Flying Dust First Nation and Canada reach settlement agreement Français
FLYING DUST FIRST NATION, TREATY 6 TERRITORY, SK, July 25, 2025 /CNW/ - Crown-Indigenous Relations and Northern Affairs Canada and Flying Dust First Nation Today, Chief Tyson Bear of Flying Dust First Nation and the Honourable Rebecca Alty, Minister of Crown-Indigenous Relations, announced a settlement agreement to resolve a land-related claim between Canada and the First Nation. Canada will provide more than $55 million in compensation to the Flying Dust First Nation for the improper transfer of 214.81 acres of treaty land in 1932 to the Canadian Pacific Railway which denied the First Nation its use for generations. Since then, about 200.8 acres have been returned, including two pieces of land held by Canada for a Royal Canadian Mounted Police (RCMP) detachment. The RCMP and the First Nation signed a lease, and on November 7, 2024, the land was formally transferred back to reserve status. The remaining land, once owned by the railway company, was remediated through cooperation between Canada, the Canadian National Railway (successor to the Canadian Pacific Railway) and the community. As part of the agreement, the First Nation may also add nearly 14 acres to its reserve through Canada's Additions to Reserve process. The Flying Dust First Nation has always recognized the Railway lands as reserve land. The story of how it it was expropriated in the early 1930s is part of the oral history of leadership. The story of the land has been passed down the years to ensure the people didn't forget. From Chief to Chief, from Council to Council, the Flying Dust First Nation always committed to have the railway lands returned home. A plan was made in 1992 when Chief Richard Gladue placed a caveat on the lands and launched the lawsuit. In the 30 years that followed, every Chief and Council joined the team and pushed the file forward. The most recent leadership team, Chief Tyson Bear, Council Calvin Bear, Marie Gladue, Nick Derocher, Charmaine Mirasty, were the ones who got to see the claim to its fruition. The vision of reacquiring the Railway Lands has always been seen as a certainty. As such, plans for development of the property has been ongoing for almost 20 years. Flying Dust has always had a vision of what the land could be and what it would mean for the people of Flying Dust, Meadow Lake and the surrounding communities. Settlements like this provide funding that First Nations can use to buy land and create new opportunities for their communities and economies. Settling specific claims is one way Canada is working to rebuild trust and strengthen its relationships with First Nations. By providing fair compensation when promises haven't been kept, Canada is taking responsibility for the past and working toward a more respectful future. Buckley Belanger Secretary of State (Rural Development) Quick facts Flying Dust First Nation is a Cree reserve located in northwestern Saskatchewan, located adjacent to the city of Meadow Lake. With 2674 members (646 living on-reserve and 2028 living off-reserve) the community has developed a reputation as a strong, progressive community. Flying Dust First Nation adhered to Treaty 6, which was signed by Crown representatives and Cree, Assiniboine, and Ojibwe leaders on August 23, 1876 at Fort Carleton, Saskatchewan, and on September 9, 1876 at Fort Pitt, Saskatchewan. The Treaty boundaries extend across central portions of present-day Albert and Saskatchewan. Railway construction began in 1930. The line was fully operational by 1932. Over time, the railway lands included a passenger station, up to eight grain elevators, two fuel depots, a stockyard, creamery, fish plant and planer mill. In the 1970s, CPR started to sell some of the commercial lots. In 1978, Canada purchased two of the lots to build an RCMP detachment. CN purchased the remaining lots in 2006. By 2009, all railway operations had stopped. The tracks were removed in 2014. Starting in 2011, Canada began working with Flying Dust and CN to remediate the land so that it could be transferred back to reserve status. Specific claims deal with past wrongs against First Nations. These claims (made by First Nations against the Government of Canada) relate to the administration of land and other First Nation assets and to the fulfilment of historic treaties and other agreements. Claims are addressed through an alternative dispute-resolution process under the Specific Claims Policy, and, since 2009, the Specific Claims Tribunal Act. Over the past five years (April 1, 2020 to May 31, 2025), 229 claims have been resolved for nearly $15.1 billion in compensation. In the tariff war, is Canada forgetting about Indigenous nations?
In the fear and fury generated by the US administration's thuggish treatment of Canada and other allies and trade partners, Canadian political elites have donned the Captain Canada mantle. Virtually all political parties and think tanks are asserting Canadian sovereignty and making commitments to jobs and incomes by proposing new mechanisms to ensure expedited approvals of priority infrastructure and industrial projects. In this melee, Indigenous nations, and our rights and interests, are not discussed — we remain marginalized. Our rights attract attention only when political elites and indeed, most Canadians, think the political agenda is relaxed enough to tolerate it, or there is something to gain through our inclusion. Indigenous Peoples' rights have a legal basis and some Constitutional recognition domestically, and more robust recognition in the United Nations Declaration on the Rights of Indigenous Peoples Act, the gold standard for these rights. Any national policy that ignores these realities will be expensive and vulnerable to litigation and civil society opposition, as evidenced by the pipeline fights in BC and the fishing wars in Mi'kmaw territory. Further, Ontario's 'Ring of Fire' region, invoked by some politicians as an immediate source of state-approved projects for its untapped mineral wealth, is on unceded Treaty 9 Indigenous territory. Ignoring Indigenous nations and rights, as Canada enters a new economic chapter, would shred Canada's reputation, much as ignoring the Canada-USA-Mexico Agreement (CUSMA) shreds America's. Ignoring us is contrary to the last decade of Canada's Truth and Reconciliation work and is a serious risk to both the legitimacy of political elites and the profitability of Canadian industries. Regulatory streamlining anticipated for pre-approved or quickly approved projects benefiting corporate stakeholders with government approvals for pipelines, mines and such, runs right through Indigenous lands, waters and rights. This is true despite the involvement in some projects of a few Indigenous communities or capitalists. Cutting 'red tape' and eliminating regulatory barriers, proposed by a number of politicians and corporate actors, facilitates the fast-forward, consequence-free kinds of approaches beloved by investment capitalists and the governments that service them. However, one critic's 'red tape' is another's regulatory regime ensuring transparency, accountability and compliance with safety codes, environmental standards, and fundamental human rights. Indigenous rights require state recognition and regulatory support. Moreover, Canadians face another existential crisis unrelated to US President Donald Trump's reckless trade war: the breakdown of our climate and natural environment collapse as a direct result of political, corporate and consumer activity. That catastrophe looms at least as large as present economic threats. Indigenous rights and priorities are linked to climate and environmental matters in profoundly important ways. Most of us come from cultures that privilege relationships with everything in our territorial environments. Maintaining these relationships is a primary obligation. Ignoring Indigenous Peoples' rights is contrary to Canada's Truth and Reconciliation work and is a serious risk to the legitimacy of political elites and the profitability of Canadian industries, write Joyce Green and Christine Sy While sharing our fellow citizens' fears about the Trump-induced economic perils, we have fears too, about the trampling of Indigenous rights and interests, seen as impediments to the prime directive of protecting economic growth and the jobs it sustains. We are not entirely hostile to these priorities, but surely, we can expect the elite political class to walk and chew gum at the same time. Canadian governments and citizens must focus on the very serious threats to the state's sovereignty and economic order, while still advancing its ethical relations with Indigenous nations, protecting Indigenous rights and enacting legislation to meet the challenges of the imminent and evident threat of more catastrophic climate change and environmental collapse. Given the erasure of Indigenous nations in public discourse about Canada's future, we wonder if a next iteration of the Idle No More movement is needed to bring these matters into the public eye and get them on the political agenda? Canada wishes to defend its sovereignty in the face of threatening rhetoric from the Trump administration, but it cannot simultaneously ignore the sovereignty of the many Indigenous nations with whom it is in relationship. The colonial rampage has never stopped for us, even if the language framing it has changed. We are still trying to recover from colonialism in a context where it is still unfolding. Some of us are still seeking either negotiation or implementation of treaties. Many treaties that exist are coerced agreements created in contexts manipulated to cause duress, somewhat like the mystifying, ever-changing shifts in trade relationships instigated by the US that Canada faces now. Indeed, Canadians are about to empathize much more personally with the politics of imperialism, the disparity of power relations, and the implications of being subjected to external dominance and exploitation. Might this lend itself to an appreciation of what Indigenous Peoples have and continue to endure? With American imperialism at the door, will Canada reflect on its relationships with Indigenous nations, and recognize that its honour is only as good as its commitment to reconciling its relationship with the Indigenous nations upon whose lands it calls home? First Nations leaders in B.C. lay out their priorities in the federal election
The full implementation of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) in Canada is top of mind for some First Nations leaders in B.C. as federal election campaigns are underway. Terry Teegee, B.C. regional chief for the Assembly of First Nations, said 2021's United Nations Declaration on the Rights of Indigenous Peoples Act is "an important commitment in terms of Crown-Indigenous relationships, to make sure that it's the minimum human rights standard." The legislation ensures that Canadian laws must align with the U.N. declaration that outlines minimum standards for the recognition and protection of Indigenous rights. An action plan for implementation of the act includes 181 measures, all of which Teegee wants to see in place. "The implementation part of it is really slow," said Cheryl Casimer, chief of ʔaq'am and a member of the First Nations Summit's political executive. Casimer and Grand Chief Stewart Phillip of the Union of British Columbia Indian Chiefs said UNDRIP is a priority they want to hear about during the election. Teegee, Casimer, and Phillip are the leaders that make up the First Nations Leadership Council, which is a collaborative political working group that advocates for First Nations issues in B.C. CBC Indigenous spoke to the leaders separately on what issues are important to them. Standing up to the United States Casimer said the provincial government has welcomed First Nations to the table when it comes to addressing tariff threats from the United States and she would like to see the same with the federal government. "Moving forward here on in with whomever becomes the elected leader, I strongly urge that they include First Nations as part of Team Canada," said Casimer. Phillip said threats to Canadian sovereignty and water from the United States amplify the urgency for the government to work with First Nations. The United States recently paused negotiations of the Columbia River Treaty that regulates flood control, hydro-electric power and salmon restoration on the cross-border river. "I am worried about First Nations issues being in the background," said Phillip. Phillip, Teegee and Casimer said they are looking for candidates to talk about reconciliation with Indigenous Peoples. Drinking water legislation Teegee said legislation that had been tabled to ensure safe drinking water for First Nations (Bill C-61) "essentially died" after the Parliament session was prorogued, then dissolved. "We would be really pushing for another potential for legislation on safe drinking water for First Nations people across British Columbia and Canada," said Teegee. Clean water is also a priority for Casimer, who said First Nations and non-Indigenous communities need proper infrastructure to ensure all waterways remain clean. Justice and policing Teegee said ensuring that First Nations policing is recognized as an essential service across the country is important. A new framework for First Nations policing is among the calls for justice of the national inquiry into Missing and Murdered Indigenous Women and Girls. More than $43 million was allocated in the 2021 federal budget for co-developing legislation that would recognize First Nations policing as an essential service. Casimer said she also wants to see more movement on the 231 calls for justice, and lowering Indigenous representation in the justice system. Teegee said he wants to work with the next government to amend the criminal code to criminalize residential school denialism. "I think that is very important as we see more and more denialism across this country," said Teegee. Other issues of concern included child and family services, the opioid crisis and sex-based discrimination in the Indian Act. Teegee and Casimer said they are not endorsing any political party this election. But Casimer said there is more stability and certainty for government and industry when the rights and title of First Nations are recognized. "It's easier to sit down and work with us, than against us," said Casimer. Phillip said he is leaning NDP because he feels they have listened to First Nations. "My heart tells me NDP and I have always supported Jagmeet Singh and his aspirations," said Phillip.
