Cuttack: The Enforcement Directorate (ED) Deputy Director Chintan Raghuvanshi, who was arrested by the CBI in May for bribery, walked out of Jharpada jail in Bhubaneswar on Friday evening after being granted bail by Orissa High Court. The High Court also granted bail to Chintan's associate Bhakti Binod Behera, from whose vehicle the CBI sleuths had recovered the bribe money. Justice Gourishankar Satapathy allowed their separate bail pleas through a common order, imposing stringent conditions. Raghuvanshi and Behera were arrested from two locations in Bhubaneswar after the CBI caught them red-handed while accepting bribe from a city-based mining businessman. According to the agency, Raghuvanshi had placed a bribe demand of Rs 5 crore, which was reduced to Rs 2 crore and Rs 20 lakh was received as an instalment. Raghuvanshi had reportedly demanded the amount from the businessman with a promise not to arrest him or attach his property in the 12 cases of financial irregularities pending against him with the ED. Earlier this month, Raghuvanshi was granted an interim bail for 10 days by the High Court to visit his ailing wife and their newborn. He returned to jail as soon as his interim protection was over.

The HC also granted bail to Chintan's associate Bhakti Binod Behera, from whose vehicle the CBI sleuths had recovered the bribe money. Justice Gourishankar Satapathy allowed their separate bail pleas through a common order, imposing stringent conditions. Raghuvanshi and Behera were arrested from two locations in Bhubaneswar after the CBI caught them red-handed while accepting bribe from a city-based mining businessman. 'The IRS officer was released from the jail on Friday evening after relevant documents from the HC and lower court were produced to the jail authorities", his lawyer Lalitendu Mishra said. Besides Mishra, senior advocates Ashok Kumar Parija and Soura Chandra Mohapatra also represented Raghuvanshi. Observing that the investigation has made significant progress and that the trial is unlikely to commence soon, the HC stated that bail is the rule and jail is the exception. 'The bail applications of Raghuvanshi and Behera are allowed and both are allowed on furnishing bail bonds of Rs 1 lakh with two solvent sureties for the like amount to the satisfaction of the trial court," the HC said. The other conditions include that the petitioners shall not commit any offence while out on bail, shall remain present in the trial court during hearings, and shall not leave the country without prior permission of the trial court. They are also required to provide the address of their place of stay and surrender their passports before the court. CUTTACK: The Orissa High Court has granted bail to Chintan Raghuvanshi, a 2013-batch Indian Revenue Service (IRS) officer and deputy director of the Enforcement Directorate (ED), who was arrested by CBI on May 30 in connection with a bribery case. Justice Gourishankar Satapathy granted bail to Raghuvanshi on furnishing bail bonds of Rs 1 lakh with two solvent sureties of the same amount to the satisfaction of the trial court. As part of the bail conditions, the court directed the surrender of Raghuvanshi's passport and restricted him from leaving the country without prior permission. Senior advocates Ashok Parija and Saura Chandra Mohapatra along with advocate Lalitendu Mishra represented the IRS officer. In a detailed order on July 23, Justice Satapathy noted that while the investigation had progressed significantly, there was no immediate prospect of trial. He observed that Raghuvanshi had been in custody for over 50 days and the offence, although serious, carries a maximum punishment of seven years. It was also noted that the CBI had not sought custodial interrogation and that Raghuvanshi had cooperated with investigators, including providing his mobile phone password and complying with interim bail conditions. The court also granted bail to Bhakti Binod Behera setting identical conditions.

Justice Gourishankar Satapathy allowed Raghuvanshi to go on bail on furnishing a bond of Rs 1 lakh with two solvent sureties of like amount, subject to conditions, including surrender of his passport and restrictions on travel without prior court permission. Senior advocate Ashok Parija and senior advocate Saura Chandra Mohapatra, along with advocate Lalitendu Mishra, represented the officer. The court, in its order on July 23, noted that Raghuvanshi has been in custody for over 50 days while the investigation is still ongoing and the trial has not yet begun. "Bail is the rule, jail the exception," Justice Satapathy observed, underlining that an accused is presumed innocent until proven guilty. The court also pointed out that the CBI has not sought custodial interrogation of Raghuvanshi at any stage and that he had cooperated with the investigation, including providing passwords to his mobile devices. It was also noted that the accused had not misused the liberty granted during interim bail. The CBI has alleged that Raghuvanshi received illegal gratification through co-accused Bhakti Binod Behera. The tainted money was allegedly recovered from a vehicle linked to Behera. The primary evidence against Raghuvanshi includes phone conversations with the complainant and co-accused. The court held that fears of Raghuvanshi being a flight risk could be addressed through appropriate bail conditions and said economic offences do not automatically warrant denial of bail.

2006 Mumbai train blasts: Maharashtra should appeal against High Court verdict in SC, says former ATS chief KP Raghuwanshi

Former Maharashtra Anti-Terrorism Squad (ATS) chief, K P Raghuvanshi, who headed the investigation into the 2006 Mumbai train blasts case, said Monday the state government should appeal against the Bombay High Court judgement acquitting all 12 accused. The Bombay High Court set aside a special court verdict that awarded the death sentence to five accused in the 2006 Mumbai train blasts, and refused the Maharashtra Government's plea seeking confirmation of their sentences. The high court acquitted all 12 accused in the case, including those sentenced to life imprisonment. Speaking to The Indian Express, Raghuvanshi said, 'I believe we had made a very strong case on the basis of which the trial court had convicted the accused. Now, ATS will examine the judgment, and in consultation with the PP (public prosecutor) and other legal experts, they will decide on the appeal. In my opinion, they should definitely go to the appeal against the judgment.' 'We are pretty sure that we have done a good investigation and collected ample evidence; that's the reason why the trial court had convicted the accused previously. I have been retired from ATS for more than 10 years. The current ATS chief's team will examine the judgment and decide on the appeal. I believe they should appeal against the verdict in the Supreme Court of India,' Raghuvanshi added. As many as 15 ATS officers investigated the train serial blasts that occurred on July 11, 2006, in seven western suburban coaches of a train, killing 189 commuters and injuring 824. ATS arrested Kamal Ahmed Mohd Vakil Ansari from Bihar, Mohammad Faisal Ataur Rahman Shaikh from Mumbai, Ehtesham Qutubuddin Siddique from Thane, Naveed Hussain Khan from Secunderabad, and Asif Khan Bashir Khan from Jalgaon in Maharashtra. All of them were previously found guilty of planting the bombs by the trial court. Besides this, ATS also arrested Tanveer Ahmed Mohammed Ibrahim Ansari, Mohammed Majid Mohammed Shafi, Shaikh Mohammed Ali Alam Shaikh, Mohammed Sajid Margub Ansari, Muzammil Ataur Rahman Shaikh, Suhail Mehmood Shaikh, and Zameer Ahmed Latifur Rehman Shaikh, who were awarded life terms. One of the accused, Wahid Shaikh, who was arrested by ATS, was acquitted by the trial court after spending nine years in jail. ATS investigators had recorded statements of around 250 witnesses, including 92 prosecution witnesses, and gathered evidence spanning over 169 volumes. Validating ATS's investigation, and after an over eight-year trial, a special court under the Maharashtra Control of Organised Crimes Act (MCOCA) in October 2015 awarded the death penalty to five of the convicts and life terms to seven others. However, nine years later, the Bombay High Court set aside the previous verdict. 'It is unsafe to reach the satisfaction that the accused appellants have committed the offence for which they have been convicted and sentenced. Therefore, the previous judgment and order of conviction and sentence are liable to be quashed and set aside,' the court said.
