Unemployed man wielding samurai sword in spat gets 12 years' jail
MUAR: An unemployed man who threatened a rival with a samurai sword in a revenge-fuelled confrontation was sentenced to 12 years in jail and four strokes of the cane by the Sessions Court here today. Muhamad Shukri Rahmad, 31, who has 13 prior convictions, pleaded guilty to possessing a dangerous weapon in public and testing positive for drugs. "I regret what I did. I beg the court to consider a lighter sentence," he said before Judge Sayani Mohd Nor handed down the sentence. For the sword possession offence, the court sentenced him to five years' jail and one stroke of the rotan. According to the charge, the man was found in possession of a 90cm samurai sword without lawful authority at an eatery on Jalan Sungai Abong here at 3.13pm on May 24. He was charged under Section 6(1) of the Corrosive and Explosive Substances and Offensive Weapons Act 1958, which carries a maximum of 10 years' imprisonment and whipping. According to the facts of the case facts, a 33-year-old man lodged a police report claiming that he was approached by three helmeted and masked men, including the accused, who was armed with the sword. The accused allegedly swung the sword several times at the victim, who managed to avoid being struck. Police investigations showed that the accused had harboured a grudge against the victim following a prior fight and had sought revenge. In a separate charge, Shukri also pleaded guilty to drug use and was sentenced to seven years' jail and one stroke of the cane after testing positive for amphetamine and methamphetamine. Deputy public prosecutor Diyana Najihah Muhamed Fauzi prosecuted the case, while the accused was unrepresented. The court ordered both sentences to run concurrently from the date of his arrest on May 29. He will also be placed under police supervision for two years after completing his prison term.

Court orders man to enter defence in rape case involving ex-girlfriend
MUAR: A man accused of raping his girlfriend three years ago has been ordered to enter his defence in the Sessions Court here today. Judge Sayani Mohd Nor made the ruling after finding that the prosecution, led by deputy public prosecutor Diyana Najiha Muhamed Fauzi, had successfully established a prima facie case against the accused, Muhamad Amir Ismail, 23. In delivering her decision at the close of the prosecution's case, Sayani said the court had thoroughly examined the testimonies of all prosecution witnesses and the exhibits presented. "This ruling also takes into consideration the written submissions from both the prosecution and the defence throughout the trial. "At the maximum evaluation stage, the court is satisfied that the prosecution has successfully proven a prima facie case under Section 376(1) of the Penal Code," she said. Following the decision, the court informed the accused of three options: to give a sworn statement from the witness stand, an unsworn statement from the dock, or to remain silent. Lawyer Syafie Naim from the National Legal Aid Foundation subsequently informed the court that his client had opted to give a sworn statement from the witness stand and would call three witnesses on July 14. The accused, who is unmarried, is charged with raping his 16-year-old girlfriend at his home in Segamat at 11pm on June 2, 2022. If convicted, he faces up to 20 years' imprisonment and whipping under Section 376(1) of the Penal Code. Earlier reports said that the accused had gone out with friends, including the victim, before taking her back to his home. He allegedly committed the offence before sending her home, after which a police report was lodged at the Jementah police station. The accused was arrested on June 29 that year and is currently being held at the Muar Correctional Centre after failing to post the RM10,000 bail set by the court.

Cattle sale fraud: Clerk pleads guilty to money mule role, fined 10k
MUAR: A 24-year-old clerk was fined RM10,000 by the Sessions Court here today after she pleaded guilty to allowing her bank account to be used by a scam syndicate linked to a bogus cattle sale. Siti Noratieka Abdullah admitted to the offence before judge Sayani Mohd Nor after the charge was read out in court. She was accused of indirectly facilitating the deposit of RM3,500 into her bank account at a premises in Jalan Bukit Pasir, Kampung Temiang, at 11.30am and 5.34pm between Jan 30 and 31. The case was prosecuted under Section 424C(1) of the Penal Code, which provides for a fine of up to RM150,000 or a jail term of up to 10 years, or both. Case facts revealed that the scam came to light after a 20-year-old man responded to a Facebook advertisement under the name "Hisham Roslan" on Jan 29 offering cattle for sale. The victim transferred the payment into the accused's account, unaware it was being used by the syndicate. Siti Noratieka paid the fine.

Father of 2 ordered to enter defence over child sexual assault charge
MUAR: The Magistrate's Court here today ordered a highway maintenance worker to enter his defence over allegations of sexually assaulting a child under his wife's care two years ago. The 42-year-old father of two, was charged under Section 14(a) of the Sexual Offences Against Children Act 2017. He pleaded not guilty. Magistrate Sayani Mohd Nor made the ruling after finding that the prosecution, led by Othman Affan Ismail, had successfully established a prima facie case against the accused. "In delivering the decision, the court considered witness testimonies, documentary evidence, and submissions from both parties. "After thorough evaluation, the court finds that the prosecution has established a prima facie case. "The accused is now given three options: to make a sworn statement from the witness box, make an unsworn statement from the dock, or remain silent," said Sayani. Defence counsel Syafie Naim, from the National Legal Aid Foundation, said his client had chosen to give a sworn statement from the witness box and would call one witness during the defence stage on June 16. The man is accused of sexually assaulting a four-year-old girl who was under the care of his wife while the child's parents were at work. He was accused of committing the act at a house in Simpang Renggam, Kluang between 11am and 6.45pm, on Sept 19, 2023. He is currently detained at the Muar Correctional Centre after failing to post the RM10,000 bail set by the court.
