UK man claims trial to alleged sexual assault on Indonesian man

PETALING JAYA: A British tourist claimed trial at the magistrate's court today to a charge of using criminal force to outrage the modesty of an Indonesian man earlier this month.
Adekoya Oluwatoyosi Osideinde, 31, pleaded not guilty when the charge was read out to him before Magistrate Shahril Anuar Ahmad Mustapha.
"I understand (the charge). Not guilty," he said from the dock.
The bespectacled accused, dressed in a purple prison outfit, was brought into the courtroom at about 9.40am. He was seen clasping his hands together during the proceedings.
Earlier, when the case was called with his name, Osideinde stood up and said, "Yes, that is me."
His lawyer, Sivaraj Retinasekharan, requested that the charge be read out in English to ensure his client fully understood the allegation.
According to the charge sheet, the foreigner was accused of committing the act against the 47-year-old victim at about 8.34am in a hotel room here on Aug 2.
The charge, under Section 354 of the Penal Code, carries a maximum 10-year jail term, or a fine, or whipping, or any combination of these, upon conviction.
Deputy public prosecutor Lim Leong Hui did not offer bail and asked the court to set a date for document submission.
In his bail application, Sivaraj asked that his client be granted minimal bail.
"He is a freelance independent wealth consultant with a valid tourist visa until September.
"He is innocent until proven guilty. Setting a high bail sum would amount to punishing him.
"If it is too high and he cannot afford it, he will remain in jail until the case is resolved, which may take up to a year," he said.
Sivaraj said his client had previously been charged in a separate drug case at the magistrate's court and was granted bail of RM5,000 with two sureties.
"There is no probability he will abscond on future court dates.
"He cooperated fully during investigations. Two local friends are willing to be his bailors and will ensure his attendance in court.
"I ask that a low bail be imposed, with two sureties, and that he is to report to the Petaling Jaya district police headquarters.
"We have no objection to the court impounding his passport, which is still valid," he said.
The magistrate granted the foreigner bail of RM6,000 with two sureties and set Oct 2 for mention.
After proceedings, Sivaraj said his client's friends would post bail, though he was unsure whether it would be done today or tomorrow.

Chinese national jailed a month, fined for attacking immigration officer

Published on: Monday, August 18, 2025 Published on: Mon, Aug 18, 2025 By: FMT Reporters Text Size: According to the charge, Fang Fuyuan had intentionally caused hurt to immigration officer Nurdiana Atirah Shapinaz Abdul Rahman, who was working at the KLIA Terminal 1 immigration counter. PETALING JAYA: The Sepang magistrates' court today sentenced Chinese national Fang Fuyuan, 31, to a month in prison and a fine of RM2,000 for hurting an immigration officer at KLIA Terminal 1 on Aug 13. Berita Harian reported that she pleaded guilty to the charge under Section 332 of the Penal Code for voluntarily causing hurt to a public servant. For this offence, a person can be jailed up to three years, fined, or both, upon conviction. According to the charge, she had intentionally caused hurt to immigration officer Nurdiana Atirah Shapinaz Abdul Rahman, who was working at the immigration counter. Fang's lawyers Tai Ying Fong and Jason Anthony had appealed for a lighter sentence on the basis of her young age and lack of a criminal record. '(Fang) has a husband and two small children, aged one and a half and five years, who are completely dependent on her. 'The family is in Malaysia without the support of other family members. 'This was a case of misunderstanding and miscommunication with the immigration officer. It occurred spontaneously and was not planned,' they said. However, deputy public prosecutor Luvithaa Veerasamy pressed for a fitting sentence that would serve as a deterrent to the accused and the public. Fang will serve her sentence starting from the date of her arrest on Aug 13. If she fails to pay the RM2,000 fine, she will serve another two months. Earlier, KLIA deputy police chief Albany Hamzah said statements from four people, including the victim, were recorded in connection with the case. The incident took place at about 7.40pm at the departure hall, when the group was undergoing immigration clearance. The woman was said to have acted aggressively and injured an immigration officer during the process, claiming she was worried about missing her flight. The officer sustained a swollen left eye and pain on the right side of her head following the assault. She was sent to Cyberjaya Hospital for treatment. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news? In a statement on Monday, the team welcomed the Attorney-General's decision to bring charges, describing it as in line with their earlier recommendations. They noted that their proposal on 14 August urged prosecution under Section 507D(2) of the Penal Code, following Bukit Aman investigations that revealed evidence pointing towards bullying. The lawyers stated that they are not yet aware of the identities of the individuals who will be charged or the exact provisions that will be applied in court. The family's legal team comprises Hamid Ismail, Shahlan Jufri, Rizwandean M Borhan, Mohd Luqman Syazwan Zabidi, Mohd Syarulnizam Mohd Salleh and Farrah Nasser. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news?
