UP man falls from bridge, clings to tree for 22hrs before rescue
Bareilly: A 25-year-old man who fell from a bridge and was swept away by the swollen Ramganga river to a flooded forested area near Maithra village of Moradabad district on Saturday night managed to somehow grab a branch of Eucalyptus tree and spent nearly 22 hours on it before being rescued around 7pm on Sunday. Satpal Kumar, a daily-wager from Maithra, was on his way to his grandma's house on Saturday evening when he slipped and fell while crossing the Ramganga bridge around 9pm. He was swept away for nearly 1.5-km downstream when the "tree saved his life". "It was a very frightening experience. It was pitch dark at night. The place was flooded and the water below was cold. It was a secluded area away from local settlements. I was terrified and shivering -- both hungry and thirsty. It was raining too. My clothes were already wet. There was nothing I could eat... I survived on rain water," Satpal said of his ordeal. Satpal added that before his phone went off on Saturday night, he managed to luckily inform his brother Veerpal of his plight. With his phone "dead", an SDRF team along with local police located him after a three-hour search operation. He was weak and quite traumatised, police said on Monday. Notably, parts of Moradabad have been struck by floods this monsoon. "By Sunday morning, there was still no trace of Satpal," said Veerpal. "Fearing the worst, we approached Dalpatpur police station. Station in-charge Dharmendra Kumar informed his seniors and initiated efforts to trace him. Police obtained the CDR of Satpal's mobile number, which revealed his location." SSP Satpal Antil added: "Five teams were set up to rescue Satpal." Still coming to terms with the frightening experience, Satpal said, "Throughout the night, I clung on to the tree's branches for dear life, at times struggling to keep balance... Man accused in minor's gang-rape acquitted after 8 yrs in jail
Bareilly: After spending more than eight years in jail, a man from Bareilly (who was 20 at that time) accused in a 2017 gang-rape case was acquitted by Special Judge (Pocso court) Devashish Pandey on Friday. Dhanpal Kashyap couldn't afford a lawyer till 2020. Following his mother's request in Oct 2021, the Bareilly court appointed a counsel for him. Advocate Shashikant Sharma, who represented Kashyap, said, "We'll move court to seek a compensation of Rs 50 lakh, as the prolonged case not only ruined his reputation but also deprived him of the chance to settle down in life. He was finally released on Saturday night." On July 11, 2017, a 16-year-old girl was gang-raped at a village in Bareilly. A case was registered against Dhanpal and another man, Veerpal, and later a charge sheet was filed in court. The girl's dad told police the men assaulted her at gunpoint, but no pistol was found, Shashikant added. The medico-legal report said, "There are no signs of recent sexual assault; however, sexual violence cannot be ruled out." Truck driver acquitted in fatal Panchkula crash over procedural errors
The court of additional chief judicial magistrate (CJM) Kirti Vashista has acquitted Harmesh Kumar, a truck driver from Kharar (Mohali), in a fatal road accident case, in which a 23-year-old man, Veerpal, had lost his life. The acquittal stems from numerous procedural lapses identified in the prosecution's case. The Sector-14 police station had registered a case against Harmesh Kumar on September 3, 2022, under Sections 279 (rash driving) and 304-A (causing death by negligence) of the IPC. According to the prosecution, the accident occurred near the Sector 12-A/Sector 20 light points, involving a Chandigarh-registered motorcycle and a Punjab-registered truck. The victim, Veerpal, originally from Muradabad, UP, was residing in Govindpura, Manimajra, and was working as a technician. His brother, Pritam Kumar, the complainant, stated that Veerpal was en route to IDBI Bank, Zirakpur, for repairing of a tower installed there, when he met with accident. The prosecution alleged that the accused truck driver was driving at high speed in a rash and negligent manner, causing Veerpal's death. However, the court observed critical flaws. The prime witness and complainant, Pritam Kumar, was never examined by the prosecution, severely weakening their case. Furthermore, the informer/eyewitness who notified Pritam about the accident was also not called as a witness. The prosecution failed to include any independent public witnesses despite their availability, and no test identification parade(TIP) of the accused was conducted, casting a 'shadow of cloud' over the prosecution's version. The court emphasised that rashness and negligence cannot be presumed merely from the occurrence of an accident, requiring definite evidence, which was absent as no prosecution witness testified to the accused's rash and negligent driving. Consequently, finding that the prosecution failed to prove its case beyond reasonable doubt, the court granted Harmesh Kumar the benefit of doubt and acquitted him of all charges.
