Telangana govt likely to file caveats in HC, SC; move aims to protect 42% Backward Classes (BCs) quota

HYDERABAD: The state govt is likely to file caveats in the high court and the Supreme Court to protect the 42% reservation it intends to extend to the Backward Classes (BCs), once the Governor approves the ordinance sent to him.
Currently, the draft of the ordinance is pending with the Governor. The govt expects that Jishnu Dev Varma will give his approval, as the state followed all guidelines recommended by the Supreme Court, including the appointment of a dedicated BC commission, obtaining empirical data through a scientific caste survey, and passing the bills in the assembly to fix reservations for the BCs in local bodies.
Once the Governor promulgates the ordinance, the govt will issue a GO to amend the Panchayat Raj Act of 2018, which currently limits the overall reservations to 50%.
The amendment will allow the state to exceed this cap.

However, BC welfare associations are urging the govt to file caveats immediately, without waiting for the Governor's approval. National BC Welfare Association president and BJP MP, R Krishnaiah, said the govt took the best available option of issuing an ordinance after sending the two BC quota bills to the President and the Central govt. "The Constitution gives the authority to the states to extend the BC quota," he said.

High court advocate Khaja Aijazuddin said filing caveats will place the govt on strong ground to defend the BC quota, as the court will not issue any interim orders if anyone challenges the reservations.
"The court will hear both parties, the one who filed the case and the govt on the issue, based on which it will make a decision. If the govt can present its case strongly, there is a bright prospect of defending the enhanced BC quota," he said.

Kishan Reddy has reiterated that the Congress government's attempt to provide 42% reservation to the Backward Classes (BCs) in local bodies would not at all benefit the BCs, as they would only get 32% reservation since the proposed BC reservations include 10% Muslim quota. He accused the Congress government of resorting to appeasement politics for political gains. Addressing a protest organised by the BJP OBC Morcha at Dharna Chowk on Saturday, Mr. Reddy said the reservations would indeed be around 32% for the BCs, as 34% reservations in local bodies were already in implementation before the BRS regime in the State. 'The Congress government has not completed the process to implement 42% reservations for the BCs. Instead, it's trying to defame the BJP and the Centre,' he said. Former Chief Minister K. Chandrashekar Rao also reduced the reservations to 23% from 34% in the local bodies for BCs. Now, Mr. Revanth Reddy is also trying to reduce the reservations, he alleged. 'The people of Telangana are observing Revanth Reddy's anti-BC actions. Despite being in power in the State and at the Centre for many years, the Congress has not conducted a caste census. To do justice to the BCs, the Centre, led by Prime Minister Narendra Modi, will conduct a caste census along with the population census. If the Revanth Reddy government is really sincere about the welfare of BCs, I demand that it offer 42% reservation to the BCs as announced,' he added. BJP State president N. Ramchander Rao also slammed the Congress for its attempts to stage a protest at Jantar Mantar in New Delhi on August 6 over the issue of BC Bills. Mr. Rao said it is the responsibility of the Congress government to implement the two Bills passed by the Telangana Assembly in March this year, which provide 42% reservation to BCs in local bodies, education and employment. BJP senior leaders, including MP Eatala Rajender and MP (Rajya Sanbha) R. Krishanaiah, attended the meeting.

He also urged the lawyers community to help protect the right to vote of every Indian by creating legal banks in every constituency, as suggested by Rahul Gandhi. "Congress' history is country's history, Congress' strength is country's strength. The Gandhi family has kept the Congress family united and the Congress has kept the country united. Otherwise our country would have been broken into various pieces," he said.
