but there have not been any purchases made so far. During the hearing of the petition, the court was informed on behalf of the state govt that tenders were floated two or three times for purchase, but they were cancelled for technical reasons. The MP Public Health Service Corporation was supposed to make the purchases. The court then summoned the principal secretary, medical education, and MD, MP Public Health Service Corporation in this regard. The two officials told the court that only one or two bids were received in response to the tender; therefore, the tenders were cancelled. The tenders have been floated again and are likely to be opened on May 6. The court, while directing the officials to take a decision on the purchase of equipment and machines for the centre irrespective of the number of bids received when the tenders open on May 6, deferred the hearing of the case to May 13.
