Yamuna floodplains to be marked with physical boundaries across 17 districts by March
Agra: The irrigation department has informed the National Green Tribunal (NGT) that the project to physically mark the Yamuna floodplains with visible boundary indicators will begin in Oct, following the completion of the tendering process in Sept. In an affidavit submitted to the tribunal, the department said over 21,000 physical markers ('muddis') will be installed at 200-metre intervals along both banks of the river across a 1,056-km stretch spanning 17 districts from Gautam Buddh Nagar to Prayagraj. The project is expected to be completed by March next year. The development comes months after the NGT imposed a penalty of Rs 50,000 each on the ministry of jal shakti and the central water commission in July last year for failing to act on floodplain demarcation, following a letter petition by Agra-based environmentalist Sharad Gupta. The court stated: "Issue of rampant & large scale illegal mining destroying sand dunes & ravines in the vicinity of Taj Mahal & restricted flood plain zone of the Yamuna was raised through a letter petition by Sharad Gupta based on a news article published in TOI dated March 6, 2022, & cognisance was taken by this tribunal; exercising suo-moto jurisdiction." "The decision to install physical boundary markers is a significant step in protecting the ecological identity of the Yamuna. These visible indicators will help prevent illegal encroachments and ensure better public understanding of restricted floodplain zones," said the petitioner. He added, "In Agra alone, where the Yamuna flows for 167 km, the floodplain extends up to 5.09 km on the right bank and 2.55 km on the left. The upcoming work must be matched with strong monitoring to ensure long-term compliance." In Feb, the central water commission had demarcated the floodplains using satellite imagery provided by a Hyderabad-based remote sensing agency. The findings were compiled in a 521-page geospatial report submitted to the tribunal. The 17 districts covered under the NGT's directive are: Gautam Buddh Nagar, Aligarh, Mathura, Hathras, Agra, Firozabad, Etawah, Jalaun, Auraiya, Kanpur Dehat, Hamirpur, Kanpur Nagar, Fatehpur, Banda, Chitrakoot, Kaushambi, and Prayagraj.

In-laws told to provide woman accommodation or pay her rent
New Delhi: Directing the in-laws of a woman to either arrange accommodation for her or pay the rent for her separate stay, a court has observed that an aggrieved person under Protection of Women from Domestic Violence Act has the right to reside in the shared household even in the absence of actual residence in it. Citing a Supreme Court ruling, the court of additional sessions judge Sharad Gupta said in his June 6 order that a woman couldn't be excluded from the shared household even if she didn't actually reside there. The petitioner, Shalini Chauhan, alleged that after her marriage in 2021 in Faridabad, she was subjected to domestic violence, following which she decided to live separately. The court was hearing her appeal against an order of a magisterial court in Sept 2023, which did not issue directions on the issue of accommodation. Vineet Chauhan, her husband who is absconding, didn't give interim maintenance to her since Jan 2023. The appellant, through her advocate Archana Sharma, said she was facing financial difficulties as her husband had filed a plea claiming he wasn't involved in any violence and not liable to pay maintenance. "Rather, as per record, the respondent no. 1 has abandoned his parents as well as his wife. Thus, considering that the appellant was living in the matrimonial home prior to the breakdown of relationships, the respondents would have to provide some shelter or rent to the appellant for a reasonable period of time," the judge said.

Agra: The National Green Tribunal (NGT) has directed the UP govt to physically demarcate the Yamuna floodplains by installing markers every 200 metres along a 1,056km stretch across 17 districts by July 30, emphasising that visible physical markers — not just geo-coordinates — are necessary to make floodplain boundaries understandable to the public. The directions were issued on Friday in response to a petition filed by Agra-based environmentalist Dr Sharad Gupta, who raised concerns about the destruction of the eco-sensitive Yamuna ravines, including areas as close as 800 metres from the Taj Mahal. Gupta told TOI, "The previous Central Water Commission report had relied solely on geo-coordinates, which common people found difficult to comprehend. This move will help prevent encroachments by making floodplain boundaries clearly visible.
