Cops to set up task force to probe fatal Gerik crash

GERIK: Police will set up a task force comprising technical experts from various agencies to probe the fatal crash involving an express bus and an MPV, which killed 15 people here early this morning.
Bukit Aman Traffic Enforcement and Investigation Department director Datuk Seri Mohd Yusri Hassan Basri said the police-led task force would include experts from the Road Transport Department, the Land Public Transport Agency, Puspakom, the Chemistry Department, the Health Ministry, the Works Ministry, and the state Works Department.
He said the team will support the police's probe into the accident.
"(The team will) help complete the investigation papers as soon as possible so that we can bring the driver to court," he told reporters after visiting survivors at the Gerik Hospital.
"To members of the public, if you have any information related to the accident, please come forward to the police to assist with the investigation.
"Please avoid spreading information about the incident through social media or mass media as it can create confusion and interfere with the investigation."
Asked if the driver had any previous traffic record, Yusri said the matter was still in the early stage of investigation.
"We will be looking into all aspects: the driver's record, his background, his previous activities, and his employment history.
"So far, I can only say that we will complete the investigation papers and examine the matter from every angle, to ensure the prosecution can proceed in court smoothly and effectively," he added.
Asked on the ill-fated bus's maintenance record, Yusri said the task force would gather all necessary reports, including details about the bus, its condition, the driver, and more.
"That is all the information I can share at this time," he said.
Earlier, 14 UPSI students and a bus assistant were confirmed dead and seven others seriously injured when the bus they were travelling in overturned along Jalan Jeli-Gerik near Tasik Banding early this morning.
The chartered bus was carrying 42 UPSI students who were travelling from Terengganu back to the university's campus in Tanjung Malim.
Preliminary investigations indicate that the bus hit a Perodua Alza from behind before the driver lost control and the vehicle skidded off the road.

'Pencil box lawyer' not liable in RM7.7mil Medi Circle case, court rules

rahmat@ SHAH ALAM: A High Court here has dismissed a lawsuit brought by a hospital operator against its former lawyers, who were accused of professional negligence in a separate medical negligence case. The ruling means Medi Circle Sdn Bhd, which runs a hospital in Bangi, has failed in its bid to sue its former legal counsel. Judge K. Muniandy ruled that the law firm Messrs A M Zaharil & Co, and its partner, Datuk Ahmad Zaharil Muhaiyar, had not breached their duty of care when representing the company. The judge said Medi Circle failed to prove its claims of professional negligence. The case was over a medical negligence claim where the company was ordered to pay RM7.7 million in damages. Ahmad Zaharil is known as the "pencil box lawyer" for a story in which he represented a mother charged with shoplifting a pencil box for her son. The son was later inspired by Ahmad Zaharil's compassion and became a lawyer himself. Medi Circle, which was represented by Ahmad Zaharil in the original medical negligence suit, later filed a separate action claiming that the lawyer had failed to competently defend the company. The hospital operator alleged that key witnesses were not called and that the cross-examination of the plaintiff's witnesses was inadequate. The court, however, ruled that legal strategy decisions, including the conduct of cross-examination and the decision to rely on evidence tendered by co-defendants, fall within the purview of counsel and should not be judged with the benefit of hindsight. "The defendants carried out their scope of duty as retained, and there is no conclusive evidence to show that the alleged professional negligence caused the adverse outcome in the medical negligence claim," the judge said in his 20-page written judgment dated Aug 5. "The plaintiff failed to establish a direct causal link between the alleged negligence and the loss suffered, particularly given the affirmation of liability against the plaintiff by the appellate courts." Muniandy said Medi Circle had the opportunity to raise concerns or appoint alternative counsel during the trial, but did not do so until a much later stage. "Even then, the plaintiff could have taken steps to recall witnesses or adduce further evidence, but such steps were not taken," he said. The court also found that the hospital had failed to provide its lawyers with crucial information and medical records needed to mount a proper defence. The judge said the absence of these documents was cited by the appellate courts as a major factor in upholding the finding of negligence against the hospital. Muniandy also dismissed the company's allegation that Ahmad Zaharil had fallen asleep during the trial, citing a lack of conclusive evidence. "Based on the available evidence, this court finds no conclusive proof that the second defendant was in fact asleep," he said, adding that Ahmad Zaharil was also assisted by an associate who was present at the trial. The court also awarded RM20,000 in costs to the defendants.

rahmat@ KUALA LUMPUR: Prosecutors in Lim Guan Eng's corruption trial are considering applying for witness protection after a key witness was attacked. A group of masked men broke into the witness' Petaling Jaya home and assaulted him. The motive for the attack has not been established, but lead prosecutor Datuk Wan Shaharuddin Wan Ladin said the team was considering witness protection. Wan Shaharuddin said the matter would be raised before Sessions Court judge Azura Alwi when the trial resumes on Aug 19. "Our witness has yet to finish giving his testimony, we will see later," he said when met at the Court Complex in Jalan Duta. Earlier today, the New Straits Times reported that the witness was attacked by 10 unidentified men who also tied up two security guards before storming the house. Lim is facing four charges of using his position as the then Penang chief minister to solicit gratification to help a company secure the undersea tunnel project. He was alleged to have sought 10 per cent of the profit to be made by the company. He was also accused of receiving RM3.3 million for himself and causing two plots of state government land to be disposed of to two companies linked to the undersea tunnel project.
