High Court raises Nissan Navara driver's jail term to 6 months
Last week, K Darmaraju pleaded guilty to reckless driving under Section 42(1) of the Road Transport Act. PETALING JAYA : The Kuala Lumpur High Court has increased K Darmaraju's jail sentence from 30 days to six months for sideswiping a motorcycle carrying a couple on the PLUS Highway on May 10. Justice K Muniandy handed down the revised sentence after allowing the prosecution's appeal against the magistrates' court's sentence of 30 days in prison, Harian Metro reported. The High Court upheld the RM12,000 fine and five-year driving licence suspension imposed on Darmaraju, who had pleaded guilty to recklessly driving a Nissan Navara in the incident. Deputy public prosecutor Sabri Othman said the initial sentence did not reflect the seriousness of the offence or the Dewan Rakyat's intent to impose heavier punishments for reckless driving in amending the Road Transport Act. He said the crash left pillion rider Suhailiza Shamsudin, 49, permanently disabled and still in the intensive care unit with head injuries, while motorcyclist Faizal Mat, 53, suffered a broken collarbone and ankle. 'The 30-day sentence pales in comparison to the suffering endured by the victims,' Sabri said, adding that public outrage showed the need for a heavier sentence. He added that Darmaraju was speeding and overtook the motorcycle from the right before sideswiping it, causing both victims to be thrown from the vehicle. Darmaraju then fled the scene without offering help. A dashcam recording submitted to the court confirmed the sequence of events involving the Navara. Darmaraju was represented by lawyers S Vinesh and T Daneish. Darmaraju, 32, was initially sentenced to 30 days' jail and fined RM12,000 after pleading guilty to reckless driving under Section 42(1) of the Road Transport Act. The offence occurred before the city-bound Jalan Duta toll plaza at 2.30pm on May 10.

KUALA LUMPUR : A 32-year-old man was sentenced to 30 days in prison by the magistrates' court today after pleading guilty to reckless driving. K Darmaraju was charged under Section 42(1) of the Road Transport Act 1987 after sideswiping a motorcycle carrying a middle-aged couple on the PLUS Highway last Saturday. The section provides for imprisonment of up to five years and a fine of between RM5,000 and RM15,000. Darmaraju was also fined RM12,000. Magistrate Khairunnisak Hassni ordered Darmaraju to serve six months in prison if he did not pay the fine. The incident occurred before the city-bound Jalan Duta toll plaza at 2.30pm on May 10. According to the facts of the case, the victims – a rider and passenger – were travelling on the left lane when the accused struck their motorcycle from behind. He then fled the scene without stopping. Both victims suffered serious injuries, including bone fractures. The pillion rider also sustained injuries to the head, a broken ankle, and a fractured rib. During mitigation, the accused's lawyer, S Vinesh, said his client had no intention of committing the accident. He said his client also regretted the incident and had apologised to those involved. 'He has promised not to repeat this mistake,' he said. Vinesh asked for the minimum sentence, citing his client's RM2,500 monthly salary as a salesman and his marriage last year. He also said his client was financially responsible for his elderly parents, and that his father had an upcoming eye surgery. The court then ordered Darmaraju to serve 30 days in jail starting from his arrest on May 11, and fined him RM12,000. He was also disqualified from holding a driving licence for five years.

KUALA LUMPUR, May 13 – A man was reportedly sentenced to 30 days in jail and fined RM12,000 by the Magistrates' Court here today after pleading guilty to reckless driving that seriously injured two motorcyclists on the PLUS Highway. Free Malaysia Today reported that K Darmaraju, 32, admitted to driving recklessly under Section 42(1) of the Road Transport Act 1987, which carries a penalty of up to five years' jail and a fine between RM5,000 and RM15,000. 'He has promised not to repeat this mistake,' his lawyer S Vinesh was quoted telling the court, adding that his client regretted the incident and had apologised to the victims. Vinesh pleaded for leniency, citing Darmaraju's RM2,500 monthly income as a salesman, his recent marriage, and his financial responsibility for his elderly parents. The crash took place around 2.30pm on May 10 before the city-bound Jalan Duta toll plaza when Darmaraju's vehicle hit a motorcycle carrying a middle-aged couple from behind. Cops act after couple on motorcycle sideswiped on KL highway

PETALING JAYA : Police have confirmed receiving reports lodged over an accident yesterday on the PLUS Highway that saw a four-wheel-drive vehicle sideswipe a middle-aged couple on a motorcycle before speeding off. In a statement today, Kuala Lumpur traffic police investigation and enforcement department chief Zamzuri Isa said a video of the incident was shared on Facebook by the DashCam Malaysia account and has since gone viral. He said the incident occurred at about 2.30pm on the PLUS Highway heading to the city centre, before the Jalan Duta toll plaza. Zamzuri said the first police report was lodged on the same day at 6.55pm by the driver of the Nissan Navara. 'The accident involved a Benelli TRK 502 motorcycle and the Nissan Navara. 'A preliminary investigation found that the motorcycle was moving straight on the left lane when the four-wheel-drive attempted to cut in front of another motorcycle, but hit the victims' motorcycle from the right,' he said. He said the collision threw the 53-year-old motorcyclist and the pillion rider, his 49-year-old wife, from their motorcycle to the road. The motorcyclist sustained a fractured collarbone and injuries to his ankle, while his wife suffered more serious injuries, including bleeding from the head, a fractured ankle and a broken right rib. 'They were taken to Sungai Buloh Hospital for treatment. 'The driver, a 32-year-old man, was uninjured. A remand application has been made and he is being held for two days at the Dang Wangi lockup to assist in the investigation,' he said. He said the case is being investigated under Section 42(1) of the Road Transport Act 1987 for reckless and dangerous driving. Zamzuri said the driver told police he feared he would be confronted by other road users, when asked why he left the scene of the accident.
