Legal experts say, if a developer makes a representation to a home buyer, whether through a brochure, advertisement, or sale agreement, and that representation turns out to be false or inaccurate, it constitutes a breach of trust. This is legally actionable and, in such cases, homebuyers have the right to seek compensation or other remedies under RERA or before a consumer court. Advocate Chandrachud Bhattacharyya explained that such legal safeguards are necessary because homebuyers are often misled by glossy marketing or vague promises. He emphasized that the larger principle at play is that a developer cannot misrepresent project features or intentions. Authorities like RERA are now laying down clear guidelines to ensure buyers can make informed decisions and receive fair redressal when misrepresentation of projects is being done, he pointed out. 'These regulations are critical to protect homebuyers,' he said. 'They help ensure that when someone invests in what is often their dream home, they do so with clarity, transparency, and legal protection.'

Chennai: Plots and houses only three kilometres from Kilambakkam and two kilometres from GST Road, with hundreds of amenities — ads with such claims have become all too common, flooding social media feeds and highway hoardings. But under a recent order by TNRERA (Tamil Nadu Real Estate Regulatory Authority), builders showcasing ads with vague, exaggerated, and misleading claims are set to get pulled up. With this crackdown, TNRERA has sent a strong message to the real estate industry: promotional gimmicks and half-truths will no longer be tolerated. The era of unchecked advertising is over. And buyers, finally, have the right to clarity. TNRERA has made it mandatory for all real estate advertisements whether in print, on television, outdoor hoardings, digital platforms, or social media to prominently display the project's RERA registration number, a scannable QR code (as per form-C), the official website of the authority, the approved location of the project, and complete promoter contact details. The order by chairperson Shiv Das Meena, states that the directive is aimed at curbing misleading practices and ensuring that buyers can easily verify the authenticity and legal status of real estate projects before making decisions. The rules specify that RERA details must appear at the top right corner of all advertisements, including hoardings and print material, with a minimum font size to ensure visibility. "The mandate also extends to the finer details. Every ad must mention the promoter's name, office address, and contact information. If a landmark is cited, only the actual distance via the most commonly used route is allowed no reference to travel time, which can vary with traffic, is permitted. The location must match the officially approved plan submitted for registration," said S Ramprabhu, chairman of the DTCP committee at the Builders Association of India. For projects exempt from RERA registration such as those completed before May 1, 2017 the advertisement must clearly state the exemption and the reason. In addition, online property portals are no longer allowed to feature or promote any project that does not carry valid TNRERA registration details, QR code, and the official website address. Media outlets, too, are being held accountable. TNRERA has warned that any media platform publishing non-compliant advertisements could face escalation to the Ministry of Information and Broadcasting and other regulatory bodies. Violations will attract penalties under sections 61 and 63 of the Real Estate (Regulation and Development) Act, 2016. To support these changes, Regulation 8(3) of Tamil Nadu Real Estate Regulatory Authority (General) Regulations, 2018, has been amended to make it clear that all real estate publicity whether through press, banners, pamphlets, or social media must carry RERA registration details as prescribed under the revised Regulation 6.

Chennai: To enhance transparency and consumer awareness, Tamil Nadu Real Estate Regulatory Authority (TNRERA) has issued a circular mandating the installation of prominent display boards at all registered real estate project sites. The order, dated May 7, applies to both building and layout projects across the state. "The circular outlines the essential information that must be displayed on these boards: name of the promoter, project name, TNRERA registration details, date of completion as per TNRERA registration, and the website address of TNRERA," TNRERA member, M Krishnamoorthy. The regulatory body has reiterated the rule mandated under the Real Estate (Regulation and Development) Act, 2016 (RERA). TNRERA has also said that a condition regarding the display board installation will be incorporated in form-C, which is part of the registration process. Compliance will be rigorously checked and ensured before the issuance of the completion report.
