SC upholds order declaring wife owner of deceaseds land

New Delhi, Jul 17 (PTI) The Supreme Court on Thursday upheld an order declaring a deceased man's wife the rightful owner of his land and said the non disclosure of her status or the reason of her disinheritance in the will ought not be examined in isolation but in light of the case's facts.
A bench of Justices Sanjay Karol and Joymalya Bagchi therefore dismissed the challenge to a Punjab and Haryana High Court order passed in November 2009, declaring the wife as the owner.
The bench noted after the man died in November 1991, his nephew filed a suit by propounding a will executed by his uncle in May 1991 bequeathing the land to him.
The trial court declared the May 1991 will as genuine and by its virtue, the nephew of the deceased was the lawful owner of the land.
The high court subsequently overruled the decisions of trial court and the first appellate court, declaring the wife was the rightful owner of the land.
Both claimants, the wife and the nephew of the deceased, died during the pendency of the case with legal representatives substituting them in the top court.
Unlike other documents, the bench said, when a will is propounded, its maker is 'no longer in the land of living".
The court, therefore, pointed out, 'This casts a solemn duty on the court to ascertain whether the Will propounded had been duly proved." The onus lay on the propounder not only to prove due execution but dispel from the court's mind all suspicious circumstances that cast a doubt on the free disposing mind of the testator, it added.
'What boils down from this discussion is that suspicious circumstance, i.e., non­-mention of the status of wife or the reason for her disinheritance in the Will ought not to be examined in insolation but in the light of all attending circumstances of the case," the bench said.
It said the nephew's case was not only to propound the will in his favour, but also to deny the status of the respondent as the deceased's wife.
Calling the will 'cryptic" the bench noted that the deceased bequeathed his properties to his nephew for taking his care.
'However, the will is completely silent with regard to the existence of his own wife and natural heir, i.e., the first respondent, or the reason for her disinheritance," it added.
The bench further said the trial court 'erroneously" observed that the non-performance of last rites of the deceased by his wife hinted at 'sour relations" between the couple.
'Ordinarily, in a Hindu/Sikh family, last rites are performed by male Sapinda relations. Given this practice, first respondent (wife) not performing last rites could not be treated as a contra indicator of indifferent relationship with her husband during the latter's lifetime," it held. Lucknow: The Directorate of Enforcement (ED), Lucknow Zonal Office, completed search operations at 15 locations related to Chhangur Baba, his close associate Naveen Rohra, and others in Balrampur, Lucknow, and Mumbai. These operations were conducted under the provisions of the Prevention of Money Laundering Act (PMLA), 2002, in connection with a money laundering case related to Chhangur Baba and others on Friday. The ED initiated the investigation based on an FIR registered by ATS, Lucknow, under various sections. The FIR alleged a large-scale conspiracy involving unlawful religious conversions, utilisation of foreign funding, and activities posing a potential threat to national security. Chhangur Baba and his associates are alleged to have established an extensive network operating from the premises of Chand Auliya Dargah, Balrampur, where he regularly organised large gatherings attended by both Indian and foreign nationals. He is accused of systematically inducing, coercing, and manipulating individuals of other faiths—particularly Scheduled Castes and economically disadvantaged persons belonging to the Hindu religion—into religious conversion. The ED sources said that during the course of the investigation, 22 bank accounts related to Chhangur Baba and his associates were analysed. From the analysis of these bank accounts, funds amounting to more than Rs. 60 Crore received by Chhangur Baba and his associates were identified. It was also revealed that a large amount of funds was received from foreign countries by Chhangur Baba and his associates. During the searches, a number of documents were seized, which revealed that the funds, which are nothing but proceeds of crime, were majorly transferred to different people for purchasing a number of immovable properties worth crores of rupees and carrying out construction activities on these properties. The evidence collected during the searches revealed that all the immovable assets acquired by Chhangur Baba are in the names of his associates, Naveen Rohra and Neetu Rohra, to conceal his actual involvement in money laundering. The searches also resulted in the recovery of physical records relevant to the investigation. Further investigation is in progress.

Jaipur: Rajasthan High Court (HC) dissolved a marriage that had effectively ended years ago, ruling that forcing a husband and wife to continue a dead relationship after a 17-year separation amounts to cruelty to both parties. The division bench of Justices Inderjeet Singh and Anand Sharma was on Thursday hearing an appeal filed by Ratiram Shukla from Alwar district. Shukla had married Kishandevi in Feb 1991 as per Hindu rites. In his divorce petition filed in 2010, he alleged that from the very beginning, his wife had behaved cruelly, refused to live with his parents, and repeatedly denied cohabitation. According to him, she finally left the matrimonial home in 2008 and never returned. The trial court dismissed Shukla's petition in 2017, but HC noted that the couple had had been living apart since 2008 and there was no evidence to contradict the claim that Kishandevi had deserted her husband. The judges also considered that Kishandevi filed criminal cases against Shukla under IPC Sections 498A and 406, which ended in his acquittal in 2016. The bench quoted an SC judgment, which held that where a couple has not lived together for decades and there is no possibility of reunion, continuing the marriage is tantamount to inflicting cruelty. While setting aside the trial court order, HC concluded that Shukla had successfully proved desertion and cruelty, and allowed his appeal, decreeing the dissolution of the marriage.
