Review 5-year-old rape survivor's custody: HC
Kolkata: The Calcutta High Court directed authorities to produce a five-year-old girl—reportedly a victim of sexual assault allegedly committed by her father and currently living in a children's home—before a special court on Friday. The special court will assess her mental state and decide whether she can be safely returned to her mother's custody. "For an infinite period, you cannot keep her from the custody of her mother. She is a five-year-old child, not an accused. She is a victim of circumstances," Justice Tirthankar Ghosh told the state. A CFSL report and a judicial statement of the child were submitted on Thursday. The state counsel objected to the immediate handing over of the child to the mother, as she is in a state of trauma. The state informed the court that after the ossification test, the chargesheet against the father would be submitted before the trial court. According to the mother's counsel, Sanjukta Samanta, the father is in police custody. The mother moved a petition before the court, stating that the child was sent to a child home on the pretext of mental health and no statement of the survivor and mother has been recorded to date. IC Markets Start Now Undo The petition states that the incident took place on April 8. Both parents work as daily labourers at Sankrail in Howrah. On the fateful day, the child was found crying and bleeding from her private part near the field where the parents worked. The mother's claim was that unknown miscreants raped her daughter. It was her claim that after treatment at the hospital, the daughter was taken to the local child home on April 9, and the father was kept with them for further investigation. It was after days that she came to know her husband was arrested for allegedly sexually assaulting their child and remanded in police custody. The mother claimed, "Cops has not at all been probing the case and has fabricated her husband as accused in the case and has put him behind the bar illegally without any information to her for an indefinite period."

Police strength less, now is the time to hire more: HC to govt on Murshidabad violence
Releasing a petition seeking a CBI probe into the murder of a father-son duo, who were killed in the communal violence that had rocked parts of Murshidabad district in April, the Calcutta High Court on Thursday advised the state government to employ more police personnel. 'Now is the time to recruit sufficient police personnel. The number of police personnel in each district is less. The police force in Murshidabad is also very small,' the court said, adding had there 'been a sufficient number of police personnel, the situation in Dhuliyan could have been brought under control'. The High Court bench further commented that there should be a minimum number of forces in every place. The state government's counsel, Kalyan Bandopadhyay, however, pointed out that there is a shortage of forces in the entire country. 'If there were sufficient forces, the incident in Pahalgam would not have happened,' Bandopadhyay said, referring to the April 22 terror attack in Kashmir in which 26 people, all tourists but one, were shot dead. Earlier, the single Bench of Justice Tirthankar Ghosh had released the petition, since a Division Bench was already hearing issues related to the incidents in Murshidabad, and the present petitioners were alleged victims of violence in the district. The matter will be sent back to the Chief Justice of the High Court for assignment to a new bench for hearing. Haragobinda Das and his son Chandan were allegedly hacked to death by rioters at Samserganj in Murshidabad district on April 12 during protests over the new Waqf law. It had been stated before the single bench of Justice Tirthankar Ghosh that their family members came to Salt Lake, and were staying at a house there with the purpose of filing a petition before the high court. Their lawyer had stated before the court that the door of the house was broken, and abuses were hurled at the family members of the deceased father and son by personnel from Bidhannagar police commissionerate.

Refrain from holding pol events over next wk: HC
Kolkata: The Calcutta High Court on Thursday urged all political forums to refrain from holding any programme over the next week, "keeping the country's current situation in mind". The HC observations came after the Centre on Thursday told it that due to Army training on a 'war-footing basis' at Brigade Parade Ground, they could not allow All India Muslim Personal Law Board (AIMPLB) to stage an anti-Waqf demonstration there on Saturday (April 26). The AIMPLB had moved the HC after their application was "not granted" by the Army commanding officer without specifying any reason. Justice Tirthankar Ghosh dismissed the Army's order on April 21 and directed them to cite a "reasoned communication" to the board "in respect of the reservations, if any, of the Army to grant permission for the meeting at Brigade Parade Ground... preferably within 24 hours". The judge asked the Board to apply afresh for permission on May 3 and the Army to reply. Asked the reason for not granting permission, the additional-solicitor general (ASG), Ashoke Kumar Chakraborty, spoke about rioting in Murshidabad. "This (anti-Waqf protests) necessitated riots in Murshidabad and Malda. The other (Calcutta HC) division bench permitted the deployment of paramilitary forces without the state permission." he said. Asked for the reason for not granting the permission, the ASG admitted, "There is no reason, it's a simple rejection, based on the given situation and circumstance."
