Senator Edward Kennedy, a key sponsor of the law, wrote at the time:
'When … children are the victims of an appropriate and rational national policy, a compassionate government will assist them in their hour of need.'
That compassionate government never showed up.
Over 39 years, the VICP has awarded just $5.4 billion to 12,000 victims. That comes out to about '1.2 awards per million doses administered.'
In a brand-new statement on X, Secretary Kennedy said he intends to FIX the broken system.
He explained that the court was meant to resolve claims 'quickly and fairly,' with 'doubts about causation resolved in favor of the victim.'
But that hasn't happened.
'The structure itself hobbles claimants,' Kennedy wrote. 'The defendant is HHS, not the vaccine makers; and claimants are therefore facing the monumental power and bottomless pockets of the U.S. government represented by the Department of Justice.'
He explained how Special Masters, who decide the cases, often come from government or political backgrounds and typically show a strong pro-government bias. 'There is no discovery, and the rules of evidence do not apply,' Kennedy lamented.
He added that petitioners' attorneys report retaliation, fee suppression, and even denied access to the Vaccine Safety Datalink, a taxpayer-funded CDC database containing the best data on vaccine injuries.
Worse, expert witnesses for injured children have reported intimidation and threats to their careers, including the loss of NIH funding if they testify.
But Kennedy says that era is over.
'The VICP is broken, and I intend to fix it,' he wrote on X.
'I will not allow the VICP to continue to ignore its mandate and fail its mission of quickly and fairly compensating vaccine-injured individuals.'
Kennedy added that he is working closely with AG Pam Bondi and HHS staff to restore the court's original mission and pledges to 'steer the Vaccine Court back to its original Congressional intent.'

Most Americans Won't Get COVID-19 Booster This Fall, Survey Says
A majority of Americans said they will likely not receive a COVID-19 booster vaccine this fall, according to a poll released Friday. A survey from the health care organization KFF found that 59 percent of respondents said they either will not or likely will not receive the booster dose. Around 37 percent said they would 'definitely not' receive the shot, while 23 percent said they would 'probably not get' the shot. According to the poll, 21 percent said they will 'definitely' receive the booster, and 19 percent said they will 'probably get' one. The survey, meanwhile, indicated that 36 percent of Americans over the age of 65 said they 'definitely' will get the updated COVID-19 vaccine when it becomes available. Around the same number of Democrats overall also said they would do so, according to the pollsters. This comes as the U.S. Health and Human Services (HHS) Secretary Robert F. Kennedy Jr. has changed the COVID-19 vaccine policy since the Trump administration took over earlier this year. Last month, the HHS dismissed all 17 members of the Centers for Disease Control and Prevention (CDC) vaccine advisory panel, ordered the removal of mercury from influenza vaccines, and ended the CDC's COVID-19 vaccine recommendations for pregnant women and healthy children. The KFF survey found that most Americans say they are confused about the changes to U.S. vaccine policy that have been made in the last six months or so. It also found that 33 percent of all adults surveyed are 'very' or 'somewhat' worried about whether COVID-19 vaccines will be available to them this fall. But most adults, or 67 percent, told KFF they are 'not too' or 'not at all' worried about that prospect, it found. On Thursday, the CDC released data showing that vaccination rates for several diseases, including measles, diphtheria, and polio, decreased among U.S. kindergartners in the 2024–2025 school year from the previous year. For the measles, mumps, and rubella (MMR) vaccine, coverage went from 95.2 percent in the 2019–2020 school year to 92.7 percent last year, before landing at 92.5 percent in 2024–2025. In Texas, the epicenter of the recent outbreak, MMR coverage has fallen to 93.2 percent from 96.9 percent in 2019. The figures brought forth by the CDC did not include data for COVID-19 vaccines, but only included vaccines that are typically given during childhood. In addition, exemptions from one or more vaccines increased to 3.6 percent in 2024–2025 from 3.3 percent the year before, the CDC website said. Exemptions, which can be granted on medical or religious grounds, increased in 36 states and the District of Columbia, with 17 states reporting exemptions exceeding 5 percent, it said. And in a recent report, the CDC said that activity for COVID-19 was low nationwide. Respiratory illness activity, including RSV and influenza, was also described as 'very low' by the agency. 'Very high' levels of the virus were being reported in Texas, Hawaii, and Alaska, while 'high' levels are occurring in California, Louisiana, Alabama, Florida, and Kentucky, according to a map provided by the agency for the week ending July 26.

Lula Threatens Response After Trump Slaps 'Witch-Hunting' Brazil With Highest Tariff-Rate Globally
On Friday President Trump imposed an unprecedented whopping 50% tariff on products imported into the US from Brazil, including nearly one-third of the coffee Americans consume daily. This is despite the US having maintained a trade surplus with Brazil amounting to hundreds of billions of dollars over the past decade, and it's all tied to the political firestorm of ex-leader Jair Bolsonaro's trial, and Trump's efforts to defend his friend known as the 'Brazilian Donald Trump'. The 50% tariff on select Brazilian imports is the highest rate currently applied to any nation globally, and with tiny Switzerland coming in second, having been shocked by its 39% tariff rate, which are the highest tariffs in Europe. On Switzerland, the BBC writes, 'It's the one story dominating the news and the airwaves on Friday. One newspaper, Blick, described it as the country's biggest defeat since French victory in the battle of Marignano in 1515.' But on the Brazil front, President Luiz Inacio Lula da Silva has slammed the Trump tariffs as blatant political interference and says the government is preparing a response. 'We have always been open for a dialogue,' President Lula wrote on X. 'We are working now to respond to the US tariff measures,' Lula da Silva said. 'Only citizens and institutions of Brazil have the right to determine the country's path, including the relations with the United States,' he added. The US has included some exemptions: U.S. President Donald Trump on Wednesday slapped a 50% tariff on most Brazilian goods to fight what he has called a 'witch hunt' against former President Jair Bolsonaro, but softened the blow by excluding sectors such as aircraft, energy and orange juice from heavier levies. Trump announced the tariffs, some of the steepest levied on any economy in the U.S. trade war, as his administration also unveiled sanctions on the Brazilian supreme court justice who has been overseeing Bolsonaro's trial on charges of plotting a coup. Lula previously vowed to introduce tit-for-tat tariffs if Washington does not reconsider, while also expressing hope that his Brazilian delegation will be able to achieve the revision of tariffs through negotiations. Eduardo Bolsonaro, son of the former president, has defended Trump's actions, saying it's not about revenge, but justice. Meanwhile Trump has said that President Lula can call him anytime.
