Allahabad HC rejects plea to implead Radha Rani in Krishna Janmabhoomi title suit

LUCKNOW: In the Krishna Janmabhoomi - Shahi Eidgah title dispute case, the Allahabad High Court has rejected the Hindu side's plea to implead deity Shriji Radha Rani in the case on the grounds that "Pauranic illustrations are considered hearsay evidence.'
The Court said that Shriji Radha Rani was not a necessary or proper party to be impleaded in the case, and if she was included, it would change the basic nature of the title suit.
The plea was filed under Order 1 Rule 10 of the Civil Procedure Code by advocate Anil Kumar Singh Bishen, who represented Shriji Radha Rani through her 'next friend' Reena N Singh.
The applicant had urged the court to make Shriji Radha Rani a joint plaintiff in Original Suit No. 7 of 2023, which was filed by Shri Bhagwan Shrikrishna Lala Virajman and others against the UP Sunni Central Waqf Board and the Shahi Idgah Masjid Committee.
The suit pertains to 13.37 acres of land in Mathura, which the plaintiffs claim is Lord Krishna's birthplace.
They claim that the Shahi Idgah Masjid was illegally built during the Mughal period by demolishing this holy site. The plaintiffs have presented historical records, reports from the Archaeological Survey of India (ASI), and references of Hindu scriptures to support their claim demanding the removal of the structure.
In her plea, Shriji Radha Rani's side argued that she was deeply connected with Lord Krishna and was his eternal consort; she also had the rights over the disputed land.

Leader of Opposition in West Bengal Assembly Suvendu Adhikari on Friday alleged the Trinamool Congress government is distributing 'sweets from local shops' as 'prasad' of the Digha Jagannath temple, and has accused the administration of playing with the sentiments of Hindu devotees. 'All District Magistrate were ordered to distribute prasad through Duare Ration. The box of sweets will be bought from the local sweet shop. An amount of Rs 20 has been allocated. I have no problem with the budget, but they are not giving the prasad, which is basically demeaning the Hindu dharma,' Adhikari said. The Jagannath Temple at Digha in Purba Medinipur district was inaugurated by Chief Minister Mamata Banerjee in May. After inauguration Banerjee said, the 'prasad' of Jagannath Dham will be distributed to all families of the state along with picture of the temple. In response, the TMC termed Adhikari's comments as a 'pack of lies' and asserted that the prasad of Lord Jagannath will be sourced from the temple and arrangements have been made to send it across every locality in West Bengal. Ghaziabad: UP govt has announced significant reforms in its marriage registration policy, mandating video evidence of ceremonies and physical verification of priests. The new directives, issued on Friday following an Allahabad High Court order, said priests must submit notarised affidavits, appear as witnesses on behalf of couples at registration offices and possess a pen drive containing videos of the wedding. Marriage registrars would now accept applications from couples only if one of them is a permanent resident of that particular district. The govt move follows an HC order from May 12, seeking to address a rise in forged certificates and false documents linked to bogus marriages. The court was hearing a writ petition filed by a Greater Noida couple who claimed to have got married in Arya Samaj Mandir in June last year and secured a registration certificate in Ghaziabad. During the hearing, the court found that the certificate lacked the priest's name, the registered address of the Arya Samaj Mandir, and details of witnesses. The couple also did not appear before the local police, but sent a request seeking protection from their families from the post-office located on the HC premises. The HC ordered a probe into widespread irregularities in the state's marriage registration system, particularly in districts like Ghaziabad, Noida and Prayagraj. The scale of the problem became evident when the probe revealed that Ghaziabad alone recorded 29,022 marriages between Aug 2023 and Aug 2024 – nearly 10 times more than other key districts like Prayagraj (2,019), Gorakhpur (2,284), and Varanasi (2,711). More startlingly, smaller districts like Shrawasti and Chitrakoot registered only 51 and 112 marriages, respectively, during the same period. The investigations also revealed that couples from places like Ahmedabad claimed to have solemnised their marriages in Maharashtra, yet obtained registrations in Ghaziabad to secure court protection orders. In these cases, supporting documents such as Aadhaar and PAN cards often turned out to be forged or altered. Other fraudulent practices included certificates issued by non-existent societies, fictitious witnesses, and cases where minors were presented as adult brides. The HC also observed that the Uttar Pradesh Marriage Registration Rules, 2017, offered limited safeguards. For instance, these rules did not require applicants to declare specific customs observed during the wedding, while the digital registration portal provided no means for marriage officers to reject suspicious requests or track those denied. Concerned about widespread exploitation of these gaps, the HC recommended amendments to the 2017 rules. Until then, the measures announced by the govt will stay. "Under the new directives, marriage registration applications will only be accepted from couples if any one present with them is a permanent resident of the district where they are applying. This applies to either the bride, groom, or their parents. Temporary accommodation documents, such as unregistered rent agreements, will no longer be considered valid proof of residence," said Pushpendra Kumar, assistant inspector-general (AIG, stamps), Ghaziabad. In cases where a couple register their marriage without parental consent, the priest who performs the ceremony must be physically present at the time of registration. "They need to submit affidavits with complete details and video evidence," Kumar said. The notification, signed by inspector-genera (stamps) Sameer Verma, allows marriage officials some flexibility if parents or adult family members from both sides are present. "If parents or adult family members of both parties are present and vouch for the marriage, the marriage registration officer may waive the video and priest affidavit requirements, provided they're satisfied with the marriage's authenticity," the notification read. Each registration performed under the new rules would have a special stamp, while the priest's affidavit and related documents would be subject to thorough verification. District offices would have to maintain a separate register containing credentials of the priest, such as their Aadhaar details, phone numbers, and photographs. "We applied the residency rule locally in Ghaziabad back in April in keeping with the high court's interim directions. The other rules will also be implemented with immediate effect," AIG Kumar said. Two back-to-back murders in Dakshina Kannada, each laced with communal undertones, have finally jolted the government to action. Police officers are now cracking down on lumpen elements across communities – a much-needed move to restore order. The government has rightly overhauled the police top brass in Dakshina Kannada and neighbouring Udupi, signalling a firm resolve to address the escalating communal tensions. But even as law enforcement begins to act decisively, Union Minister of State for Labour and Employment Shobha Karandlaje has chosen a troubling path. She has written to Justice N K Sudhindra Rao, chairman of the Police Complaints Authority, alleging police harassment of 'innocent' Hindu activists. A copy of the letter has also been marked to the National Human Rights fact finding committee on DK murders to submit interim report next complaint is both misplaced and misleading. As a constitutional authority, she should stand by the law, not those who flout it. The police have been doing their duty in a district teetering on the edge. Her letter, devoid of specifics, amounts to a blatant interference in the enforcement of law and order. The claim that GPS tracking is being used to target Hindutva activists holds no water – modern technology tools are legitimate instruments to track criminal suspects irrespective of their religious identity. Who exactly are these 'innocent' people she wants to shield? Many are known offenders. For instance, Suhas Shetty whose recent murder sparked outrage was a rowdy sheeter with two murder charges against him, all booked when BJP was in power. Karandlaje's portrayal of police action as one-sided is factually incorrect. The list of anti-social elements who the police propose to extern from the district includes those from both Hindu and Muslim communities. Such interference from a union minister not only undermines the police action to restore peace but also sends dangerous signals that political patronage can shield anti-social elements from the due process of law. They should act even against those occupying top positions if they engage in hate speech or incite violence. The state government must back the police not just with moral support, but with robust legal resources that ensure that these criminals don't get a reprieve from the court. The coastal districts need healing and that will happen only when politicians stop stoking fires, and allow the law to take its course.
