Cabinet likely to decide on 42% BC quota, panchayat polls & key reports today
Hyderabad: The state cabinet meeting on Monday is likely to decide on fixing 42% reservations for the Backward Classes (BCs) in local bodies and proceeding with panchayat elections . Sources told TOI that the govt must decide on BC reservations as the high court-set deadline to finalise reservations within a month expired two days ago. The court also directed the govt to complete the panchayat elections by Sept 30. With the ordinance to remove the 50 cap on the quota from the Panchayat Raj Act of 2018 still pending with the governor, and the issue of including the enhanced BC quota in the IX Schedule of the Constitution likely to take much more time, the cabinet must decide on reservations or inform the court of the reasons for the delay. The cabinet would discuss the report in detail and is likely to decide on fixing reservations for the BCs in local bodies. The govt plans to approve this report and place it in the assembly for discussion. HYDERABAD: The state govt is likely to file caveats in the high court and the Supreme Court to protect the 42% reservation it intends to extend to the Backward Classes (BCs), once the Governor approves the ordinance sent to him. Currently, the draft of the ordinance is pending with the Governor. The govt expects that Jishnu Dev Varma will give his approval, as the state followed all guidelines recommended by the Supreme Court, including the appointment of a dedicated BC commission, obtaining empirical data through a scientific caste survey, and passing the bills in the assembly to fix reservations for the BCs in local bodies. Once the Governor promulgates the ordinance, the govt will issue a GO to amend the Panchayat Raj Act of 2018, which currently limits the overall reservations to 50%. The amendment will allow the state to exceed this cap. National BC Welfare Association president and BJP MP, R Krishnaiah, said the govt took the best available option of issuing an ordinance after sending the two BC quota bills to the President and the Central govt. "The court will hear both parties, the one who filed the case and the govt on the issue, based on which it will make a decision. If the govt can present its case strongly, there is a bright prospect of defending the enhanced BC quota," he said.

As Cabinet meets today, BCs wait for a concrete decision on 42% reservations
All eyes are on the Cabinet meeting to be held on Thursday (July 10) as the Backward Classes (BC) expect a huge decision coming for implementing 42% reservations for them in the local body elections to be conducted soon. This is the first Cabinet meeting after the government indicated that local body elections would be held soon, asking the party to get prepared. Chief Minister A. Revanth Reddy himself gave the indication asking leaders to go to the villages and work there and leave their recognition by the party to him. In fact, he has also put the onus on Ministers for the success of party candidates. The Chief Minister is likely to seek the opinion of the Ministers on amending the Panchayat Raj Act of 2018 to increase the reservations and legal hurdles in it. Should the amendments be brought by an Ordinance or through a special session of the Legislative Assembly is the challenge before it. The party functionaries, on the other hand, have been asked to go to the village level, exposing how the BRS government reduced the BC reservations in the local body polls from 34% to 23% when it brought in the Telangana Panchayat Raj Act in 2018. The fear, however, is the legal challenges that are likely to crop up once the changes are made. The challengers may move the courts, arguing that unless the Centre amends the rules to overcome the ceiling of 50% reservations imposed by the Supreme Court, the State governments have no right to break the ceiling. The Independent Committee, headed by former Supreme Court judge Justice Sudarshan Reddy, to review the caste survey data has completed its work and will submit the report to the State government soon. It has given a comprehensive view of the backwardness of each caste based on various parameters and apparently argued for the implementation of the proposed enhancement of reservations, covering even the most backward castes, thus fulfilling the demands of even the backward castes that have gone unrepresented in the political system so far.
