KUALA LUMPUR, Aug 21 — Home Minister Datuk Seri Saifuddin Nasution Ismail confirmed that the Royal Malaysia Police (PDRM) will reopen the investigation file on the death of tahfiz student Wan Ahmad Faris Wan Abdul Rahman, who is believed to have been murdered at a tahfiz school in Kok Lanas, Kelantan in December 2013. He said the police had no obstacle to doing so because the investigation file for the case in 2013 was complete. "The case of Faris (Wan Ahmad Faris) was in 2013, and the inquest decision was in 2016. What was the inquest's decision? He was found hanging, and there was third-party involvement... that's why the family is now pushing to review the case. "I want to say this, yes... the police will reopen the investigation papers (Wan Ahmad Faris), that have been completed, however at that time (2013) the DPP (Deputy Public Prosecutor) stated that there would be 'no further action' in the case. "I have discussed with the Criminal Investigation Department director what is preventing us from reviewing the investigation papers. The police said there is no problem reopening the investigation papers because they are complete," he said when winding up the debate on the 13th Malaysia Plan (RMK13) motion for the ministry in the Dewan Rakyat yesterday. On Monday, the family of the late Wan Ahmad Faris submitted a letter to Bukit Aman police requesting them to reopen the investigation file into the death of the tahfiz student. In December 2013, Wan Ahmad Faris, who was also a Form Four student, was found hanging in the dormitory toilet of Maahad Tahfiz Sains Nurul Aman, Kok Lanas in Kelantan. His body was reportedly found by the dormitory supervisor after detecting a foul odour from the toilet. Forensic experts who performed an autopsy on Wan Ahmad Faris's body confirmed the case as a sudden death unrelated to criminal elements. However, the Coroner's Court in June 2016 ruled that Wan Ahmad Faris' death was caused by the actions of an unknown individual. The Dewan Rakyat sitting resumes today. — Bernama

KOTA BHARU, Aug 19 — The family of tahfiz student Wan Ahmad Faris Wan Abdul Rahman, who was believed to have been murdered at a school in Kok Lanas in December 2013, has submitted a letter to Bukit Aman police headquarters. Their lawyer Zulqarnain Lukman said the letter was sent yesterday to request that the police reopen investigations into the death, amid renewed public spotlight on fatal school bullying cases after the death of student Zara Qairina Mahathir. 'I hope Bukit Aman will respond swiftly and carry out a proper investigation into the case,' he reportedlty told Kosmo!. 'At the same time, we have also met with the Home Minister's political secretary last Thursday to discuss developments regarding the case.' Zulqarnain said the civil suit filed by Wan Ahmad Faris's family is still ongoing. Meanwhile, Family representative Ali Hanafiah Mohamed, 54, said they were now waiting for Bukit Aman's reply on the matter. He said Prime Minister Datuk Seri Anwar Ibrahim had also been informed of the issue. 'The family is encouraged that it has received the attention of national leaders, and we hope the case will be reinvestigated transparently and thoroughly until those responsible are brought to justice,' he said. Wan Ahmad Faris, who was a Form Four student at the time, was found hanging in a toilet at the Maahad Tahfiz Sains Nurul Aman hostel in Kok Lanas in December 2013. His body was discovered by a hostel warden after a foul smell was detected. A post-mortem initially classified his death as sudden death with no criminal element involved. However, the Coroner's Court ruled in June 2016 that his death was homicide, caused by an unknown individual.

Family files negligence suit against govt, police over tahfiz student's death

(Bernama pic) PETALING JAYA : The family of a former tahfiz student has filed a civil suit against the government claiming negligence and breach of statutory duty in relation to investigations into his death 12 years ago. In a statement today, the lawyers representing the family of Wan Ahmad Faris Wan Abdul Rahman, who was in Form 4 of the tahfiz school, said a writ of summons and statement of claim had been filed at the Kota Bharu High Court. The case is being handled by a team of 10 lawyers and a former deputy public prosecutor, on a pro bono basis. Based on the statement of claim, the suit named the home minister, the police force, the inspector-general of police, and the two investigating officers of the case – Mat Yaman Hassan and Awis Kirani Abdullah – as defendants. It also named as defendants Raja Rozmi Raja Rashid, a police officer stationed in Bukit Aman who was involved in the investigations; Abdul Rozak Muhammad, who was the Kota Bharu police criminal investigations chief at the material time; Nor Yhazid Idris, in his capacity of state criminal investigation department chief; and Fazley Ab Rahman, the then director-general of prosecution at Bukit Aman's criminal investigation department. The plaintiffs, Wan Abdul Rahman Wan Yaacob and Ruhani Hussain, who are Wan Faris's parents, are claiming general, aggravated and exemplary damages from the defendants. They claim that the police team failed to discharge their duty of care in taking necessary investigative steps into the teen's death, including in accordance with Article 5 of the Federal Constitution on right to life, the Police Act, and the Criminal Procedure Code. The plaintiffs also claim that the police failed to provide the family with updates on their probe, including the post-mortem report. They allege that the police failed to look into several important aspects of investigation, including the wounds on Wan Faris's body, blood stains found on his clothing, phone records, as well as claims of bullying at the religious school. As a result, the plaintiffs are said to have suffered mental distress, pain, suffering and anguish. 'The plaintiffs have not been able to get any certainty as to what actually happened,' according to the statement of claim. Last month, home minister Saifuddin Nasution Ismail said the fresh investigation paper into Wan Faris's death had been referred to the Attorney-General's Chambers, confirming that police reopened their investigation into the case. Saifuddin said police recorded the statements of 14 witnesses, including additional statements from the chemist and pathologist who conducted the autopsy on the deceased. Wan Faris's body was found by a dormitory supervisor on Dec 14, 2013, after he detected an odour coming from a toilet at the dormitory. An autopsy classified it as sudden death and ruled out any criminal involvement. However, a coroner's court ruled in June 2016 that he was murdered by an unidentified person.

Blaze guts roof of Kuching tahfiz centre, 24 escape unharmed

KUCHING, July 21 — A total of 20 students and four ustaz from the Mahaad Tahfiz Husnul Khotimah in Semerah Padi, near here, managed to escape unhurt after a fire broke out in the tahfiz centre yester afternoon. The Sarawak Operations Movement Centre announced in a statement yesterday that it received a distress call regarding the incident at 5.47 pm before a team of firefighters and fire engines from the Petra Jaya Fire and Rescue Station (JBPM) and Padungan JBPM were dispatched to the location. The incident involved a fire on the roof of the tahfiz building, while the ground floor of the building was unaffected. According to witnesses at the scene, the fire could have been caused by a short circuit. 'All the residents, namely 20 tahfiz students and four ustaz, managed to escape without any injuries,' said the statement. According to the statement, the firefighters extinguished the blaze using water sources from the fire engines and nearby fire hydrants. The operation was fully completed at 6.48 pm, while the cause of the fire and the value of the losses are being investigated. — Bernama
