Kolkata: Two days since recieving bail, red tape held back the release of the 26-year-old MBA student from Karnataka who had been accused of raping a young woman on the B-school campus two weeks ago. Paramanand Toppannawar, the second-year MBA student at Kolkata's premiere B-school was granted bail on Saturday, after a week's stay in police custody. He is still spending his days at Haridevpur Police Station. "As per the bail conditions, he needs to submit his passport before the police station. But his passport is at his hostel room which has been sealed by the cops for investigation. We have requested them to get the passport collected and submitted before the police station but it couldn't be done till Monday night," said Kanishk Ravindran, the youth's counsel. He was also asked not to leave the state and meet the investigating officer every alternate day. "We also haven't been able to submit the surety as a local guardian needs to sign the document. A person known to Paramanand's parents have agreed for the same but he couldn't come to Alipore court on Monday as he claimed he couldn't get a transport due to the July 21 rally," said Ravindran. Toppannawar was granted bail on Saturday after his counsel questioned the delay in recording the woman's confessional statement before the magistrate and termed the woman a "ghost complainant". Incidentally, the woman had missed three dates set for the recording of her statement before the court and didn't submit her clothes, cellphone or consent for a medico-legal test, giving the investigators a hard time.

He is set to return to campus and resume his studies this week but will not stay in the institute hostel from now on. "He has missed more than a week's classes and is eager to resume studies at the earliest. However, the hostel room allotted to him is still sealed for investigation, and he doesn't want to stay on the institute premises. He is likely to stay in rented accommodation near the institute and one of his parents is likely to stay with him," said Kanishk Ravindran, the youth's counsel. Institute officials said since the court granted him bail and there is no condition preventing him from entering the campus, there is no basis on which the institute can restrict him from attending classes or staying at the hostel. Although he was granted bail late on Saturday, he spent Sunday at Haridevpur PS due to bond-related legalities. His lawyers said he is likely to leave the police station on Monday evening, after completing all formalities. "We are supposed to submit Rs 25,000 before the cash branch of the court, but it was closed on Sunday. We are also procuring his passport to submit to police," said Ravindran. Meanwhile, the B-school campus has been abuzz with discussions on whether he should be allowed to attend classes. While a section of students and teachers feel that sharing space with him might make other students uncomfortable, others believe he should be allowed in since he was granted bail.

The court questioned the delay in recording the survivor's confessional statement before the magistrate. Incidentally, the woman had missed three dates set for recording of her statement before the court. Since lodging the complaint on July 11, she didn't hand over her clothes, cellphones and also didn't agree for a medico-legal test. Her father claimed that police had forced her to file the plaint and that nothing had happened to her. Demanding bail, the accused's lawyer, Subrata Sardar, argued that the complainant was "untraceable" and termed the FIR as "questionable" while presenting how the survivor didn't appear before the court to record her statement thrice and no reason was cited. 24-year-old psychologist reported a rape on a Kolkata business school campus, leading to the arrest of an MBA student KOLKATA: The 24-year-old psychologist, who was allegedly raped on the campus of a premier business management school in Kolkata, walked into Thakurpukur PS around 7.30pm on Friday, accompanied by a male friend, said police sources. She wrote out her complaint while seated in front of the duty officer. The officers then escorted her to Haridevpur PS, where the complaint was formally lodged, an officer added. Police said they have CCTV footage to corroborate the facts, in response to the woman's father's claim that 'nothing has happened.' On Saturday, police arrested second-year MBA student Paramanand Toppannawar. He has been remanded in police custody for seven days. But barely 12 hours after the complaint was lodged, the woman's father said the police had 'made' his daughter file the complaint. Following this, police formed a nine-member Special Investigation Team (SIT) to probe the incident. The institute official said: 'The two entered together in a car at 12.30pm when they first signed the logbook at entry gate. Next they signed at hostel gate at 12.45pm. The woman left on her own in a car after making exit entry at hostel gate at 3.10pm.' The SIT has collected CCTV footage from Thakurpukur PS, along with other evidence, to establish a clear chronology of Friday's events. The woman, in her complaint, said she went to the campus around 11.45am on Friday for a private counselling session with Toppannawar when he took her to his hostel room, spiked her drink, and allegedly assaulted and raped her. But, on Saturday, her father told reporters that his daughter's scooter rammed an auto on DH Road. She lost consciousness and woke up at SSKM, where cops questioned her and then made her write the plaint. Since then, the woman has neither agreed to a medico-legal test nor submitted her apparel and cellphone. Police said they checked CCTV cameras and traffic records on DH Road and found no evidence of any accident between Friday afternoon and evening involving a scooter and auto rickshaw. 'We have CCTV evidence that shows the woman entering Thakurpukur PS at 7.30 pm with another man. She narrated the ordeal, following which she wrote the plaint sitting inside the PS. Once it was drafted, she was escorted in a police car to Haridevpur PS, under whose jurisdiction the institute falls,' said a senior officer. Cops said while there were some marks of assault on her body, they didn't find any evidence of accident on her. 'She initially even confessed before the doctor at SSKM about the sexual assault and other physical assaults on her while she was inside the hostel room on Friday. But she has not been cooperating with cops since then,' said an officer. Police have come across inconsistencies even in her statement. While she had written in plaint that she was not allowed to enter her name in the register, institute officials said she had registered her name at 12.30 pm at the entrance and at 12.45 pm at the hostel gate. The register also shows she left the hostel at 3.10 pm after entering her exit time. The SIT summoned the woman and her parents to Haridevpur PS, but they didn't turn up till late on Sunday. KOLKATA: A 24-year-old woman lodged a rape complaint against a 2nd-year student of one of India's premier management institutes on Friday evening, leading to the latter's arrest. Barely 12 hours later, however, the woman's father denied 'anything had happened' and suggested cops had 'made' his daughter file the complaint, turning on its head another seemingly openand-shut case of campus rape. (Institute insiders, however, said this was not true.) Once inside the campus gate, Toppannawar led her to his room at the men's hostel citing privacy concerns. It was there that she was offered a slice of pizza and a drink and she began feeling 'dizzy' almost as soon as she finished the drink, cops said quoting from her complaint. She then told Toppannawar that she wanted to use the washroom (just outside his room) because she felt like throwing up but was not allowed; Toppannawar claimed it would be a problem for him if other students spotted him with a woman. I slapped him in defence but he then grabbed my neck and hand. I do not remember anything after that — where I was or what I was doing —but can recall him touching me inappropriately, grabbing my waist and pulling down my pants. He sexually assaulted me. I found myself on his bed when I regained my senses.' She said she somehow pulled herself together and managed to leave the campus, following which she contacted a friend who asked her to immediately report the matter to the police. She first went to Thakurpukur police station from where where she was guided to Haridevpur, where the complaint was registered. The entire case, however, was turned on its head barely 12 hours after the woman registered the FIR. Her father told several television channels — with his back to the cameras — that no one tortured her daughter and that she had only suffered some injuries after falling off an autorickshaw. 'My daughter called me around 9.40 pm to say she had hurt herself after falling from an auto. Haridevpur cops rescued her and took her to SSKM Hospital. Cops told me my daughter had been abused and one person had been arrested but my daughter told me nothing of this sort had happened. Cops told her to say certain things during the medical examination that she did not say,' he added. 'She has no connection with the arrested person. I do not know where Haridevpur cops found her. My daughter said the police made her write the complaint,' he said in a statement filled with gaps. Cops, taken aback by this development, said they acted only after the woman (a psychologist) lodged a complaint and were doing everything according to law. 'Our immediate challenge is to prove the sequence of events,' an investigator said. 'We have repeatedly gone to the woman's home but the family is stonewalling us. They have not given us her clothes and mobile — all crucial pieces of evidence — and are going on telling us that the woman is sleeping,' a senior official said. Officials started a case under BNS Sections 64 (rape) and 123 (causing hurt by means of poison or other harmful substances with intent to commit another offence) and then added BNS Sections of 127(2) (wrongful confinement), 115(2) (voluntarily causing hurt) and 76 (assault or use of criminal force on a woman with intent to disrobe her). State counsel Sourin Ghosal asked the court for Toppannawar's police custody, claiming he was 'influential' and could destroy evidence; he was also not cooperating with the probe. 'It is an ideal case of matching merit with mismatching mental health (sic). He may be meritorious but the crime he has committed speaks of his mentality,' Ghosal said. Defence counsel Subrata Sardar said the complaint itself was 'fishy'. 'The woman was on the campus from 11.45 am to 8.30 pm. But the complaint was lodged at 8.30 pm at a police station 4.5 km away. How is it possible?' he asked. Mother of rape accused Paramanand Mahaveer Toppannawar who reached Kolkata from Karnataka on Saturday said: 'My son is innocent. He has come so far to study. He will never do such a dirty thing,' she said. 'We received a call from his friend around 11 pm. He told us that my son has been arrested and he didn't know the reason... We have no clue why our son has been arrested... We want to meet our son and talk to him... He was in the final year of his college. .. We do not know anything here in Kolkata — where the police station is or where the court is. All we know is that our son is innocent.'
