Nissan Navara driver handed 30-day jail sentence for reckless driving

KUALA LUMPUR : A 32-year-old man was sentenced to 30 days in prison by the magistrates' court today after pleading guilty to reckless driving.
K Darmaraju was charged under Section 42(1) of the Road Transport Act 1987 after sideswiping a motorcycle carrying a middle-aged couple on the PLUS Highway last Saturday.
The section provides for imprisonment of up to five years and a fine of between RM5,000 and RM15,000.
Darmaraju was also fined RM12,000.
Magistrate Khairunnisak Hassni ordered Darmaraju to serve six months in prison if he did not pay the fine.
The incident occurred before the city-bound Jalan Duta toll plaza at 2.30pm on May 10.
According to the facts of the case, the victims – a rider and passenger – were travelling on the left lane when the accused struck their motorcycle from behind.
He then fled the scene without stopping.
Both victims suffered serious injuries, including bone fractures. The pillion rider also sustained injuries to the head, a broken ankle, and a fractured rib.
During mitigation, the accused's lawyer, S Vinesh, said his client had no intention of committing the accident. He said his client also regretted the incident and had apologised to those involved.
'He has promised not to repeat this mistake,' he said.
Vinesh asked for the minimum sentence, citing his client's RM2,500 monthly salary as a salesman and his marriage last year.
He also said his client was financially responsible for his elderly parents, and that his father had an upcoming eye surgery.
The court then ordered Darmaraju to serve 30 days in jail starting from his arrest on May 11, and fined him RM12,000.
He was also disqualified from holding a driving licence for five years.

'That is why passengers seated on the left side of the bus were among those who lost their lives, because the barrier penetrated all the way to the passenger seats. 'We leave it to our investigating officers to go through the recording and take the owner's statement,' said Noor Hisam. He added that the statements of survivors would also be taken, after several of the Universiti Pendidikan Sultan Idris (UPSI) students claimed the bus was speeding before the crash. He said the site of the crash was a downhill stretch of a hilly road and that the accident occurred around midnight after some rain. 'Based on my observation, there were no clear road markings and the area is very dark. We're still probing whether the cause of the crash was due to negligence or technical issues.' Noor Hisam also said most of the survivors were found in a drain next to the barrier, while the bodies of most of those killed were still in the bus after the crash. A total of 15 UPSI students died from the crash on the Gerik-Jeli East West Highway, near Tasik Banding. The bus was carrying 42 students, the bus driver and his assistant. A couple, along with their six-year-old daughter and three-year-old son, were travelling in a Perodua Alza the bus collided with.

According to Amira, she will record her statement under Section 504 of the Penal Code and Section 233 of the Communications and Multimedia Act following an order from the Papar district police in Sabah. 'I have been summoned and investigated in connection with many previous peaceful assemblies,' she said in an X posting today. 'I remain steadfast in the struggle to bring truth and justice. (Bernama pic) PETALING JAYA : Police revealed that the bus driver involved in the crash that killed 15 students from Universiti Pendidikan Sultan Idris (UPSI) yesterday had a record of 18 traffic summonses. Bukit Aman traffic investigation and enforcement department director Yusri Hassan Basri said 13 of the summonses were for speeding, three for not wearing a seatbelt, one for not having a third brake light, and another for involvement in a previous accident, Sinar Harian reported. Earlier, Yusri announced that a special task force would be formed to investigate the crash. It will comprise the police, the Malaysian Institute of Road Safety Research, the road transport department, the Land Public Transport Agency, and other relevant bodies. 'We will complete the investigation papers as soon as possible. Our investigation will be thorough and cover all aspects, including the driver's past offences, background, activities and career history,' he said. Fifteen UPSI students were killed when the bus travelling from Jertih, Terengganu, to the university's campus in Tanjung Malim, Perak, crashed into the rear of a Perodua Alza, veered off the road, and overturned along the East-West Highway near Tasik Banding early yesterday morning.
